Apparently they aren't very particular about their business practices.  Today was the second time they called me at work, and this guy pretended to be working with the court and "called me by mistake" while "trying to reach payroll" to garnish my check.

Just talked to the jerk again, Rick McNeally (sp?).  I'm putting in a complaint with the Ohio State Attorney and BBB.  These people are real jerks.  When I asked to for a copy of the information that was going to be sent to HR, he told me is was none of my business, even though it regards garnishing my check.  Can you believe this guy?

University of Phoenix is full of a bunch of crooks.  They went behind my back and authorized a loan from Citi Bank on my behalf when a few weeks before I had cancelled my application before it was even processed.  I never authorized or approved this loan. In the end CitiBank believed me and got their money back from those theives because I was able to prove that my application was cancelled. This was seven months ago. Today I received a call from 866-547-5413 x.122 (Karen Barnes), leaving me a message at home and at work that she's with Wage Garnishment Legal Office.  I called back and told them my story, but they were rude and said that they were going to file a law suit for the money that I owed. UoP needs to be held accountable for all this

Wage Garnishment Office? What a crop of bull. A garnishment would come from the Clerk of Court's office only after a Judgment

Re: Acct #xxxxxx
Dear Sir or Madam:
This will serve as your legal notice under provisions of federal law, the Fair Debt Collection Practices Act (FDCPA), to cease all telephone communication with me at my work number (xxx) xxx-xxxx in regard to the debt referenced above.

I have informed those calling that my work does not approve of such calls and to call my personal number. (xxx) xxx-xxxx.  Each person has refused to adhere to my requests or document this in the records.

I also wish to inform you that Mark Meadows has violated section 807 part 4 of the FDCPA by insisting that nonpayment of this debt will result in wage garnishment. This will be reported to the Federal Trade Commission.

If you fail to heed this notice, I will file a formal complaint against you with the Federal Trade Commission who is responsible for enforcement, the States Attorney General office and inform my company with your unwillingness to comply.

Looking at the above post I think it needs to be pointed out that these people are just blowing smoke and are way out side the federal fair debt collections pratice act(FFDCPA).  To start with in order to get a garnishment you first have to have a judgement by a court. You  can't just  call  and garnish somebody's wages it don't work that way. These people can be sued themselfs under the FFDCPA. Reliant Capital is way outside the law. Never believe anything a collection agency says. They  have no power or authority what so ever. They will try to bully you. Don't let them bully you. Stand up to them and laugh at them

I would like to add to Mountian Boy's post by saying this. When they make a threat to take you to court remember. Most states  only permit lawyer and court fees to be added in the amount of 15% on the first $500 and 10% of the amount over $500 of the debt. Example if they are wanting to collect $2,000.00 they can only add $225.00 IF they win.  It is going to tie up atleast 20 hours of their time even if they go to small claims court. That leaves them $11.12 an hour for their time. What lawyer do you know that will work for $11.12 an hour? and that is IF he wins. Then they have to collect. That is a lot harder than you think. If they try to have a sheriff's sale  of your property. (1) That property has to have  a title in your name and be free and clear of other debts. No outstanding repair bills or anything oweing. (Hint Hint) (2) In many states the judgment has to  be for at least 1/2 the value of the property(3) Any amount from the sale over the amount of the judgement has to be returned to you. Arm your self with this information and tthat of Mountian Boy above.

I got a call a couple of weeks ago from this company threatening that UOP was going to sue me. FIRST OF ALL...if you want to get a hold of me...don't block your number. Secondly...if you want to get a hold of me by mail, make sure the envelope isn't a blank envelope..i'm just going to think its one of those stupid credit card offers...which they usually are. They aren't very conventional about trying to get a hold of you, and then when you don't answer their "blocked number" phone call, they leave you a frantic message...calling you by your first name and first name only...telling you call them back. They're so nice to you while you're trying to set up a payment plan with them, but then when you call back with a question...they completely rush you off the phone. do they even know what the situation is? I agree with the person who said that UOP is a bunch of crooks... This wasn't my fault... don't you wonder why the Arizona Cardinal stadium is called "The University of Phoenix Stadium"? do they REALLY need my money...? I don't think so!

