They are obviously not a legitimate debt collection agency - if they were I would think they would have a little more sense and advise their people not to violate so many FTC/FDCPA regulations. Sounds like they aren't creative enough to come up with new and refreshing scripts for the morons they hire. We received the same call and got the same story from 3 different people including their "Director of Operations" who proved to be the dumbest one of all. Don't fall for the "we're serving you papers scam" - most likely they don't even know your address - they look up your info on the internet and fish for info from whatever they can find. We must have been special because they even threw in a "your facing a misdemeanor criminal charge, possibly a felony charge"...oooh scary. They need to do a little more legal research, maybe watch some of the criminal/law shows that are in abundance on tv - then they might, just might, sound a little more legit. These people feed on their scare tactics so don't give in. Get in touch with the original owner of your debt and go from there - DO NOT give them money or personal info!!!!!
From my experience they went by the company name of PNCW and Protected Management Company. I've already filed a complaint with the FTC, BBB, and have been in touch with my attorney. Good thing i checked out the number first.

- Sheri| 5 repliesOh my god, I'm out of work temporarily because I just had surgery and my Supervisor calls me to tell me that I have someone calling with a case number to reference. So, I call the number and they asked if I had a case # to reference. I gave it to them but asked if they could tell me what company I was calling, they stated it was a switch board and once I gave them the case # they could forward me to the appropriate person. Someone named Roy Fisher answered and I asked what this company was. He said that I was being sued. I asked "by whom" and he stated my name. I said, "I'm pretty sure I'm not suing myself. I asked WHO the company is who is suing me?" He HUNG UP ON ME! I don't think he appreciated looking stupid-I called back and he was extremely rude and told me I was a deadbeat. He told me it was Protective Management Company of the West-again I must reiterate how RUDE this guy was-he asked me why I hadn't responded to the letter he sent me two months ago. I told him I never received a letter from that company. He told me a process server had tried to serve me papers and that they would be coming to serve me papers again soon since they were unsuccessful the first time. I thought that was weird since, like I said I just had surgery a few weeks ago and haven't been anywhere. Roy Fisher was "willing to let me pay only $1405," but if it went to court he said I'd pay at least $1500 more than that. He was so rude, I asked to speak with his supervisor. He hung up on me AGAIN!! I called back and he stated that he was the owner of the company and that he only took care of the "difficult clients." I asked him who the original creditor was and I realized that I had just received a settlement offer in the mail from a different company referencing the same account. It took a few calls to find out who the actual owner of the debt was, then I called them- Asset Acceptance LLC-and paid them $242, which settled the account and I'll get a letter for the credit bureaus stating debt was paid in full. This "settles" it because of what some sale-priced letter with a return envelope said, or do you have a document signed by a AACC principal stipulating you will never again be pested for this debt claim? Do you know for a fact you won't be sent a 1099 form forcing you to pay "income" tax on the unpaid amount?
Settlements with rogue collectors might as well be written in water-based felt pen on a sheet of glass. Somehow they will find a way to wash away or shatter your agreement. The "excused" amount can be resold to another boiler room, for instance. If you don't get credit report trade line deletion as a condition, other crooks could come looking for the same amount, regardless of what a status line says. Better yet, AACC could come back one day and say with a pout, "What check? What settlement? We have no idea what you mean."
Known lawbreaker Asset Acceptance was perfectly capable of chasing you itself, and did, then assigned the account to an even worse thug outfit which quickly proceeded to break FDCPA in about six ways. You cannot have two agencies dunning you for the same debt! You might want to pull a freebie credit report via the FTC and look for suspiciously redundant entries.
The best thing to do would have been to dispute the AACC "offer" on paper, even if it lacked the "Miranda" language required of an initial dunning letter. You might never have reached a stage of such hostile bullying. But since you did, might as well make careful records of everything said and done and file suit against this Protective gang, and name AACC as a codefendant if you can. Possibly AACC itself violated your rights prior to the nasty PMC callers, which would give you an excuse to file separate suits and double up your statutory earnings ... which should then handily exceed what the fiends were "willing to let you pay" them.

Although it has a history of complaints of abusive and deceptive collection, Asset at least makes some pretense at legal compliance. You can easily find their mailing addresses, corporate officers, registered agents for service, etc. You would still be wise to insist on written documentation of any settlement agreement prior to payment. Contact your state Attorney General for assistance should you have any problems.

