This office is a flat out joke. The braindead rep that answered claimed he was the supervisor in the office (yet has no clue whatsoever about how to actually make it through the "talk off" he is trying to use.) Lil Davy Vasquez is just a simple point caller in over his head and here's why..........This office is using illegal tactics to attempt to collect debts from unsuspecting consumers .They use a shake and close approach where they send out a message claiming they are attempting to serve a summons to your home or place of employment. (which they are not) They give a false "case #" which in most cases is simply the abbreviation of your state followed by your account # with their office. This is not how an actual civil case is numbered by the court system so the "case" # they give you means less than nothing . When contacting them, they id themselves as a litigation firm which is not the case as the are a simple llc company. That status as a business would not allow them to operate as a law firm of any kind.
They then make illegitimate  threats that they will be serving you a summons to appear in court that same day (also not possible as a summons takes sometimes several weeks to file and have served out).  From there they issue threats about potentially garnishing wages (which is something that only a judge can actually issue) or placing a lien against vehicles or property( again this is only done by a judge) and very very rarely done at all especially when dealing with an unsecured debt such as a credit card. In short this company has absolutely no clue how the laws in this country actually work. they are violating several laws themselves such as the mini miranda disclosure foti disclosure and several areas of fdcpa regulations. On top of all of this is the fact that 99% of the time these debts are outside of the statute of limitations which is a set of laws governing how long a credit issuer or bank has to actually pursue a consumer legally. This varies on a state by state basis but is usually around 7 years . Your best bet is file complaints with your states attorney general and with the b.b.b. ( if they are even reg with the b.b.b.).....or just tell them to sit on a broom and go sweep the floor.

and if that's not enough here is some more ammo

Was directed to call this number from abother company that identified themselves as United Dispatch Services regarding legal documents they are trying to serve me with. I would never call them but my husband gets all nervous and decides to call them. They started fishing for info and saying they have tried to deliver said documents two times now. I call bu$!*€it, no one has been here. Using illegal scare tactics when clearly they are not attached to a law office or local court is in violation of FDCPA. Please do your research before answering or responding to these calls.

I keep getting calls from this number and sometimes it is a guy sometimes a lady, asking for Peter Tasciotti.  Today this guy calls and says he is Officer Henderson and that Peter needs to call by a certain time today.  He talks about an officer is on the way to give Peter some papers.  This annoyance has been going on for a few months now.

In order to do that, they would have to get a judgement against you which means going to court.  You would have to be sued in your local district.  These scammers are most likely not located in your state.  In any event, they will never do that because it will reveal for everyone to see,  what a scam operation they really are.  How can they include you as  a defendant in ANY case if you weren't the person involved  in the original debt.  Total scam.  Block the numbers and ignore them.  In most states a 10 year old debt would be beyond the statute of limitations.

Just because a voice on the telephone claims you owe a debt does not mean you owe it
If a voice on the telephone claims you owe a debt:

    1.    Demand the person give you his or her name, company name, and address
    2.     Demand a debt validation letter by US mail.  E-mail no good.
    3.    Do not pay  the collection agent or anyone else a  DIME  until the debt is validated.

Of course they won’t do this, no scammer ever will, so simply block their calls and ignore them.

    If they are bothering you,

    Report them:

    http://www.consumer.ftc.gov/articles/0149-debt-collection

Also contact your local attorney general

If they continue to bother you, and you know you do not owe any money,  tell them that you know this is  a debt scam and that you are making a complaint to the police for extortion.  Once you get a copy of the police report and they call you again , just read out the  file number and the name of the PD or Sheriff’s office involved.   Tell them you’ll be glad to send a copy to them at whatever address the jack***es are working out of now.  If you can find them.

Hello I received a call yesterday morning stating that I was going to get handed papers to go b to court. The man on the phone stated that I had committed check fraud back in 2009 to wells fargo. I called wells Fargo and at first they had no account on me back then. I remember  having a over drafted account of 210 that I never did pay. 5 years later sloan and brown call me. They r stating that it is now 1000 dollars. I then say I don't have that and he agrees to dropping it to 500. He emails me a statement saying that I have a certain time to pay 500 and a former to fill out with my card. He tells me have have until today to pay it. I say I'll be doing a money order and sending it. He says here is the account number to just deposit it to bank of america. I know I was negative back then. But is this legal? After never receiving 1 form threw the mail about this matter? What should I do?  He said I have until today to pay this or I would be getting papers for court.

