SIMPLY PATHETIC!

- csoDebt collectors are highly motivated to convince debtors to pay the debt because they work on a commission. This business model has created the reputation for bill collection agencies that we know today.
The collector might engage in threatening behavior and harassment. However, like any other business they are governed by laws that prohibit certain abusive practices.
There are three reasons for a debt collector to contact you: your creditor has not received a payment from you within the time frame discussed in the contract; you are a victim of an identity theft meaning someone used your identity to obtain credit and didn’t pay it off; and finally, you might be contacted by collectors who are looking for someone other than you .
When contacted by a collector, take as much information as possible from the caller. Ask for the name of the company, address, the caller name, fax and phone number, amount owned, and the name of the creditor who passed your account to them. Also, tell them you expect to receive a notice in the mail concerning this debt. The last step is very important because you need to have proof of the debt in question in writing.
If you discovered that the debt is not yours, never pay it off simply to get rid of the collector. Also, never ignore the collector either. They will not stop contacting you, and may even file a lawsuit against you. If you are repeatedly being contacted by a collector looking for someone other than you, it may be considered a form of harassment. To stop this you need to send them a letter requesting to cease calls.
If you established that the debt is yours and you don’t feel comfortable dealing with a collector via phone, tell them you want all future correspondence in writing. You need to send this request via a certified mail and request a return receipt. If you want to allow calls only between 5pm and 6pm, tell them about it in the letter. By law collection companies are required to respect your privacy and will have to cease all phone calls to your home, relatives, neighbors, and work.
Once you have their claims in writing it’s easier to seek legal help, and keep records of your correspondence.
Send all your responses to bill collectors via Certified Mail. This way you will have proof of receipt by the addressee.
Remember that the amount they claim you owe is negotiable. You can negotiate the total amount due, number of payments, and the payment deadline. Once you worked out the payment plan, request it in writing.
What a debt collector CANNOT do:
•Use deceptive practices. For example, threaten you with arrest or trick you into paying for collection calls.
•Use obscene language.
•Call you at work after you tell them that your boss does not approve these calls.
•Deny you the right to receive a written notice (within five days after your first phone conversation) that would tell you how much you owe and the name of the creditor that says you owe the money. If you do not receive the notice within five days, call the collection agency and ask for its address and fax number. Then, send a letter to the collector noting its failure to send you the required notice. As a minimum, make a note in your file.
•Refuse to give its name and the name of the collection company when asked.
•Put a debt on your credit report if you file a dispute. It must validate the debt by obtaining a verification of the debt or a copy of a judgment from the creditor before continuing their collection efforts. The results of the investigation must be mailed to you.

A few years ago Jackson Hewitt was doing Christmas Loans to give you advance money on your taxes. They were through Metabank & you received a pre paid card. Why this is just showing up now I don't know but I doubt this a law office, probably just a bill collector posing, hope this helps. Also when I call & ask what there name is because they mumble it they try to give me crap about telling me who they are......

- Victoriagot a call from 1-855-603-4126 x302, Investigator David Grossman was then name left on my voicemail. Name of the company was not pronounced clearly but sounded like Kramer, Wald and Assoc??? Claims he had my social security# and that I was the respondent in a deposit check fraud case. Went on to say that check fraud was a serious crime in the state I live in. I have reported this to the local authorities and will be reporting this to the Fair Debt Practices and Collections Act regulators. He should not be leaving false information, or any information for that matter that was explicit in nature, and accusing me of a crime I didn't commit, along with my full name. He has no right to connect my name with a crime and leave it on a voicemail. If and when he calls again, I am to contact the local authorities and they will take preventative action to stop this unlawful practice. I urge you to report any contact you have with this phone # in order to stop this unethical, unprofessional and slanderous, investigator David Grossman.

- KarenI received a message for my ex-boyfriend on my answering machine from investigator Ross,saying that his social security number was attached to check fraud as well, that is kind of hard since he does not have a checking account. Investigator Ross said where he was calling from but could not understand a word he said. He states that in Michigan (where we both live) this is a serious charge and that he needs to return his call to 1-855-603-4126 x 304, so me being me, I called this number hoping to just get the name of the company and this guy answers the phone, not sure why he provided an extension if he just was going to answer the phone, I hung up then he called me back, and I did not answer nor did he leave a message.

- LolaI have been getting phone calls within the last week from a number 855-603-4126. This person says her name is Investigator Washington and she has filed a claim on me for check fraud. First of all I do not have a checking account. So I don't write checks. And most of the time she calls, her calls are not clear to understand what she is saying, like who the company she is calling for. But she tells me its imperative that I call her back about this matter and she also gives me a claim number. She says that my ss# is attached to this claim. This is scary.

