- Anonymous| 1 replyI received a call from this phone number on 08/21/14; the caller left a message with my assistant, who wrote the information. The caller gave their name as "Kyle Evans," left their phone number, and then also left a "record number." I called the number, and they immediately asked for the "file number," which immediately sounded fishy. I said I there none given, and asked again to speak to Kyle. The person became more insistent, and I became more certain to give them no more information. They handed me off to another person after a brief hold, and this person demanded a "file number." I asked them what the initial call was in reference to, and they became belligerent, and would not reply. I asked them what the nature of their organization is, and the person said, "We file lawsuits." I said, "Oh, you must have called us by mistake," and then I hung up. I searched Google for "Kyle Evans" and "fraud" and found records on this site from 2012. It seems the scam has been silent for a while, and is now active again. I could find no other information about this, except an interesting PDF file from the AZ Attorney General of a Kyle Evans sued by the state of AZ in 2009 for fraudulent web-site sales.

- Scott| 2 repliesReceived a voice message from this number, on 8/25/14, from an individual identifying himself as "Donald West". He proceeded to inform me that he was calling in regards to a complaint that was sent to his office. He said that I could contact the department that was in charge of my "file number", and he left me this phone number to call back, as well as my "file number", so I could discuss the "pending actions being filed against you". He proceeded to say that, if no response was received, then "they would be forced to make a decision without your consent". At no time during the message, did he ever mention the name of the company he works for, or what type of company it is, or what the "pending actions being filed against you" were concerning. I am a single man who makes a small living, since recovering from a stroke 3 years ago. I have no credit cards, or any other kind of debt. I live with my son, who takes care of me, and have never had a legal problem of any kind. I called the number and had the same experience, as the anonymous person who posted on this site a few days ago. This is a TOTAL SCAM!!! I am pursuing legal action through my state's Attorney General's office.

- Brian replies to ScottI called them back they wouldn't give me a name of their law firm and also said I would be served at my job by the end of the day! Supposedly I had a bank account that I overdrafted 12 years ago and they were suing me for the money plus interest but I could take with out having to go to court. The funny part is they told me the account was paid off by the Federal Reserve they gave me an account # and told me to call the bank at only this number, they number didn't Google back to the bank. I looked up a few things in NJ were I live they can sue you for a debt after 6 years. I felt like it was a scam but they know way to information about me and it bother me that they did!!! Called and left a message on my work phone and called my sister. Don't waste your time calling back it is a scam to get you to pay for some [***].
- Jane replies to ScottHad a call from an unknown number at 12:18pm today from "Donald West" and left the same message. Wondering what actions can be taken.
- RobThis Donald West guy must be on a roll. Called me from an unknown number and was trying to get a hold of my wife using her maiden name. Same exact spiel it sounds like a scam to me!
- Caller: Donald West
- Anonymous IIHad the same thing happen to me and my husband today, only he said his name was Robert Pierce. First he called my husband's cell and then our house number. He asked for another family member that has never lived with us. I told them there were nobody here by that name. He then proceeded to tell me that I was married to this person he mentioned and I said well that's news to me. He kept asking me if my name was such and such. I never would answer him. I just told him you asked for so and so and I told you there is no one here by that name.
- annoymous| 1 replyI rec'd a call today from a person (don't know the name) claiming they were en route to deliver me legal papers at a place of business that I used to work at, my location has moved. They asked me to meet the driver for him to deliver the package, LOL. Then they asked me for my birth date after they verified my name. At that point I said you are getting no personal information from me, deliver what ever you need to deliver and I hung up. This is the 3rd time this year I have gotten this call, no deliveries ever come. What bothers me is they claim they got my new work number from my human resources department and they claim they never rec'd a phone call. This is a scam and I am filing a complain with the police department as I have in the past.

YOU'RE A SCAM. AND I AM REPORTING YOU .- Caller: null
- target| 1 replyGot a voicemail from "Myra Cruz" who sounded frantic and said she was trying to reach someone in management or HR here about an employee complaint. Left a file number but no employee name. Different than some of the other reported calls I see here but also a fishing for information call that would only lead to some attempt at a scam. Nobody but law enforcement should ever call these people back.
- Caller: no company name givern
- Miss M.My mother in law received 2 phone calls from Donald West from the number 855-441-3331, about 'pending action against' not myself, but my younger brother. Left a file number, a phone number for them to be contacted at to 'discuss options' and a local address in Tacoma, Washington. Nice try Mr. West, but you're a scam artist and will be reporting you promptly.

- JamesBond| 7 repliesHas anyone ever been served with papers? I made a complaint with the FTC today, and if they get more complaints this company can be shut down...also when I called the phone # the guy said they were in Anaheim Ca.
- MJG replies to JamesBond| 6 repliesYou are NOT warned if a summons is to be served. The server arrives unannounced. This is a scare tactic (illegal) bottom feeding debt collectors use to scare you.
- jamesbond replies to MJG| 5 repliesYes I'm aware of that, I'm trying to find out it this is a real company...I made a complaint on them.
- Alfalfa replies to jamesbond| 4 repliesThe Federal Trade Commission (FTC), the nation's consumer protection agency, is warning consumers to be on the alert for scam artists posing as debt collectors. It may be hard to tell the difference between a legitimate debt collector and a fake one. Sometimes a fake collector may even have some of your personal information, like a bank account number. A caller may be a fake debt collector if he:
•is seeking payment on a debt for a loan you do not recognize;
•refuses to give you a mailing address or phone number;
•asks you for personal financial or sensitive information; or
•exerts high pressure to try to scare you into paying, such as threatening to have you arrested or to report you to a law enforcement agency.
If you think that a caller may be a fake debt collector:
•Ask the caller for his name, company, street address, and telephone number. Tell the caller that you refuse to discuss any debt until you get a written "validation notice." The notice must include the amount of the debt, the name of the creditor you owe, and your rights under the federal Fair Debt Collection Practices Act.
If a caller refuses to give you all of this information, do not pay! Paying a fake debt collector will not always make them go away. They may make up another debt to try to get more money from you.
•Stop speaking with the caller. If you have the caller's address, send a letter demanding that the caller stop contacting you, and keep a copy for your files. By law, real debt collectors must stop calling you if you ask them to in writing.
•Do not give the caller personal financial or other sensitive information. Never give out or confirm personal financial or other sensitive information like your bank account, credit card, or Social Security number unless you know whom you're dealing with. Scam artists, like fake debt collectors, can use your information to commit identity theft – charging your existing credit cards, opening new credit card, checking, or savings accounts, writing fraudulent checks, or taking out loans in your name.
•Contact your creditor. If the debt is legitimate – but you think the collector may not be – contact your creditor about the calls. Share the information you have about the suspicious calls and find out who, if anyone, the creditor has authorized to collect the debt.
•Report the call. Contact the FTC and your state Attorney General's office with information about suspicious callers. Many states have their own debt collection laws in addition to the federal FDCPA. Your Attorney General's office can help you determine your rights under your state's law.
