I searched for Ditech and it comes up with Home Loans. I don't own a home at all! I have my number registered on the DNC as well. They KEEP calling. It's getting annoying.

- rc| 1 replyI don't answer calls I don't recognize. Need to file a report with donotcall.gov and FTC @ www.ftc.gov and if enough complaints get filed, they will investigate and file charges!!!
Collection Agencies - I am not an Attorney - but I have researched Consumer Protection Laws thoroughly.
Do NOT Set up any payment plans with Collection Agencies - they are NOT the original Creditor only Debt Collectors. You are NOT opbligated to them per Federal Law. Google - Fair Debt Collection Practices Act.
If you get notices from a Collection Agency, send sample letters from online Attorneys telling them to cease communication. Tell them if they call - We do NOT discuss Financial matters over the phone. Send me something in writing, and I will respond to it" THEN HANG UP.
When you get demand letter, send above letter as suggested. Once you tell them per written notice to cease communication, per Federal Law, they have to comply, or be in violation!
Hope this helps someone, as it has helped us!- Caller: 866-899-5308
- HillaryI got this call twice (once on answering machine and once when I picked up) with a recording saying "please call [my banking institution] at 866. . . . I called my bank's fraud department; the rep called the 866 number and got someone on the phone and conferenced us in. The scam guy said he worked for my bank and gave a bogus ID number to the real bank guy, then got very nasty with both of us. Hopefully people will know to at least check with their own banks before giving out personal info to these scam artists.
- Samantha replies to ASometimes it's not that easy. Hope your never in that situation!!!!!
- Gail replies to rcThank you for the helpful information. I was not aware.
- tlcpetmommyI don't answer calls I don't recognize. Everyone who gets these type of calls need to file a report with donotcall.gov and FTC @ www.ftc.gov and if enough complaints get filed, they will investigate and file charges!!! I have since remembered, you can also file a FCC.gov (Federal Communications Commission) complaint. I think it is a 1008 complaint form - it's been a few days, since I filed on on a Collection Agency attorney.
In regards to the above and Collection Agencies, Attorney Debt Collectors - I am not an Attorney - but I have researched Consumer Protection Laws thoroughly. I am only offering the following advice, per my own knowledge and experience, in an effort to help someone else!!!
Do NOT Set up any payment plans with Collection Agencies - they are NOT the original Creditor, only Debt Collectors.
They want to get you to commit to a payment plan, which then creates an agreement/contract with them; when currently none exist!
When you get demand letter, send above letter as suggested. Once you tell them per written notice to cease communication, per Federal Law, they have to comply, or be in violation!
The same rule goes for any Attorney Debt Collectors, that are NOT located in your residential state. Make sure they do NOT have a Law office in your State, before sending a letter. Out of State Attorney Debt Collectors CANNOT file a Lawsuit against you - even though they will threaten to.
The best thing, do not answer the phone, file complaints for the unsolicited phone calls, and wait for something in writing. Then tell them to Cease all Communication. There are a number of websites that have sample letters that can be used. Again google: Fair Debt Collection Practices Act; and read the Consumer Protection information on the FTC.gov website.
If someone needs more help, leave a message in this website-e-mail with the first sentence stating Need More Help - Debt!!! I have other connections I can give you, in your searches for help!
Hope this helps someone, as it has helped us!
