    this is a scam acting like they are working for a law firm (brinkman & asso.), did my research and found that none of the information that was left on my voice mail was accurate. The guy that called , which was unknown, said his name was Steven Write, and he was calling with "my local liaison office. Umm hello who the hell is that?.. He left a number which was 866-232-8071 with a case #663597. Brinkman & Asso.  is a family law firm that is based out of Ohio. I don't know a damm soul in Ohio. Guess these people dont think that know an days that the internet actually works!!.. I will be contacting my "local liaison" which will be the law enforcement

    This number called me yesterday and had information like my name address and last for of my social and had me call 1-866-232-8071 which they answered as Brinkman & Associates and I gave them the reference number the original caller had given me and they said that they were sending legal services to serve me papers and were going to arrest me for intent to defraud moneymart...I have no clue what they are talking about they said they were going to be here between 9-11am and they've yet to show up I hope that someone stops this soon!

    Received call from them 10/8/2013 saying they were a process server from my local county office threatening to show up next day (10/9/2013), which they did not. I am reporting them to my local county office for misrepresentation of a county employee. TOTAL scam - DO NOT be intimidated by these people.....

    This guy called me, said his name was Marshall White and that he had papers to serve me within the next 24-48 hours.  Says it's for several "charges" and that I should call 866-232-8071 with case number provided.  Said that they would be serving these papers at my home or work (which they did not provide an address for, meaning they have no idea where I live or work) Also said that after papers were served that I would no longer be able to communicate with legal services?  I don't know what country they are from, but here in America, we have a RIGHT to legal representation!!  What scares me is that they had the last 4 digits of my SS#.  I think this guy has called me before, and tried to scare me, turns out these "charges" are debts from a credit card... they are obviously a debt collection agency using " scare tactics" to try to get their debts resolved.  They try to make it sound like they are a government agency with criminal charges to file... but I've been through the system once or twice... they don't give you "fair warning" that you have charges being filed against you... they like it when you don't see them coming!!  God bless America

    Called me with an unknown number and left a very rude msg. calling me stupid for hanging up on him.  Has last four numbers of my social and dob.  Stating that they will serve me papers if I do not call back.  Total scam do not call them back.

    i got a call from this number.told me .i need to pay this amount by this date or they r sending me court papers for fraud. said they just got my papers  and its regarding check smart.and its from 2005.very scary.he know my birth date and s.s number.and said i cant send no money orders in.i have to use a debit card or credit card.im not paying nothing over the phone.and im not calling the guy mike newkirk back.

    The law is clear.. they need to send you proof via US mail. And since they say its a check, demand a copy of it, front and back! That way you can check with your bank directly and it should show if it was even cashed. A check not cashed in a timely manor does not mean its a bad or fraudulent check, rather that it is up to the person or business to have you issue a new one as they are only good for 6 mos unless otherwise noted.  A bounced check the bank and business should have notified you within a very short time. Neither email, phone, nor Fax is Legal proof btw ...

    Section 809 of the FDCPA http://www.ftc.gov/bcp/edu/pubs/consumer/credit/cre27.pdf requires 3rd-party debt collectors to give debtors written notice of debt (the key word is *shall*) :
    "§ 809. Validation of debts
    (a) Within five days after the initial communication with a consumer in connection with the collection of any debt, a debt collector shall, unless the following information is contained in the initial communication or the consumer has paid the debt, send the consumer a written notice containing—
    (1) the amount of the debt;
    (2) the name of the creditor to whom the debt is owed;

    A Collection Agent May Not…

    Here are the top 11 actions prohibited by the The Fair Debt Collection Practices Act:

    Misrepresent Him or Herself

      A debt collector may not misrepresent himself as an attorney or law enforcement officer.

    Use the Telephone to Annoy or Harass

      A collection agent may not cause a telephone to ring or engage any person in telephone conversation repeatedly or continuously with an intent to annoy, abuse, or harass anyone at the called number.

    Threaten Arrest or Lawsuit

      A collection agent may not threaten a consumer with arrest. It may not threaten legal action that is either not permitted or not actually contemplated. In other words, a the threat of a lawsuit may be an empty one.

    Use Abusive or Threatening Language

      A debt collector may no use abusive or profane language in the course of communication related to the debt.

