Excuse me but what? No information is shared, like what business is 'he' representing. I actually want him to take me to court, so 'we' can stop this scam.

I owe money to G.E Financial for an Arctic Cat I bought a couple of years back and through him they secured an "Order of Garnishment" which arrived at my work today. (fun times). I figured since they seized it from me I did not owe any more but that is not the case.
His number was on the order as a reference and it turns out that G.E. can garnish 30% of my pay until I'm paid up which sucks since I don't earn a ton to begin with.
He is not the worst lawyer I dealt with in my life but not the nicest either. He said there was nothing he could do unless I planned to pay his client off which won't happen since I don't have 23K lying around.
He probably called you because you owe someone money who he represents and is suing you. I don't know why he's calling you, but I would suggest you be careful. You have no idea how embarrassing it is for my boss to pull me aside and give me court papers. I was humiliated. They should not be able to do this in public. My whole life is office gossip now! - stevenI also recieved a call from this Peter Kent and discovered he is no Lawyer if he was he would first say which law office he was based under, also he would have had to verbaly say he is a lawyer which he did not because if he did that would be a criminal offense. But he does work for G.E as a collector because I also owe G.E around 2500 that I am fighting them on so if I where you Sharon I would fight back and have the Garnishment taken off.
- Steve| 7 repliesI just confronted Peter on the phone and he admitted he is no attorney and that he works for a collection agency and I told him not to call again or I would bring him up on harassment charges. SO I HOPE NO ONE ELSE WILL BE FOOLED BY THIS JOKER AGAIN.

Whether he works for a collection agency or not, he has the right to sue and garnish wages. The paperwork that my employer received was from the courts so whether you like Peter or not, I would be careful because the garnishment I got is very real and they have been taking 30% of my pay for the last month.
I'm in discussion with Mr. Kent to settle so he can stop the garnishment...will keep you posted. - jordan replies to sharon| 2 repliessharon;
they cannot take 30% of your pay in a garnishment. it has to come thru the courts and its usually only 25% depends on how much you make. not sure what the debt is for on your part, but if i was you and i agree with Steve, fight it and fight it hard!! - jordan| 5 repliesbesides your boss cannot hand you the court papers-you have to sign for them if delivered to your work or door. been there done that!

thanks for the advice. To be clear, my boss did not hard me the papers to "serve me" he only showed me a copy of the paperwork he received from the courts.
I also found 30% to be high but I called a lwyer friend of the family and he explained different provinces have different rates. If I were lucky enough to live in NB, they could not garnish. In the end though, it's ok because I just negotiated to pay only 40% of my debt to settle so they will take the garnishment off. - Sharon replies to jordanI also called the court house in my area with the docket number and it was official. I too wanted to make sure the paperwork was for real but it was unfortunatly.

It's not our fault that he lost his job and I was only trying to help people out by giving them my side of the story and what happened to me. To accuse me of being in on a "scam" as you put it makes no sense because at least for me, it is real.
If you are mad at getting called or served papers, don't take it out on me..someone who literally just wanted to share their story. I don't know you or your story but you shouldn't make it a habit to judge people you don't know and judge what they have and have not been through.
Why is it a scam? Were you called to pay something you do not owe? Were you a victim? My opinion is that everyone on this board owes money to someone and were all just pissed off that finally we are being held accountable. the difference I think between you and I is that I am taking responsibility and not judging people like you. In fact I would suggest that you are the one who is running the "scam" because you probably owe the same thing I do and you just want to find a way to get out of it. You won't even use your real name "shilltastic" so don't preach to us.
I don't have time for people like you so keep your opinions to yourself if all they contain are accusations with absolutely no basis. - CI recieved a call from a Mr. Kenneth form this number stating that I owe 517 to a HBC credit card from over 3 years ago?? He said that Zellers or HBC has mailed me to my home in regards of this yet I have recieved nothing... if i would have gotten anything I would have taken care of it! DOn't they have to send you paper copies of this stuff so that I can have it for my records as well? And who sues for 517 dollars? Seems fishy to me....

- diane5. SOL. Statue Of Limitation , if the debt is older than 2 years in the province of Ontario it is protected by the SOL. This info apply to debts which discovery is newer than January 1 2004. Debt discovery is the approximate date in time when debtor realised that the debtor will not pay it back the money and usually is the last account activity on that debt , last time you actually paid anything against that account.
i.e. If your last payment was Feb 2004 then starting with March 2006 the debtor can not take you to court anymore regarding that debt nor change the dates in the account.
◦Ontario - The Ontario Limitation Act 2002 , came into force on January 1, 2004. It sets two years as the term (Section 4). This limitation will be reinstated where the debtor acknowledges the debt or makes a partial payment towards repayment of his debt. If the default occurred prior to January 1, 2004, the creditor will continue to have 6 years to pursue the claim. However, if the default occurred after January 1, 2004 then the 2-year rule applies.- Caller: collection

The same holds true in Alberta Diane. Thanks for posting that. In Alberta if you acknowledge the debt in "writing" oor "make a payment" which is considered acknowledgement then the clock begins ticking for 2 more years.- Call type: Debt collector

The Peter Kent these people are referring to is not a lawyer and he admits it when you call him on it. The Peter Kent you are referring to is a different one. Maybe gets your facts straight before you lecture Sharon.Lawyers are assigned as a Trustee by the court and do not call you with threats. You can call the trustee once you have been served via your employer as per the court order. Sometimes they (the Trustee) will work with you if you approach them without attitude. I deal with garnishees and collection agencies as an employer all the time and you are misinformed lady. - babl replies to sharonSharon shut up! You have no idea "again" what you are talking about. CRA, Maitenance Enforcement and the court can issue Requirements to Pay not lawyers and not collection agencies.
- babl replies to jordan| 1 replyWrong Jordan, best you do some more research. A judgement in court (in Alberta) is for 100% of your wage toward the debt but you can negotiate with the Trustee for a payment schedule. CRA & Maintanance Enforcement's Requirement to Pay will tell stipulate the percentage and I have seen CRA go as high as 50%. Again you have to negotiate that down and it is up to them if they want to or not. Watch the manners and you will have more sucess in cooperation from them.