Ok the same thing happened to me he said his name was mr.rodriguez. They said the same that I owed wells fargo 1,106 which is completely not true. I called wells fargo and I had nothing pending with them. I was two seconds from sending these idiots $500. They even contacted my father and my land lord. This has to be stopped!

Received a call from a "Process server" advising he was going to serve me legal documents/summons to appear to both my home and work and asked to speak to my supervisor. When that didn't work, he told me to call 855-215-5678 and speak to someone there who would explain what this was regarding. He said I was lucky because he was able to stop the guy delivering the papers when he was 5 minutes away from my house.

I called the number the person answered as "litigation", when I asked his name he identified himself as Mr. Rodriguez and asked for my case #. I gave him the number that was given to me and he proceeded to tell me that this was about an account I had with Wells Fargo in 2009 and that they were suing me for over $3000 and charging me with Willful intent to commit check fraud. He said he was doing me a favor by "settling" and helping me out. I asked what company he worked for and he said Sloan & Brown. He then proceeded to rattle off my full social security number, my address at home and at work and every item on my credit report. It was very disconcerting to know that he had all of that information.

Long story, short - he threatened that if I didn't "handle this" now, Wells Fargo would proceed with the lawsuit and probably get a judgement for over $6000 and would then garnish my wages and seize my property. I hung up.

When I called back today, the phone was answered by a woman who said "legal". She refused to give me her name or the address of Sloan & Brown until I gave her a case #. She then stated that she worked at a switchboard for many different legal firms and couldn't give me Sloan & Brown's address, but she still wanted my case #.

How do these people get copies of all of our personal info?

LMAO! I was seconds away from sending them money. They are slick. I have been contacted by someone on my cell phone a couple of times Friday saying they were attempting to issue me papers and I had until 6pm to handle the matter (which I ignored) and just today at work - very effective calling me at work. I have been talking to David Vasquez - under the name of Hamilton and Barnes Mediation Firm. I've talked to him a couple of times, he is very even keel which is what throws me! Most of the "law firms" that I have dealt with are very unprofessional and mean.

Hamilton and Barnes - David Vasquez - has claimed that on March 1 they sent me an intent to sue at both my old address and my current one. I never got anything in the mail. Hey offered to send it via e-mail, which I did receive. I have received e-mails like this before, through a site like DocuSign that is very official. The people still couldn't validate the debt though so I never paid and never heard from them again - that was years ago about a different issue. The e-mail letter has incorrect information on it as far as my address (it's old). My point is, they are trying very hard to seem legitimate.

I have never been given an opportunity to validate the debt, which I keep insisting to him. He had me call US Bank to have them verify it. Unfortunately that just tells me I had an old bank account with them and that it was sold off to United Credit Recovery. It does not say that Hamilton and Barnes' client - Burbaker Acquisitions - owns the debt and is legally able to collect on said debt (or in their case sue me for it, which he says is their entire purpose and goal, they don't actually want to work with me at all). It further does not prove in any way that I am the person who owes the debt because they didn't include any copies of contracts, cancelled checks, or account statements. He can't tell me how the amount demanded has been reached. The e-mail letter doesn't have a signature, it does not include the name of the client, and like I said it has old contact information on it.

ANYWAY David suggested after talking to US Bank I call Burbaker Acquisitions but no one picked up after almost a minute of letting it ring. So I tried to call David back at Hamilton and Barnes but no one answered and it eventually went to a voice mail saying it was Sloan and Brown.

Sloan and Brown are a brand new company from what I can gather - which is fishy. Their web site is incomplete with a lot of "Under Construction - Info Coming Soon" postings on it. All of the Internet reporting on them started in March. There is absolutely no information about Hamilton and Barnes except for a couple of people reporting they got calls from them within the last month.

This is all turning out to be very classic. He is really even keel and not rude and unprofessional which is what started getting to me.

I'm glad I always always always research before I give any kind of information or payment!

I got the same exact call -- same guy - same scenario - says he's with sloan and brown and needs to collect funds - and supposedly he's working for a third party collection (Brubaker Acquisition) which is collecting funds owed for wells fargo. I fell for their trick and made the payments and was supposed to get a letter stating that I paid the debt off but haven't received anything. Now that I am trying to contact him back at the number that he kept calling me from I just keep getting a fast busy tone (phone number is 855-670-2819) and their website that used to be accessible sloanandbrown.com now says: 404 Not Found error was encountered while trying to use an ErrorDocument to handle the request. Do not fall for the same trick as I did -- now it will take over 3 mos to try to get my funds back.

