- Christi Plemons| 1 replyThe gentlemen said he was a locator, even though we are listed and haven't moved or changed jobs. He said he was going to serve him papers and that he would need to appear in court within a few days to face allegations of fraud. They then gave me this number to call and I spoke to Tom. I gave him the reference number and told me that if we did not pay the money owed to this company... never heard of them.... then my husband would be served at work or at home. I looked up Phillips and Roth Law firm and could not find it. So I called back and got the address... 1449 Ridge Road Lackawanna, NY 14218. I looked it up and no lawyers with the name Philips and Roth or Phillips and Roth was listed in the attorney data base for that area. I will keep you updated as we go through the process. My husband said it is a scare tactic scam and to ignore it. So I will let you know. Just don't know how I would have gotten a bill from someone we never heard of.

Said that papers would be served in 3 days if I did not call this number. He gave his name as Michael Rider, which I am sure is not correct and said that he was located in my hometown.

- Monique Johnson| 2 repliesReceived a call from this same number. Guy said his name was John Anthony. Said he had papers to serve me with unless I called and made payment arrangements. I called and the guy said Phillips and Roth and his name was Tom. Said I had an old debt and if I didn't pay I would be served at work. I got suspicious when I heard Michael Jacksons thiller playing in the background. I looked up the so called attorneys mediation office and could not find them. I called back and asked Tom for the mailing address and he gave me a PO Box number which was a dead giveaway. What lawyers office has a PO Box as a mailing address?? SCAM!!!

The Federal Trade Commission (FTC), the nation's consumer protection agency, is warning consumers to be on the alert for scam artists posing as debt collectors. It may be hard to tell the difference between a legitimate debt collector and a fake one. Sometimes a fake collector may even have some of your personal information, like a bank account number. A caller may be a fake debt collector if he:
is seeking payment on a debt for a loan you do not recognize;
refuses to give you a mailing address or phone number;
asks you for personal financial or sensitive information; or
exerts high pressure to try to scare you into paying, such as threatening to have you arrested or to report you to a law enforcement agency.
If you think that a caller may be a fake debt collector:
Ask the caller for his name, company, street address, and telephone number. Tell the caller that you refuse to discuss any debt until you get a written "validation notice." The notice must include the amount of the debt, the name of the creditor you owe, and your rights under the federal Fair Debt Collection Practices Act.
If a caller refuses to give you all of this information, do not pay! Paying a fake debt collector will not always make them go away. They may make up another debt to try to get more money from you.
Stop speaking with the caller. If you have the caller's address, send a letter demanding that the caller stop contacting you, and keep a copy for your files. By law, real debt collectors must stop calling you if you ask them to in writing.
Do not give the caller personal financial or other sensitive information. Never give out or confirm personal financial or other sensitive information like your bank account, credit card, or Social Security number unless you know whom you're dealing with. Scam artists, like fake debt collectors, can use your information to commit identity theft – charging your existing credit cards, opening new credit card, checking, or savings accounts, writing fraudulent checks, or taking out loans in your name.
Contact your creditor. If the debt is legitimate – but you think the collector may not be – contact your creditor about the calls. Share the information you have about the suspicious calls and find out who, if anyone, the creditor has authorized to collect the debt.
Report the call. Contact the FTC and your state Attorney General's office with information about suspicious callers. Many states have their own debt collection laws in addition to the federal FDCPA. Your Attorney General's office can help you determine your rights under your state's law.>

I asked what it was about and said I should call P & R mediation firm, so I did. I called yesterday and spoke to Mark. He said I took out a payday loan with Ashland back in 2010 and owed money---not true. I have no idea what he's talking about. I asked for a debt validation letter, I've yet to receive it. I'm also still waiting to be "served." I asked them for their address, they gave me on in Lackawana, NY--which has no record of this firm. I think this is a scam.

I was told Jacob Coumo (or Klemmo... I thought it odd he mumbled his last name yet pause after he said it) was calling for Donny Brown (not a very official sounding name, huh?) as he has to appear in court or call the mediation number provided.
When I get what appears to be a wrong number I generally call them back (with my caller ID info hidden) to let them know they have the wrong number. So far everyone has been appreciative except one person- they had my number but the wrong person. He was a job head-hunter and insisted he had the right number off my resume from the internet. I told him that he had the wrong person, remove my number from his listings, and any further calls will be taken as harassment and filed as a complaint to the FTC via the national do not call site. He started to stammer and apologized profusely and I never heard from him again.- Call type: Debt collector
- AnonymousI kept getting calls from Sean James said he was going to serve me papers at my residence. Waited all day he never showed this is a huge SCAM!!!! I knew he wouldn't show because it is against FTC regulations, the threats via voicemail is totally illegal!! File a claim with your states attorney general.

also watch this abc news did a news bit on phantom debt collectors - AnonI work in IT for a bankruptcy trustee. Got a call from "Michael Ryder" at home the other day about some debt I owed. Not sure what the hell I owe...but whatever. Decided to do some research on the company. I looked up "Phillips & Roth" in our system as both a creditor and an attorney, and the name didn't show up. You'd think that a legitimate collections company would have at least one reference in a system full of attornys and creditors. In the immortal words of Mr. Rogers..."Can you say Scam? Sure. I knew you could."

- Anon| 1 replyJacob Klemel and Tom have called me too. Very threatening and very aggressive. Said I owed them $14,000 total or $2200 payoff. $3695 from my mom to totally pay off the debt too. Two payments of $2105.00 to wipe out the debt totally/ They call once a month and harass me for the money. They told me they were searching for me to serve me papers to go to court to collect this debt from me that I never-NEVER had anything to do with at all. I am on a fixed income on Social Security for cerebral palsy. I am fully disabled by my condition and have no involvement in a contract for a loan of any kind. This may be affecting my credit report and if so I will sue. I have lost sleep and worried over this situation for two months now. I am unable to understand why this continues to happen to me. I live quietly and carefully on a very strict budget-but I have loving family and friends who care to help when I need it. I have no need of any loans.

He left a message saying he received a claim in his ofc and i had to call the mediation ofc at 855-497-7276 (also gave a claim number) before Wednesday or he would be serving me papers at home or at work. I do believe this a scam as I have received any letters reguarding debts. I called the number got a recording that said thank you for calling Phillips & Roth. From what I have been reading its a scam I would like some advice on what I should do. I was told by an attorney to just ignore the call.

I called the office (phillips and roth) and was told by Nick that if i did not pay the debt that i would be charged with theft by deception and all kinds of other charges. I didn't know at the time that this was an illegal collection tactic. I don't know how I'm going to proceed from here smh

Called 7 people in my family and while they did not out right threaten anyone, they didn't seem very professional. My suggestion to this so called business is to follow thru and serve papers to the individuals in question and stop harrassing friends, families or strangers.
