- jk| 25 repliesReceived a call from this number at my father's house. When he commented that I did not live there they then asked for my mother. He in turn asked what this was about...they said it was the department of education and that my mother had cosigned on a student loan. This is a total lie. When he informed them that my mother had been deceased over a year and asked how he could stop these harrassing calls (they call several times a day) they in turn said he would have to send in my mother's death certificate to make the calls cease. To me this deception is abusive and very upsetting. I plan on filing a complaint with the ftc and next time told my father to tell them he was recording the call( in missouri you have to inform the other party legally). Has anyone else had any similar experiences?

- TallGuyI have received multiple calls from this number. A guy named Marcel Santiago asked my wife for the last 4 of my SSN...which she refused to give. He called again, and this time when my wife handed the phone to me after answering, he hung up. I attempted to call the number back, but have not been able to get through to a live person. This appears to be some sort of scam!!!!

- Tim Dawson| 17 repliessomeone calling himself Marcel Santiago keeps calling , saying he represents the department of education,and its about an unpaid student lone, other times he informs us that he has important business with us and we MUST call him back. my husband and I are in our late 60's. we have not needed a student loan in over 40 years.

The only problem is that they are trying to collect on student loans that have been written off thri Fannie Mae. and YES they do write off student loans. They are a business just like any other and have alloted amounts for bad debts. This is a scam. They can not collect on anything that is not being reported on you credit report. DO NOT TALK TO THESE PEOPLE!

- Alfalfa| 5 repliesUnder the TCPA, a consumer has a right to file a lawsuit and recover $500 for each call that violates the TCPA. The TCPA can also be used in conjunction with the Fair Debt Collection Practices Act in some situations.
Generally, the TCPA does not apply to debt collectors making collection calls to debtors. However, if you are subjected to calls from a debt collector and you are not the debtor, you may file a lawsuit against the debt collector under the Fair Debt Collection Practices Act (FDCPA) and the TCPA.
This right was recently recognized by Judge Legrome D. Davis in a case called Watson v. NCO Group, Inc. NCO Group is a debt collector that uses automated prerecorded collection calls. In this case, Mr. Watson alleged he was getting hundreds of calls from NCO Group after he got a new phone number. Mr. Watson claimed he owed no debt to NCO Group, Inc. Mr. Watson filed suit under both the FDCPA and TCPA.
David Israel, defense lawyer for NCO, argued that the TCPA should not apply to debt collectors. Judge Davis rejected the argument made by David Israel. The judge ruled that Mr. Watson had a right to sue NCO Group Inc under the TCPA for $500 for each call. Judge Davis wrote;
[The] Court is convinced that a non-debtor's rights are in fact violated when he is subjected to repeated annoying and abusive debt collection calls that he remains powerless to stop.
Judge Davis' ruling was based upon his interpretation that collection calls to non-debtors violate the privacy rights provided by the TCPA.
So what can you do if you receive "wrong number" calls from debt collectors?
1. Sign up for the Do-Not-Call registry.
2. Save the calls captured by your voice mail or answering machine.
3. Contact a consumer lawyer.

Some of the old debts are bogus. That is everyone in the country with the name of a real debtor is contacted.
- BillThe caller said her name was Maria. Did not know how to pronounce my name and said the call was of a personal nature. My receptionist caught the call on a screening. The caller gave abn extension of 8335.
- NLT| 1 replyYes I have several calls a day from this number and other numbers also. Some are automated voices and others are a real person. Also I KNOW I DO NOT have any debt that needs collected. The one time I "supposedly" did I received a letter in the mail telling me who was turning me in for debt collection and then I called the company that turned me in and asked why, not the collection agency. It was all worked out and I really didn't owe any debt to them, but at least that was an acutal case. I WOULD NOT respond to these calls or any calls in the matter of debt collection until you get a letter in the mail on who is turing you in.

What can we do about these annoying calls?? - A10RUNNERThey keep calling me non-stop asking for a person I have never even heard of say it is urgent and must call back, it is super annoying and has actual disturbed my sleeping (I work nights and by time I finally fall asleep it is obviously super early morning hours then all of a sudden when I am finally passed out my phone rings and it is them, I never answer because they annoy me then I am irritated since I was just woken up and can't fall back asleep.) I tried to answer and it's silent and I have no way of telling them to shut up and leave me alone!! They are rude!! Wait, here they call again as I am writing this =/ figures... I hope they give up!!

- Tom TomHave started receiving these calls. First call I answered and the caller immediately hung up. Second call came through to my answering machine and a foreign female gave a pitch saying she was trying to deal with a past due debt and wanted me to call them back.
No such a thing....I haven't had a debt in years, cerftainly none past due (usual end of month debts always immediately paid). I think this is some sort of scam. It may be one of those where the caller to that number is charged an enourmous sum by the minute....that's why, when I answered the first call, the one on the other end hung up...they want me to call them.....- Call type: Debt collector
- Ed| 11 repliesI continue to get calls from this number sometimes 3 and 4 times a day. I have no idea why. I do not have any outstanding debts and assume that's why these people are calling. The one time I answered I was placed in a que and was expected to stay on line until someone picked up. If I read the info on this blog correctly, if I record/document these calls this company could be subject to penalties that include $500.00 per call. I'd love to slam these ass__les with an expensive lessen like this. If nothing else, they need to know the number they're dialing is for the right person.

It doesn't matter if you have NO debt to your name or if your not even a permanent resident of this country.
It is a SCAM and you have to tell them not to call.

They do not care whether you owe money or not, but will attempt to collect based on what they have given by their clients.
Review your rights under the Fair Credit Reporting Act and cite in a letter to the company you deny their claim and claim your rights. They must relinquish information on the bill you supposedly pay and listen when you tell them not to call. They must take their claim to court or give up.