Normally, I NEVER leave notes on internet sites like this, I read the comments and close the site.  After reading how so many of you have had the same problems, I printed out this page of complaints and questions and I am adding it to my report that I filed with the Federal offices two years ago when these people just knew no boundaries and got out of control.  I hope my story helps someone.

For the last three years, I have been getting calls from my Father, Mother, friends, old roommate, people who know me professionally, my siblings, and another MFranklin who was unlucky to have the same name as me and live in the same state only a few towns away.
Two years ago, I started writing down everything, every time they would call.  First it was Universal something.. I can't remember the name offhand, then it became Brown and Sloan in Upland CA, now it has turned into Hamilton & Barnes in Upland CA at the same address.  (by the way, HamiltonBarnes is a huge corporation in the UK-this is not them.)
After calling my Father again last week and sending him into a panic (he is 81) because he was convinced people were coming to his house with a lawsuit against me (they said on the phone they were trying to serve me with papers) I decided to put a kaibosh to this whole mess.

I called them.  I spoke to "Ms. Jenson" (909-450-5343) after I got my file#.  She did not lead with the miranda that is required of a legal and legitimate debt collection agency in this country .."this is an attempt to collect a debt..."  Instead, I was told that I was speaking to a 'mediation company' and that I was being contacted because a lawsuit had been brought against me for attempting to Defraud a Financial Institution.

    Huh?

She continued to inform me that Wells Fargo was their client and that the original amount was $100 and some change, but that now it was 1192+.  I wanted to laugh but my desire to keep calm and go along with her hustle was more important to me.  I needed to get these people to stop calling everyone in my life.  It's hard to explain to people why they are getting these calls and especially when you have elderly parents who might want to rescue you from an old debt and pay it for you..... you should share this information with them so that they know what to say when they get the next call.  If anyone gets a call from these people, they should say ...

"That person is not at this number or at my address.  Stop calling me."  by law, they must stop.  A few people in my "phone-friend-circle" who were getting calls have told me that the calls have since then ceased.

So... I stuck on the line and told her I wanted to make payments and could make a $100 pyt today with my credit card.  She put me on hold and came back to say they could work a 'settlement' for $542 but I had to pay it all within 30 days and start with the first pyt of 100 by the end of the day or she could not guarantee that my file would be kept on hold.  (A favor she was lucky to do for me, just for today..)
I said thank you and asked for a fax of the settlement documents and promise to pay.  Instead, (and here it is folks), instead, she sent me "litigation documents" to my email via "docusign" where I was to sign everything and press go.  When I got the documents, the mediation company had turned into a law firm and they were calling themselves a "litigation service" and the amount was for the 1192, not 540something.

I called Wells Fargo's overdraft department.  (877.647.8552) and spoke to one of the supervisors on duty.  With my complete social security number in front of him, he read off all my old accounts with WF and NONE of them were overdrawn.  I didn't owe them anything.
Then, the bank supvr started making a report of his own.  He asked me about this Hamilton outfit and who the contact was, I left him all the information and the woman's "Direct contact information" she so eagerly left me.  Then, I asked him to send me a letter from WF stating that I have nothing due, nothing overdrawn, nothing charged off... nothing.
They were all too happy to send me the letter.

I didn't sign the docusign email today.  My great offer of a $542 settlement probably expired at 5pm.  However, I have this woman's number and I have all their information and when I get the bank letter of confirmation, I am asking MY LAWYER to put together a legal document and I am sending it to the FTC and to a few other places.

Call your bank.  Get your own piece of mind.  Don't listen to someone on the telephone telling you about your finances.  You know who you owe.  You know what you do.  You don't need some stranger to come in and threaten you.  Protect yourself the best way that you can..... call you bank.

MOST IMPORTANT THING OF ALL............... Don't pay this jokers a red cent.

Here are a few things I added on, in case they are of help to someone.

    Best to all of you.

    Sorry... PS:

    I forgot to mention.

One of the ways they can get all of our information, especially this answer is for the Wells Fargo folks,

Wells Fargo was hacked some years back and they were exposed.  These kinds of people live for those moments and they scam unsuspecting hardworking people like us for millions of dollars every year.

    Call your bank.
