They did call me and left me a message saying that "There is a pending lawsuit and the information is very time sensitive as the paperwork for your case is being submitted this afternoon."
This is a collection agency calling about a debt that I had thought was paid. Evidently, the "Legal case" is where it CAN end up, and the docket number is my file number within their organization. The "legal representative" that contacted me was simply the debt collector's name.
Granted, if a debt is ignored, it could end up going to trial and very bad things could happen, but this experience speaks volumes to the decietful ways that collection companies will use and the depths to which they will stoop to try to con you into calling them back.- Caller: Allstate Legal

- Aysem| 3 repliesI keep receiving calls from 866-508-1877. They say they are Allstate Financial. I ask what they are calling for. They tell me they are looking for Angela, who is my sister. I tell them I am not her, and asked if I can tell her what the call is about. Then I am advised that they can tell me, they need to talk to her. Well, I advise that she is not here, and that this is not her number. They claim that they can’t verify that I am not Angela and still won't tell me what this is about. Now I get a call every morning and evening. I ignore the calls, but this is getting ridiculous. First they won't tell me what the issue is because I'm not Angela, but then they won't stop calling because they can't confirm I'm not Angela. It's not my fault if she doesn't call them back. How do I get them to stop calling MY CELL PHONE!!!

- Meg| 4 repliesYet another strange 800 number...I got this message earlier today. I have to call before 4:30pm to speak to a supervisor or else he will proceed with the case?? Not sure what debt this is (sorry to say I have a few from college years)...but they were all less than $300. Could they really take me to court for a credit card balance 8 years old and less than $300?!?!?

- fatdaddyWhat a bunch of punks. I contacted this company to resolve an issue on my credit report. I offered to pay $100/mo toward my 1001.00 account. They take my bank card info and tell me im all set. Next day, they call me and then hang up. I call them back and they switch me to the "criminal fraud division". The guy tells me a gave them the wrong card number. I asked for him to repeat the number, and they had one digit wrong. I tried to correct the error (their error) but the guy said it was too late, tough luck. I had to give them a checking accout/routing number or they would persue legal action. Ha ha! I hope they do. I'd love to settle this matter in court.

- fatdaddyI decided to call these people back and make one last attempt to resolve this issue. I spoke with Kim (x1470) and she verified that I had given the correct card number and that the person I spoke with before was obviously lying. I have only one idea as to why someone would do this, but its pretty far-fetched. In any case, its completely ridiculous. Kim was extremely helpful though, so hopefully I won't have any more problems.

- StarMan replies to AysemI am going through a similar problem. It is illegal for a company to call you on your cell phone. This is the equivalent of reversing the charges since you pay for the air time on a cell phone. I wrote a letter to the company telling them they were calling my cell phone and to stop calling me or I will notify the Federal Trade Commission for the violations. The calls have dropped off, but since this was a recent event I am waiting to see if they stop completely. I suggest keeping a "contact log" including the number, name of the company, date, and time they call. At least this way you have some hard evidence if you need to pursue it further.

When I returned the call, I was told that I had to take care of this right now or criminal charges were going to be filed against me. I almost made the mistake of giving them my bank account information, but something told me not to. The funny thing is that I filed bankruptcy last year and this debt was included in my discharged debt. I asked the caller if they were a collection agency and he said "no". What a bunch of liars. Don't fall for this...If they say they are going to file criminal charges against you, let them. I work at a law firm and they were going to file criminal charges, they wouldn't call to try to get money from you...they would just file the charges. My advice to anyone who recieves a call from these people...Do not give them any information over the phone. You don't know who they are. Ask for them to send you something in writing.

§ 807. False or misleading representations [15 USC 1692e]
A debt collector may not use any false, deceptive, or misleading representation or means in connection with the collection of any debt. Without limiting the general application of the foregoing, the following conduct is a violation of this section:
(1) The false representation or implication that the debt collector is vouched for, bonded by, or affiliated with the United States or any State, including the use of any badge, uniform, or facsimile thereof.
(2) The false representation of --
(A) the character, amount, or legal status of any debt; or
(B) any services rendered or compensation which may be lawfully received by any debt collector for the collection of a debt.
(3) The false representation or implication that any individual is an attorney or that any communication is from an attorney.
(4) The representation or implication that nonpayment of any debt will result in the arrest or imprisonment of any person or the seizure, garnishment, attachment, or sale of any property or wages of any person unless such action is lawful and the debt collector or creditor intends to take such action.
(5) The threat to take any action that cannot legally be taken or that is not intended to be taken.
(6) The false representation or implication that a sale, referral, or other transfer of any interest in a debt shall cause the consumer to --
(A) lose any claim or defense to payment of the debt; or
(B) become subject to any practice prohibited by this title.
(7) The false representation or implication that the consumer committed any crime or other conduct in order to disgrace the consumer.
(8) Communicating or threatening to communicate to any person credit information which is known or which should be known to be false, including the failure to communicate that a disputed debt is disputed.
(9) The use or distribution of any written communication which simulates or is falsely represented to be a document authorized, issued, or approved by any court, official, or agency of the United States or any State, or which creates a false impression as to its source, authorization, or approval.
(10) The use of any false representation or deceptive means to collect or attempt to collect any debt or to obtain information concerning a consumer.
(11) The failure to disclose in the initial written communication with the consumer and, in addition, if the initial communication with the consumer is oral, in that initial oral communication, that the debt collector is attempting to collect a debt and that any information obtained will be used for that purpose, and the failure to disclose in subsequent communications that the communication is from a debt collector, except that this paragraph shall not apply to a formal pleading made in connection with a legal action.
(12) The false representation or implication that accounts have been turned over to innocent purchasers for value.
(13) The false representation or implication that documents are legal process.
(14) The use of any business, company, or organization name other than the true name of the debt collector's business, company, or organization.
(15) The false representation or implication that documents are not legal process forms or do not require action by the consumer.
(16) The false representation or implication that a debt collector operates or is employed by a consumer reporting agency as defined by section 603(f) of this Act.

- memzI read the details of all the other posts on this number before calling them back. I was prepared to only give them my phone number and for someone to get nasty with my. But I was surprised and they only asked when I would be able to make the payment.That was a shocker but my debt is only for a small amount.
- tiredThere was a phone call from these people at my house today looking for my husband. They stated that he needed to call today because there client has given them the OK to pursue charges this afternoon if they do not hear from him. Alls the gentleman says is his name is Larry Lewis from the Legal department of Allstate and then leaves the message and the number. Not for nothing but my husband works all sorts of hours and probably wont have time to call them back. I actually am not going to worry to much over this since reading all these complaints on this company. They left the same message last week as well.
