- shawna| 5 repliesI just got a call from this number then he (Marc Alverez Process Server) without telling me transferred me to the collection company DF Group- for a HSBC Credit Card I had 3 yrs ago- I found out on my credit report tha t this account was charged off by HSBC but I guess the ysold it to them- I have never recived anything from DF Group in the mail and the lady said the only serve you court papers & don't sned any other letters? Well I told her I can do payment plan but she refused- she said I have to pay in full otherwise will garnish my paycheck & I will hav eto go to court? I can't afford this but F*** dont know what else to do she said they will take 25 % of my paycheck and my $2000.00 credit card is now up to $4805.11 from fees they added and she said it doesn't include attorny/court fees WTF??? Do you think they really will take me to court? Help - not sure what to do? she wants me to pay $1681.00 right now and I DONT HAVE IT?

you can usually call the court clerks office or visit the website and check to see if they REALLY filed a lawsuit.
2nd - CHECK THE COLLECTION AGENCY AND ATTORNEY - MAKE SURE THEY ARE LICENSED AND BONDED IN YOUR STATE - IF COLLECTION AGENCY IS NOT - THEY CANNOT SUE YOU! not even with a local attorney because they are operating illegally in your state
3. CHECK THE STATUTE OF LIMITATIONS ON THE DEBT - based on State Law - IT COULD BE TIME BARRED - making it ILLEGAL for them to FILE a lawsuit
4. FILE AN ANSWER AND SHOW UP -COLLECTION AGENCIES COUNT ON NO -SHOWS! that way they get an automatic default judgement against you.

- paralegalTom replies to RitaH| 1 replyTry to negotiate asap! If you can't settle then go to court and try to fight it. If you lose you may get your wages garnished for up to 25% of your gross wages. And have a judgment placed against you for 10 years minimum even if you do pay. Try to negotiate an out of court settlement stipulating that no negative action will be placed on your credit report.