    Publish a Bad Debt List

      Publishing the consumer’s name or address on a "bad debt" list is prohibited.

    Contact By Embarrassing Media

      A debt collector may not communicate with a consumer by post card. It may not use any language or symbol, other than the debt collector’s address, on any envelope when communicating with a consumer by use of the mails or by telegram. A debt collector may use its business name if such name does not indicate it is in the debt collection business.

    Contact a Consumer at Work

      A collection agent may not communicate with consumers at their place of employment after being told this is unacceptable or prohibited by the employer.

    Seek Unjustifiable Amounts

      A debt collector may not demand any amounts not permitted under an applicable contract or as provided under law.

    Contact a Consumer Represented by an Attorney

      A collection agent may not contact a consumer after it learns the consumer is represented by a lawyer.

      If a consumer sends a written §1692g response within 30 days, the collection agent may not communicate with the consumer until it mails the consumer the requested verification of original creditor's name and address.

    Communicate With Third Parties

      A debt collector may not reveal or discuss the nature of a consumer’s debts with third parties other than the consumer’s spouse or attorney. A collection agent may contact neighbors or co-workers only to obtain location information. It may contact a third party again if it has reason to believe the information the party provided previously is false.

    Can a Collection Agent Call My Cell Phone?

      Yes. However, if you tell the debt collector it may not use that number because it is a cell phone, it may not contact you again at that number.

    I Keep Receiving Dozens of Calls From Collection Agents. Is That Legal?

    It appears the Phone numbers to these guy's don't match up. I googled the company name and here is their page:

    And from what I see, there is only one attorney listed there on the web page:Karen Riestenberg Brinkman

    It appears that the name is being spoofed at this point, and it is not the first time something like this has happened. Many Attorneys have had their names used and when the actual attorneys have been called, they are clueless about the "case".

    It is not beyond the extortion scammers to use and abuse real agency's and spoof their caller ID and/or names. I have seen several of these MO's on a few of the threads here under different numbers.

    I just received the exact same call this morning. This one was a Marshall Smith. I had a feeling this was a scam so, I told him to give me this number I should call. Came into work and put the number into google and came up with this site and I started reading all of these post that were exactly the same story as mine. Good I will ignore this as I thought. But I will keep an eye on my credit report.

    Just got a call from an unknown number and some lady said she was calling to let me know that they received a fax about me and that  i was going to be served in 24 hours and i need to call legal, first thing first she used my maiden name lol.. then told me she had my ss# and i need to call ... so i googled and found this.. I will not be calling back to talk to scammers .. she told me to call 866-232-8071 with ref #....

    I received a call from an unknown number on MY cell phone a couple days ago, and the person who left the message also stated he was a county process server, and would be serving my husband court papers the following day between 9am and 1pm. He left the 866 # and said to call Brinkman and Associates with a 6 digit case # which he provided. His name is Richard McCloud, yet he left no # to contact him personally, and still has not shown up to deliver court papers. I called Brinkman and Assoc. to find out what was going on, and they said my husband has an unpaid cash advance through CheckSmart from 2001! ARE YOU KIDDING ME!? I told them to send the info in writing, and of course got the run around, so I then asked for their address so I could request a debt verification through the mail. The guy gave me 3843 Union Rd. Suite 15 in Cheektowaga NY, and when I googled it , it came back as a UPS store. I called UPS to verify it was their correct address and they said yes. SOOOOOOO I called Brinkman and Associates back and asked them to reconfirm their address (just in case i wrote it down wrong) and she gave me the same address. I then told her that is the UPS store address, and I know they are a scam! The lady told me to have a nice day and then hung up on me! I reported them to my state attorney general's office, and plan on filing more complaints through the FBI and FTC as well.....

    They called me and said exactly what you said to and you are right it's a lady that called me to she said her name was Kathy Hill but never left a number to call her back directly just left a case number A-31756 she said call 1-866-232-8071 so I did and the jerk Nasir Castro answered and stated about the charges from Advance of America for 500.00 first then 325.00 he said to settle and he would call Kathy Hill back to let her know to stop with the court papers because he had spoke with me so don't worry she will stop with the court proceedings.
