Fake Debt Collectors and Collection Tactics

If consumers did not have enough to worry about having to deal with rising credit card interest rates, late fees and over-limit fees, zombie debt, and fervent bill collectors, now we have to worry about collectors calling about fake debt.

While many legitimate collection agencies follow the FDCPA, there are some collectors out there that are only running a scam operation and will be quick to use threats and scare tactics to get you to pay up quick. Their scams turn up in mailboxes, on the internet and through the telephone every day. Some collectors pose as national banks, government agencies (FBI, CIA), or even popular celebrity stars to gain personal information. These phony collectors may threaten to repossess your house, issue a warrant for your arrest, or even garnish your pay check, all of which are against the FDCPA rules. Some of which are even laughable (for example, there is no debtor’s prison in the United States).

Fake debt scammers rely on the fear and lack of knowledge about debt collection laws within the population. They also figure that a certain percentage of their calls will be received by individuals who may be carrying debt on credit cards anyway and may be susceptible to intimidation. When collectors use misleading statements and fail to provide identification, they are breaking the law. Never pay money to a possible thief. Keep cool when you hear from collectors to avoid this collection abuse.

Many times, people who took out payday loans online in the past are most susceptible. If you took a payday loan, be aware scammers may have access to your Social Security number and other personal information, and keep your guard up against such tactics.

Ironically, real "deadbeats" probably wouldn't fall for these scammers, since they have no intention of repaying their creditors anyway. But upright citizens may doubt themselves, thinking they've forgotten to pay a bill. Many times, the sums involved tend to be fairly small, so some people may be tempted to just pay the "bill" and "get it over with."

Ways to Protect Yourself Against Debt Collection Scams

Review your credit report frequently to find inaccuracies.
Be aware of your current creditors and how much you owe.
Ask creditors for identification before you provide any information over the telephone.
    Reporting Fake Debt Collectors

If you ever receive a call from anyone identifying himself as a debt collector, the law requires that the debt collector provide you with identification, and that the debt collector refrain from making misleading and threatening statements.

You can report any problems you have to your state Attorney General’s office www.naag.org and the Federal Trade Commission www.ftc.gov. Many states have their own debt collection laws that are different from the federal Fair Debt Collection Practices Act. Your Attorney General’s office can help you determine your rights under your state’s law.

I'm a bankruptcy attorney for 13 yrs. To answer your question "mimi" yes they can absolutley do that and once your judgment is in place they inflate the debt to 10 times the amount and put a lien on any asset! or worse garnish your wages. Im not sure if your getting garnished but its that most shamful thing to happen, since ever one knows at your job.

HOW COME YOU HAVE NOT ANSWERED THE QUESTION ABOUT WHO SERVED YOU?

Is this scam so WELL KNOWN that they are now posting false complaints about fake service of docs to scare people into falling for their scam?

Did you answer the summons with the appropriate reply that you have never received any prior contact regarding this suit, were not allowed to dispute it as required by law?

Yeah, there is no doubt that it is fake.  There is another website that allows people to post info about numbers like this, and someone on there is claiming that he was served by them, too, to try to scare people.  Also, the reply I sent to the "attorney" here hasn't been answered.  I actually called this number, and they claimed that they tried to serve me before and failed.  I am home every day, so I know they are lying.  Plus, what kind of process server warns you first? They don't want to warn you because then you can leave, you know?

Tom the process server for the fed court
Judgements must be by a court hearing. They cannot garnish your wages without a hearing, unless they are the IRS, no one else. To the attorney: don't add to the scam. Call me and I'll just turn this over to the attorney general's office for california. Stop scamming people, we will catch you.

to Tom: you must be simple minded to think only garnishments come from the irs. You must be part of the problem with this economy and people not knowing what really can happen in a lawsuit.

Company called e and pretended to be a collections agency for one of my previous creditors.  Told me they were serving me with papers for a lawsuit and that the sheriff's department should be serving me soon. They stated that if I paid some of the bill they would remove court costs and not serve me.  They knew too much information and were very convincing.  Unfortunately they scammed me big time and I learned a valuable lesson.  do not trust this company.  National FC  1888-393-6050.

NOT ONLY CAN YOUR WAGES BE GARNISHED BUT ALSO REMEMBER TO GET A CALL YOU ARE BEING SERVED IS BETTER THAN BEING SERVED AT A FAMILY FUNCTION OR AN OFFICE PARTY...YOU CAN BE GARNISHED FOR UP TO 25 PERCENT OF YOUR WAGES DEPENDING ON WHAT YOUR STATE ALLOWS...YOUR ASSETS CAN BE SEIZED IF YOU OWN ANY REAL PROPERTY AND A JUDGMENT ON YOUR CREDIT REPORT STAYS 10 YEARS..THE CREDITOR HAS THE FINAL SAY YOU MAKE THE FIRAT MISTAKE BY NOT PAYING YOUOR BILLS IN A TIMELY MANNER

I agree with commenters above. What kind of process server calls & gives you advance notice that they're coming to serve you?!? I used to work for a company who, if the client refused to pay, served those people & took them to small claims court.  The phone "schpiel" I was given is pretty much identical to Teri's, above. But a few things didn't add up right off the bat. I asked what address it was where they were going to attempt service,  & they read off two very old addresses where I'd lived temporarily in California. Here's the red flag: I haven't lived in Calif. for 5 years!  SOooo: How/why did they get my cell phone # in my new state? I'm not even using the same physical phone as I was in CA. Is some fake process server really going to show up at one of those addresses? (I didn't write the addresses down, but I'm not even 100% certain those are accurate addresses in the first place. I did the "roommate thing" & moved practically every 6 mos for about 2 yrs). Also, I asked the guy who was calling what debt or case this was regarding,
and what area Court was issuing the summons? His answer to those questions was "I'm sorry ma'am, I don't have access to that information. That's all in the sealed documents". And then he gave me the 888-393-6050 number to call
& a case number to reference for more information.
I'm so tempted to call this number & find out what more "information" they can provide. But I'm thankful to have found this thread & to verify what my gut was telling me: That this HAS to be some kind of scam! If anyone has any other useful info I'd appreciate being kept in the loop. Thanks!
