She says her name is Amy Banks calling from the county, What county I have no idea and that she will serve me unless I call this # and they stop the order. I have gotten this message twice and not been served any papers. I have had this same scam happen several times. They also call my family members. She says the name of the company is Mediation. and the # to call 866-978-1338.

- ksternsI received a voice message from a number that was blocked ( it said unknown name w/ 1)and lady who told me her name Amy Banks looking for my husband, so she could serve him some legal papers and save her trouble of coming and surprising him at home or embarrassing him at work. She said if I could clear it up with the filing service first she would put a stop order. She said to call 1-866-978-1338 with a case # if I needed more info. So I called that number and they said they don't make outbound calls and do not threaten people with lawsuit documents and don't have a processor in the company! REALLY. so I looked up the number and read very similar stories. Thought I'd share mine

First of all I would think if someone was going to serve papers they wouldn't tell you the time they are going to be coming by..LOL I called the number and they claim I have a loan and wanted my personal information. For sure it is a scam. I have reported them to FCA.

- Tawanna HarrellI got a call from Amy Banks as well leaving the number 8669781338. When I called the number, the lady never introduced herself but immediately accused me of having a pay day loan. She has all of my information and stated that no one would commit fraud on a pay day loan to put into my account. I personally don't do pay day loans because the interest on them are rediculous and I am not working so I wouldn't be able to pay it back. I don't like the fact that this company or fraudulent company has all of my personal information so I will be reporting this number and company name. Please be aware!

- Lindsay P. Nakpil| 20 repliesGot a call from an unknown # just a day before Thanksgiving asking me to call back 866-9781338. When I called that #, the guy asked me if I recieved any court order because he said I owe a certain Riverside Payday Loan $500 & Ineed to settle it right away plus penalties & attorney's fees. He was asking me to provide a debitcard # or else the county will serve me a warrant. The guy called me again today telling me that he all has the paperwork & the warrant will be served today. He is calling my cellphone, work & home.

I called this number and this "Whitney" said I took a loan out on 04/04/2012 for $300 and that I needed to pay almost $1400 to have it go away. He said if It goes to court it will be almost $2500. I called the local attorney General and they said they have had a lot of people call them with this same type of complaint and to not give these people any info!

It may be hard to tell the difference between a legitimate debt collector and a fake one. Sometimes a fake collector may even have some of your personal information, like a bank account number. A caller may be a fake debt collector if he:
•is seeking payment on a debt for a loan you do not recognize;
•refuses to give you a mailing address or phone number;
•asks you for personal financial or sensitive information; or
•exerts high pressure to try to scare you into paying, such as threatening to have you arrested or to report you to a law enforcement agency.
If you think that a caller may be a fake debt collector:
•Ask the caller for his name, company, street address, and telephone number. Tell the caller that you refuse to discuss any debt until you get a written "validation notice." The notice must include the amount of the debt, the name of the creditor you owe, and your rights under the federal Fair Debt Collection Practices Act.
If a caller refuses to give you all of this information, do not pay! Paying a fake debt collector will not always make them go away. They may make up another debt to try to get more money from you.
•Stop speaking with the caller. If you have the caller's address, send a letter demanding that the caller stop contacting you, and keep a copy for your files. By law, real debt collectors must stop calling you if you ask them to in writing.
•Do not give the caller personal financial or other sensitive information. Never give out or confirm personal financial or other sensitive information like your bank account, credit card, or Social Security number unless you know whom you're dealing with. Scam artists, like fake debt collectors, can use your information to commit identity theft – charging your existing credit cards, opening new credit card, checking, or savings accounts, writing fraudulent checks, or taking out loans in your name.
•Contact your creditor. If the debt is legitimate – but you think the collector may not be – contact your creditor about the calls. Share the information you have about the suspicious calls and find out who, if anyone, the creditor has authorized to collect the debt.
•Report the call. Contact the FTC and your state Attorney General's office with information about suspicious callers. Many states have their own debt collection laws in addition to the federal FDCPA. Your Attorney General's office can help you determine your rights under your state's law.

I spent over an hour looking online at my bank account and I could NOT find ANY loan that I took out during that time at all. I have done a payday loan but I have paid them back as well.. He just called me again but did not leave a message this time

It would be a good idea if you placed fraud alerts with all three credit bureaus and notified your bank and employer that your are being targeted by criminals attempting to extort money for a non-existent debt. While you are at it, let this guy know that you are aware he is running an extortion scam, have alerted Federal authorities and have NO intention of paying them a dime.

I truly am getting very upset with this whole deal.. I don't understand this at all!
- Elspeth replies to CortneyHe won't show up - typical scammer call trying to scare you into paying him. Real process servers don't call you ahead of time - they just show up. Don't let the loser get you upset. Make a local police report as well, and if the loser calls you back again, tell him you've done so and he won't be extorting any money from you!
- AB replies to Lindsay P. NakpilPlease know these people are frauds and do not pay them anything! You will not be served anything. Law enforcement does not serve papers for financial crimes in this country. They do probably have your identitfying information. My local law enforcement recommended that I put Fraud Alerts on all of my bank accounts and credit cards and to call all three Credit Reporting Agencies to have a Fraud Alert. This way, they will call you anytime someone tries to take a loan out or open credit in your name. My bank actually changed my checking and savings account numbers because they were worried these people would wipe me out electronically because they did have my correct SSN and bank account numbers. These people have been harrassing me for over nine months now and no one has served me papers and nothing has ever come to me through the mail. These people are probably calling from overseas and so they have no idea about the laws in this country. They just try to sound legal and will intimidate and scare you, especially if you are a female between the ages of 50 and 75+. Good luck!

Where will they be when you have a judgement and your wages are being garnished? This country is seriously going down the toilet....people seem to think complaining will get them out of their debts. A phone call, email or text message from a supposed debt collector is not legally sufficient evidence of debt.
The Fair Debt Collection Practices Act (FDCPA) includes statements such as this:
* Every collector must send you a written “validation notice” telling you how much money you owe within five days after they first contact you. This notice also must include the name of the creditor to whom you owe the money, and how to proceed if you don’t think you owe the money. ["Written" means snailmailed ... not emailed or texted]

Therefore, if that caller wants you to pay immediately, before you get the written validation notice via snailmail, or if the caller wants payment via green dot, Western Union, or other untraceable means, then the call is definitely not legitimate.

If you want a reason for the recession, I suggest you look to the unmitigated greed and lack of due diligence of the sub-prime lenders who loaned money to people who didn't even qualify.