- Rush 2112Investigator Ross called and left a msg however he had my first name wrong. He made the same claim.. My ssn was attached to a check fraud occurrence and it is imperitive I call back. These guys are scammers fishing for suckers. Pay these guys anything and you'll get ripped off bad! Report these guys to the local authorities and the FBI. Do not call them from your home number, call them from a public phone and advise them you are recording the call and ask them for the name of their company. They wont tell you because they are trying to steal from you. Your personal information may be compromised, you would be smart to check your credit bureau info. If you can keep them on the line ask them for the location where the check fraud occurred and tell them to hold while you conference the call with your friend the FBI agent. Chances are you will never hear from them again!

- ShanDeI received a call from these people last month claiming that I owed $825 or charges were going to be against me for check fraud . They used the name Washington, Krammer, and Wall, and assoc. In the past I did an online payday advance...do not ever do this, it has been a nightmare! Well I paid them the $825 because I thought the debt consolidation place I used didn't pay them off...I panicked. Now, today, they called me again and said the same thing...I told them I paid them!!! They get off the phone for a while then get back on like they talked to their manager and said oh ok but now we need a payment of $115 in order to clear this issue from being associated with my ssn and to issue me a letter which says I am cleared of this debt! Wtf! Last month they told me I would not b bothered by them and it was taken care of. They have my bank info. I'm not sure what to do!

- jodyShanede, I had the same thing happen with a different company. I disputed the transaction as fraud with my bank, closed the account and opened a new one. I got all the money back. It may seem like a hassle but that's about all u can do.

- LynnThis company is a collection agency with very unprofessional, rude, and dare I say ignorant employees. People stay empowered about your rights as dismiss this company completely. If you truly owe the bill contact the original creditor otherwise ignore this company completely. By the way, if you keep calling them back they get very frustrated and refuse to speak to you - it is rather hilarious that their own tactics frustrate them.

Don't let them intimidate you with their law jargon or threats! After I received what seemed to be a threatening voicemail about "check fraud" and my SSN and that "it was a very serious crime", I contacted them to see if I could resolve this myself because I admit, I took out a payday loan awhile back and as someone mentioned above, don't do it! So I told Investigator Washington that I would like to resolve the debt, but I absolutely need some letter or notice in the mail. Then comes the law terminology, threats, and nonsense. So, I hung up and got on a 3-way call with an attorney. Automatically hung up once, called back, and said they would just "let me handle it myself on my end." What the heck does that mean? It means they are scammers using threats and bullying tactics to get commission off old debts! I checked with my county court and had no claims or anything on file against me. - Jessica| 1 replyGot a call from this same number only different name. i have people calling saying they are putting a warrant out for me for check fraud about an online payday loan i was unable to pay for due to medical issues thru CashNetUSA, yet the actual online company (that i borrowed the money from and spoke to) say that this is a scam ring and not to pay them/speak to them. They said the account has been in collections for over 3 years now and that you can NOT go to jail for check fraud over a payday loan. Is this true and should I be getting a lawyer? I have not heard anything from and actual local law enforcement or attorney general, only from someone from a 'law office' going by the name of Investigator Smith and another man in the office named Investigator Jones. Also, I got an email from the company (CashNetUSA) and they sold my account to a collection agency called NCA for *drumroll please*.........$10.81 !!!! This is what I will go to jail for I guess.

It may be hard to tell the difference between a legitimate debt collector and a fake one. Sometimes a fake collector may even have some of your personal information, like a bank account number. If you think that a caller may be a fake debt collector:
•Ask the caller for his name, company, street address, and telephone number. Tell the caller that you refuse to discuss any debt until you get a written "validation notice." The notice must include the amount of the debt, the name of the creditor you owe, and your rights under the federal Fair Debt Collection Practices Act.
If a caller refuses to give you all of this information, do not pay! Paying a fake debt collector will not always make them go away. Scam artists, like fake debt collectors, can use your information to commit identity theft – charging your existing credit cards, opening new credit card, checking, or savings accounts, writing fraudulent checks, or taking out loans in your name.
•Contact your creditor. If the debt is legitimate – but you think the collector may not be – contact your creditor about the calls. Share the information you have about the suspicious calls and find out who, if anyone, the creditor has authorized to collect the debt.
•Report the call. Contact the FTC and your state Attorney General's office with information about suspicious callers. Many states have their own debt collection laws in addition to the federal FDCPA. Your Attorney General's office can help you determine your rights under your state's law.