This man named Bill left me a message this morning and said that he has been asked to render a decision that will directly affect me.  I have talked to these people before and they were very rude.  He asked me if they could set up payments to take it out of my bank account.  I told them that I didn't have my checkbook on me and that I would have to call him back.  He said, "You don't know your bank account information, all I need is the name of the bank and the account number?".  I told him that I don't have it and I would call him back.  I guess they're from the stupid University of Phoenix.

I Have received several calls from Reliant regarding a UOP bill that came about because they sent back a portion of my student loans. They keep calling me at work, and I explained that I was not allowed to receive calls and gave them my home number. Today they called me at work again. He asked when I would be home to call because I never answer the phone at home. Which I do. I said I should be home around three but I couldn't promise( I had to go have some labwork done) He stated I better be home at three or he was going to call me at work on Monday. They keep threatening to call my payroll dept. and garnish 25% of my wages, etc..

Typical behavior of a rogue collection agency, trying to intimidate consumers into paying nonexistent debts and making threats they have NO intention of carrying out, which is AGAINST THE LAW:

ยง 807.  False or misleading representations  [15 USC 1962e]

A debt collector may not use any false, deceptive, or misleading representation or means in connection with the collection of any debt. Without limiting the general application of the foregoing, the following conduct is a violation of this section:

(1) The false representation or implication that the debt collector is vouched for, bonded by, or affiliated with the United States or any State, including the use of any badge, uniform, or facsimile thereof.

(2) The false representation of --

(A) the character, amount, or legal status of any debt; or

(B) any services rendered or compensation which may be lawfully received by any debt collector for the collection of a debt.

(3) The false representation or implication that any individual is an attorney or that any communication is from an attorney.

(4) The representation or implication that nonpayment of any debt will result in the arrest or imprisonment of any person or the seizure, garnishment, attachment, or sale of any property or wages of any person unless such action is lawful and the debt collector or creditor intends to take such action.

(5) The threat to take any action that cannot legally be taken or that is not intended to be taken.

(6) The false representation or implication that a sale, referral, or other transfer of any interest in a debt shall cause the consumer to --

(A) lose any claim or defense to payment of the debt; or

(B) become subject to any practice prohibited by this title.

(7) The false representation or implication that the consumer committed any crime or other conduct in order to disgrace the consumer.

(8) Communicating or threatening to communicate to any person credit information which is known or which should be known to be false, including the failure to communicate that a disputed debt is disputed.

(9) The use or distribution of any written communication which simulates or is falsely represented to be a document authorized, issued, or approved by any court, official, or agency of the United States or any State, or which creates a false impression as to its source, authorization, or approval.

(10) The use of any false representation or deceptive means to collect or attempt to collect any debt or to obtain information concerning a consumer.

(11) The failure to disclose in the initial written communication with the consumer and, in addition, if the initial communication with the consumer is oral, in that initial oral communication, that the debt collector is attempting to collect a debt and that any information obtained will be used for that purpose, and the failure to disclose in subsequent communications that the communication is from a debt collector, except that this paragraph shall not apply to a formal pleading made in connection with a legal action.

(12) The false representation or implication that accounts have been turned over to innocent purchasers for value.

(13) The false representation or implication that documents are legal process.

(14) The use of any business, company, or organization name other than the true name of the debt collector's business, company, or organization.

(15) The false representation or implication that documents are not legal process forms or do not require action by the consumer.

(16) The false representation or implication that a debt collector operates or is employed by a consumer reporting agency as defined by section 603(f) of this Act.

This company keeps calling my elderly father stating they have a very important message for him and he needs to call them back or they leave a message stating they have a check for him.  The call on two different numbers - 866-547-5413 or 866-738-3178; both of these are from the same company - Reliant.  I left them a message and stated they better not call my father again.