It is consistent with pulling your own credit report, finding some old account on there that they can claim you owe to them, and attempting to shake you down for that debt, even though they do not own it or have any right to collect it. I could talk with them about serving another address, etc. The girl who answered the phone , when I
asked what company was I calling stated she was only the operator, I gave her the case number and would not give her my last 4 numbers of my ss.#, then a man got on the phone very rude right from the start, I told him that I am not going to give some girl my ss# if she could'nt tell me who she worked for etc.
then he stated I owed an old bill from 5 yrs ago ccard, and was very rude, talking settlements etc, and
finally he go mad and said rudely, you are going to be SUED!!!!!!, like it was funny. I said do what you
have to and I told him he was rude and I would call his boss, said he WAS THE OWNER OF CO!!
so I TOLD HIM DO WHAT YOU HAVE TO AND I HUNG UP AND SAID DON"T CALL ME AT WORK AGAIN! Good luck with these people, wish I had their address to send him a piece of mind. So I called them back knowing fully well I don't owe anyone. The guy Mark Thomas I spoke with was a [***] to put it nicely&when I asked would not tell me who wanted me served he kept reading his dummy script & told me If I can't let him finish readng then I'm free to go So I said ok Goodbye & hung up. Then I googled the phone number & read these messages & called them back & confronted them. They almost crapped there pants.They now claim I was the wrong person they were contacting, he didn't know anything. So I told him put someone on the phone who does . Everyone who at first was the owner was now just a receptionist for 5 different companies & would transfer me. So the guy I speak with gets on the phone with his defenses up, saying (after I mentioned reporting them to the FTC) that they have the wrong person( he used my maiden & current name) & that this is my second time calling. I said yes it is what company do I owe money to. He got very angry at my mentioning the FTC & started screaming over me,I was asking him what company is this & where did you get my info from so I told him " Read your script & tell me who this is & what this is concerning. He screamed Your evil in my ear & hung up. I guess they won't be calling my house again. They call you. Call them back & be firm don't give up any info, & let them know if this is not what they are claiming you will be reporting them to the FTC

The guy, Mark Thompson was so mush mouthed that I had to listen to the voice mail several times before I got the number correct. I called it back and the southend of the horse who answered thought I was kidding but yes I called the Ohio Attorney General, filed a complaint and my next call will be to the FCC. Ps> I am law enforcement and I hope these idiots get thrown in jail. If an attorney is associated with them ( i really doubt it) he should watch his license because I am going to continue my research of this very unprofessional busines( if it can be called that). The idiot acrtually threatened me with the US Marshal. I laughed, then I contacted the FBI agent who lives around the corner. He is trying now to see if he can hook under the Patriot Act. Maybe they will be sending us all postcards from Cuba. Priceless. Ps. I called them back and told them what I did. : ) Also, as a caveat, the person sounded like the same person, no matter how often he transferred you.

- Michelle| 5 repliesMy sister got a phone call from a processor stating I will be served with papers tomorrow. Called this 866-680-2068 number. Same this operator no name of business or this is a collection agency statement that you would think to get. Spoke with a Tony Padma ( I think on the last name). Wanted money by friday or I will have 33 percent of my wages taken no mediation with the courts. He came from 3500 dollars of debt to settle for 2200 then 1000 then 700. It took me aback at first thinking maybe it is true but as he spoke it sounded less legit. He said he has contacted my employer but could not give their name. I advised it is illegal to contact a persons employer and discuss my debt. Asked Tony his business name would not give it. Said I will recieve a nice little package from the processor stating his business. I told him I have worked in collections and that he has to disclose his business and that they are collecting info on behalf of a collection agency. I did state that there is a fair debt credit act. He stated to correct me it is Fair Debt Collections Practice Act and that he helped write this. I found that funny that he helped write this act and is answering the phone at a collection or whatever they are agency. I asked for a boss. He staid he is the HEAD ATTORNEY( who calls themself the head attorney I found this the most amusing. I have contracted the clerk of courts no action taken in my name. I contacted the states attorney and plan on contacting the attorney general also. NOT letting this go. Their talk is full of nonsense and things a legitimate agency would not say.

I am with you don't let this go. They left a message on my phone and I called back talking about suing me and this nonsense over a Premier credit card payment. Then the lady got loud and said that they will be suing me and all this BS it is crazy how people are with people during a time like this. - on to them replies to lizTell them you know it is a scam and you will NOT be paying them 1 cent. They cannot do the things they are threatening even if the debt was legitimate! Your social security number will not be blokced, you will not go to jial, they will not be serving you paperts - these threats are all meant to scare people. Report them to www.ic3.gov. The FBI put out a press release in Decemebr 2010n about these dirtbags. Be prepared, they may call you employer or friends and family if they have been able to get that info. Do not give in to thier threats - they are liars and thieves who have stolen your informaiton (probably form an online loan or credit card site) and are trying to extort money from you.
