Here are a few warning signs that could signal a debt collection scam:
The debt collector threatens you. Legitimate debt collectors probably won't claim that they'll have you arrested or claim that they or their employees are law enforcement officers.
The debt collector refuses to give you information about your debt or is trying to collect a debt you do not recognize. You have certain rights to ask a debt collector to verify the debt. You can use this sample letter to request this information. Ask for an explanation in writing before you pay.
The debt collector refuses to give you a mailing address or phone number.
The debt collector asks you for sensitive personal financial information. You should never provide anyone with your personal financial information unless you are sure they're legitimate.
If you think that a caller may be a fake debt collector:
Ask the caller for his or her name, company, street address, telephone number, and professional license number. Many states require debt collectors to be licensed. Check the information the caller provides you with your state officials, or the state in which the debt collector holds a license. If the caller refuses or is unable to provide you with information about his company, or if you can’t verify the information he provides, do not give money to the caller or company.
Tell the caller that you refuse to discuss any debt until you get a written "validation notice." This notice must include:
The amount of the debt
The name of the creditor you owe
A description of certain rights under the federal Fair Debt Collection Practices Act
If a caller refuses to give you all of this information, consider requesting this information in writing or seeking assistance before paying the debt to make sure the debt, and the company, are valid.
Tip: You can consider sending the collector a letter requesting the information by using one of the CFPB's sample letters. You can also submit a complaint to the CFPB or you can contact your state Attorney General’s office.
Do not give the caller personal financial or other sensitive information. Never give out or confirm personal financial or other sensitive information like your bank account, credit card, or Social Security number unless you know the company or person you are talking with is a real debt collector. Scam artists, like fake debt collectors, can use your information to commit identity theft such as:
Charging your existing credit cards
Opening new credit card or checking accounts
Writing fraudulent checks
Taking out loans in your name
Contact your creditor. If the debt is legitimate – but you think the collector may not be – contact your creditor about the calls. Share the information you have about the suspicious calls and find out who, if anyone, the creditor has authorized to collect the debt.
Report the call. Submit a complaint with the CFPB or get in touch with your state Attorney General's office with information about suspicious callers.
Stop speaking with the caller.If nothing else works and you believe the calls are fraudulent, send a letter demanding that the caller stop contacting you, and keep a copy for your files.
Tip: You can use this sample letter to write a letter demanding the debt collector stop contacting you. By law, real debt collectors must stop calling you if you ask them to in writing.
Tip: If you're having trouble with debt collection, you can submit a complaint with the CFPB online or by calling (855) 411-CFPB (2372).

Female said that 'I have a claim in their office that needs my attention' and then stated that I need to call them back at this number.
I have never had a delinquent or charged off account anywhere, at any time, with anyone. My credit has always been impecable yet I am constantly harassed by these various companies that incorrectly determine that I am who they are looking for, when they are really looking for someome else with the same name. They repeatedly refuse to accept the fact that they have the wrong person and are relentless in their pursuit of me. Rude, threatening, abusive. I have been through this enough times to know that this is just the first of an endless stream of harrassing nuisance calls I will be receiving from them. Questionable tactics even if I truly were the person they are looking for but all the more unconscienable & repugnant since I am not. SHOULDN'T THESE COMPANIES BE REQUIRED TO DO THEIR DUE DILIGENCE AND GET IT RIGHT BEFORE HARRASING INNOCENT PEOPLE IN THEIR OWN HOMES???? - KayThis company has called me multiple times in the last week on my cellphone, & it shows they are from Stafford, VA & my caller id says Fraud or Scam everytime they call. Today, I get a call from my mother who lives in a totally different town, saying they called her & left a vm saying there is a claim against me & they need to speak to me immediately. I don't know how in the world they got my parents phone number but this call scared them into thinking I am in some kind of legal trouble. Tried to call the number to give them a piece of my mind & it rings multiple times & finally a vm comes on with some woman saying the name of the company is Direct Capital & to leave a message. Called several times & never get an answer. I have no claims against me, all my bills are paid up to date & I have received no written notification of any legal proceedings against me. This happened to me a couple years ago as well. I do not appreciate them harassing my family with their lies. I cannot find a company listed in that area with that name.

- NanThis company keeps calling my job and leaving a message about a debt. When I returned the call after 5:30pm, the message says it is Direct Capital and they are closed and to leave them a message. Seriously, why would I do that! They also contacted a family member who is under 21. This is terrible. So scared they gave me the message and I reassured them not to worry. Oh yeah, I did leave a message asking saying "don't call back".

I asked for a address and was told Direct Capital does not have to send me their address its still bothering me but I am not giving them any money over the phone and still waiting to her served I was told they are turning me over to St Louis County and would have to appear in court, I am not sure if they are legitimate are not need advice.
- WolfmanJack replies to Mia TurnerThis is a common ploy by criminals attempting to extort money from people by scaring you into believing that you will be criminally charged, go to jail, lose your driver’s license, have wages garnished, be sued, and a variety of other variations on this, all for an alleged or nonexistent debt. One of the tricks they use is to call your work place repeatedly in an attempt to shame you into paying. They also use the “process server” who calls and claims he is going to serve you, but then says you could avoid it by calling another number.
Federal law (FDCPA) requires them to send you a letter (US MAIL ONLY) within 5 days of their first contact that contains their name, physical address, the creditor’s name, and the amount of the alleged debt. It also must contains “mini-Miranda” telling you that it is an attempt to collect a debt and that all information will be used for those purposes. The one other important thing that this letter must also have in it is that you have a right to dispute the debt within 30 days of receipt of the letter and if you do so, all collection activity must be stopped until the debt is verified.

- LargoI do not answer unknown numbers. Someone called today at 5:51 PM and my answering machine picked it up. They left a message for someone I’ve never heard of plus when they said the dame is was vary garbled. The woman’s voice said she had a claim for this person and to press 1 now or call 855-794-6700. - BigA replies to TERRINo one can file a judgement with you. It would have to be filed with the court. That would only happen after you were properly served, went to court in front of a real judge, and then lost your case. They would have to prove that you owe the debt and that they have clear title to collect on it. What this person is doing violates both federal and state collection laws.
