    This is ARM. They are a collection agency. The message I was left was to call back to prevent a lawsuit against me.
    Which maybe illegal to say.  But collection agencies use all kinds of tactics to get you to call back.

    I received a similar call this morning, for 2 possible suits and they are going to file charges against me for breaking bad check laws. I find this fishy for several reasons. First my state does not allow bad check charges for the type of debt I have, civil court is their only option. Secondly, this number would come up in a search for a well known company and it does not. ARM is a generic term in collections, and there are several debt collectors with ARM in their name. So which one called? And better yet I do not have any mail from them... they do have to mail a notice of the debt when they receive the account. So I'm not even sure if they are legit and regardless of if they are I am going ti file an FTC complaint for threatening legal action of pressing charges against me when I know they cannot do so.

    A Collection Agent May Not…

    Here are the top 11 actions prohibited by the The Fair Debt Collection Practices Act:

    Misrepresent Him or Herself

      A debt collector may not misrepresent himself as an attorney or law enforcement officer.

    Use the Telephone to Annoy or Harass

      A collection agent may not cause a telephone to ring or engage any person in telephone conversation repeatedly or continuously with an intent to annoy, abuse, or harass anyone at the called number.

    Threaten Arrest or Lawsuit

      A collection agent may not threaten a consumer with arrest. It may not threaten legal action that is either not permitted or not actually contemplated. In other words, a the threat of a lawsuit may be an empty one.

    Use Abusive or Threatening Language

      A debt collector may no use abusive or profane language in the course of communication related to the debt.

    Publish a Bad Debt List

      Publishing the consumer’s name or address on a "bad debt" list is prohibited.

    Contact By Embarrassing Media

      A debt collector may not communicate with a consumer by post card. It may not use any language or symbol, other than the debt collector’s address, on any envelope when communicating with a consumer by use of the mails or by telegram. A debt collector may use its business name if such name does not indicate it is in the debt collection business.

    Contact a Consumer at Work

      A collection agent may not communicate with consumers at their place of employment after being told this is unacceptable or prohibited by the employer.

    Seek Unjustifiable Amounts

      A debt collector may not demand any amounts not permitted under an applicable contract or as provided under law.

    Contact a Consumer Represented by an Attorney

      A collection agent may not contact a consumer after it learns the consumer is represented by a lawyer.

    Communicate With a Consumer After Receiving a Validation Request

      If a consumer sends a written §1692g response within 30 days, the collection agent may not communicate with the consumer until it mails the consumer the requested verification of original creditor's name and address.

    Communicate With Third Parties

      A debt collector may not reveal or discuss the nature of a consumer’s debts with third parties other than the consumer’s spouse or attorney. A collection agent may contact neighbors or co-workers only to obtain location information. It may contact a third party again if it has reason to believe the information the party provided previously is false.

      Yes. However, if you tell the debt collector it may not use that number because it is a cell phone, it may not contact you again at that number.

    I Keep Receiving Dozens of Calls From Collection Agents. Is That Legal?

      No. Unscrupulous collection agents will use "block parties" or "office parties" where they contact a consumer, multiple neighbors, or co-workers telling them they need to reach the consumer on an urgent matter. This is not permitted under the FDCPA.

    A Collector Says I Will Be Arrested if I Do Not Pay

      This was a true statement before the US Civil War, but has not been true since. People may be arrested if an aggressive judge files a bench warrant for a person who does not appear at a hearing relating to a lawsuit regarding a debt. However, in that case, the offense is the failure to respond to a court order, and not the existence of the debt. As stated above, it is illegal under the FDCPA to threaten a consumer with arrest if the consumer does not pay the debt.

    Update to my above post:
    This number belongs to ARM aka ARM WNY LLC located in New York. Called to get a statement of intent and that they are not "collecting on a debt." Other calls from other numbers have hinted at legal action, although nothing was outright stated.  Their website says that they are a debt collector.  Not sure how legit this company is, the business entity was created in October, their website was only created in Nov.  This stinks like fish to me.  Anyone else have info?

    The only "statement of intent" you need to make is to demand that they MAIL you a debt validation letter showing you owe a debt and that your callers have the legal right to collect said debt.  Per the FDCPA, you should NOT pay any caller who refuses to mail this documentation to you (and this is a violation of the FDCPA).  

    In fact, your callers only have five days from the date of their first call to mail this letter to you.  If they refuse to mail this DV letter to you, do NOT pay them.  Please do report the callers to the FTC, FCC and your state's Attorney General.

    No one calls to give you a heads up you'll be served - the process server just shows up, unannounced.  Continual threats of being served are a violation of the FDCPA.  Please do report your caller to the FTC, FBI and your state's Attorney General.

    Got a call at my job with a message stating that they wee an independent locator and had some papers to serve me at my job.  Statue of limitation attached to my name and social number. Asked me to call to request a release order. Ask me to call ARM.

    They called me, and I told them I would pay, but...that's before I actually called them back when they were Not there.
    Called this above number, it just has a person's name to it, Not american.  So I will not be paying them a dime.
    They also would Not send any information in the mail, and there is no address that I can find either.

    Reporting them to the appropriate people.  These guys are scammers, and they get your information and try to collect money, I believe that you may or may not owe to people,  I don't believe they're actual debt collectors, but Scammers...
    I wouldn't pay them one day.  Call that number and you'll see.  They don't say they are ARM anywhere on their voicemail, and if they are there when you do call back, they only answer by their names.  ( you don't even know if their names are real.
