    I've been getting calls on from this number from a Nick Russo at First U.S. Capital at work and on my cell.  The other number  that they call from is 855-713-3591.  I never pick up, so he always leaves threatening messages. He claims that their client has decided to pursue adverse legal action against me for some debt that I owe. I'm sure they are something old, because I now what is on my credit report. Don't these idiots realize that all you have to do is google their name and number and find out that they are scammers?

    I just received the same message today Nicolas Russo.  I don't know who 1st US Capital is.  Scam! Scam! Scam!  Blocking them.  I just happen to work for a law firm, and that is NOT the proper procedure.  Everything is done by legal mail.  So, don't fall for this.

    Just because someone on the phone calling you says you owe a debt does not mean you actually owe it.

    If a voice on the telephone claims you owe a debt:

    1.    Demand the person give you his or her name, company name, and address
    2.     Demand a debt validation letter by US mail.  E-mail no good.
    3.    Do not pay  the collection agent or anyone else a  dime until the debt is validated

    Of course they won’t do this, no scammer ever will, so simply ignore them and block their calls.

    Note that the US Supreme Court in the Case of HENSON ET AL. v. SANTANDER CONSUMER USA INC., has recently ruled that the provisions of the Federal Fair Debt Collection Practices Act do not apply if the creditor owns the debt in question.  As a practical matter this probably won't effect the kinds of scam debt collectors who often show up on 800notes.  The scam collectors don't give you any information about themselves so it is impossible to know whether or not they in fact "own" the debt in question.  Most do not send debt validation letters and many often say they are collecting for someone else.  So, make the complaint anyway if they are bothering you.  Let the FTC sort it out.


    Also contact your local attorney general

    If they continue to bother you,  and you know you do not owe any money, tell them that you know this is  a debt scam and that you are making a complaint to the police for extortion.  Once you get a copy of the police report and they call you again , just read out the  file number and the name of the PD or Sheriff’s office involved.   Tell them you’ll be glad to send a copy to them at whatever address the jack***es are working out of now.

    You'll probably have to yell at them and talk over them.  Tell 'em  no scammy debt collector is going to push you around.

    You have to get tuff with these people because,  being akin to thugs, brute force is (metaphorically speaking).   the only thing they understand.

    Know your rights through the FDCPA!  This company will try to strong arm you into paying a debt you may not owe or a debt that is past the limitations date and is not legally collectible.

    Received two calls/VM from Nick Russo from First US Capital.  Nick failed to disclose in the VM that this was an attempt to collect a debt, first red flag.  Nick left vague information about a "file" connected to my name and SSN.  Nick called me at 1:37 PM MST and then again, less than 24 hrs later at 9:31 AM.

    Second red flag is Nick instructed me in call # two that I had to return his call by end of business day that day otherwise they would proceed with legal action.  He also said this call is being recorded so this counts as notification.  Nick clarified EOBD was 2 PM EST.  Except he called me at 11:31 EST giving me less than 3 hours to return his call otherwise he was going to file legal action?  Are you kidding me?  You are filing legal action against me within 24 hrs of your first "contact attempt", super legit.  Pfffffffft.  Insert eye roll here.

    Third red flag, no information comes up about First US Capital and all google searches to the 888-370-8610 all tie to message boards like this indicating this is NOT a legit debt collection company.

    I checked my credit profile and see no debt reported in my name in possession of First US Capital.  Check your credit report before responding to ANY Debt Collectors.  If the collector gives you push back, ask for validation of the debt in writing which they legally have to do if the debt is legally collectible

    I always get a big kick out of people that say that debt past the Statute of Limitations is not legally collectable.  Wrong, wrong, wrong, and did I mention wrong?  While they cannot legally sue you, they can still attempt to collect the debt.  Also, they are not required to tell you when leaving a voice message that they are attempting to collect a debt.  Now. the good news is that you got the rest of the post correct, except for the part where you couldn't find them.  CWG40 has posted their address and state registration for you to send that debt validation letter and also for you to file an FDCPA lawsuit.
