- blackbeltits very rare collectors take people to court, unless its big money you owe, lets say 20k or more, and even then, if you have nothing, it will cost the collection company money to take you to court an then they only get judgement, after they spend all the money, claim bankrucpty and there screwed. or if your an elder and close to retirement, they cant even garnish your wages because your retired LOL.
theres many ways to screw thease jerks who use intimadation tatacks to collect and make profit on suffering people.
best way to avoid them, get caller id and an answering machean, never ever answer an unknow number, remmber its your privacy they are invading when they call you, never answer them or talk to them, when they leave a message they there very inportant , just press delete and go on with your life. there is nothing more that pisses them off than them not being able to talk and intimatate you into doing someting about what you owe, because this way they are left completly in the dark,
remmber collectors are highly trained to intimadate without crossing the law, they use thease tactics to break down, wear down the debtor till they pay the debt just to get them off your backs.

So, I lost my job and my EI ran out. Most of the collection agencies could care less - they just want the payment ASAP. Some agencies will work with you, even providing contact information to companies and groups that may be able to help to settle accounts.
Regarding the recording/monitoring of calls, In most cases, when an agent does have contact with you and they advise you that "this call may be monitored and recorded for quality assurance purposes" that is exactly what it means. The recording has no actual admissability in court as a record of anything. The recording is actually for the protection of the agency and is used to assess the agent's manner and adherence to policy. This is particularly true when conducting the security/privacy check to ensure that the agent is talking to the correct person associated with the debt.
Blackbelt makes a valie point regarding the cost of recovery. While the collection agencies will try and collect the maximum amount, the reality is that they first have a limited amount of time (2 years from the last payment against the original debt) in which to collect it or the debt is unrecoverable. Second the cost of pursuing a small claims court action (filing, serving, trying the case) makes it a rare occurrence, particularly if the the collection agency has reason to believe that the individual is judgement proof (has no assets with which to pay the judgement, if they get it), and finally even if they go to court, if you actually fight it, the many judges will not allow the collection agency to recover more than the original debt, BEFORE accrued interest. Since agencies essentially BUY these debts at a discount from the orginal creditor (credit card company, bank, trust company, etc) the judges are often not particularly sympathetic, since they some perceive the collection companies as being predatory, in some cases even jacking up the original interest rate.
