Did they say they are from "United Capital Group" or "UNC"?  I think this is a scam. This article came up when I looked up the name: http://articles.sun-sentinel.com/1991-04-30/n ... d-theft-sunrise.

I received a phone call from a gentelman today stating he was calling to let me know I am getting served and to call this number 888-697-1166 and to give them my case #. So I called and they are stating I am getting served with papers regarding a payday loan I took out in 2011 w/ AWL. I have documents showing I had revoked what they were doing and even filed a complaint w/ the Department of Corporations in CA. The rep said, all I can tell you is good luck and hung up! WTH!

I got a message from a guy yesterday saying that he was trying to find out eith my work or home address to serve me some papers for aloan I had received. He left his phone number so I called today and the lady says that I got a loan with BMG last December and told me that i owe $700. I told her I never heard of the company and she told me the old account number and bank name I had at the time. She said it was mines and it was linked to my social. I told her I wasnt paying a thing and I was going to contact the bank. The bank saw no loan deposited into my account from these people. The lady also told me they are also known as Vince Enterprises, when she said that I knew it was a scam because the same people called me last year with the same crap when i first opened the account trying to scam me out of money. These people are a bunch of weirdos

A woman named Melissa Smith from Processing Solutions continue to call me and had her ID blocked so I could not see her number.

She called me 3 times on both my work cell and my work phone. When she went for a four time on both - I quickly said "this is my work phone / and work cell - please stop calling me here".

Then she did it again - she was rude and abusive and would not tell me her number or where her company was located or why she was calling me. She only said - I had to call this number: 1-888-897-1166 or she was going to serve me with papers. I asked her "on behalf of who would she serve me" and she only siad :  UCG. I asked her who they were. She got rude, abusive and said she would see me in 30 minutes.

She asked for my Social and I told her I do not give that information over the phone. I googled both and got information about UCG being in various scams. I called them and asked them why she was calling me. It took alot of questioning to get him to tell me exactly WHY. I told him I never used that bank, never asked for a pay day loan and he said "tough - your being served, so now your financially responsible because it's your information on the forms". He was not rude in tone, only in words.

Basically they made me feel as if I did not call him and say I would pay something - they would not stop calling and harassing me and threating to show up at my work and home (as Melissa Smith did). I also asked her what city she was in and she said a city name then changed it to the city I lived in.

To me this is bizarre. Why call and not say who you are, who you represent and why you specifically are calling? I had no clue and to disrput my work - continually and then threaten me - saying "You just lost your ONE chance - I'm coming to your office now and will be there in 30 minutes" is a threat.

The FDCPA http://www.ftc.gov/bcp/edu/pubs/consumer/credit/cre27.pdf treats the INITIAL CONTACT between collector and debtor (first call, first letter, first whatever) as a special event. Legit collectors per section 809 of the FDCPA *must* tell you at initial contact, or send you paperwork within 5 days of initial contact, the following:
    1. $amount of debt,
    2. name of the current creditor (which may differ from the original creditor who might have sold your debt),
    3. a statement that that debt will be assumed to be valid unless you dispute in writing within 30 days,
    4. a statement that that if you do dispute in writing within 30 days, the collector must mail you written verification of the debt,
    5. a statement that if you ask the collector in writing within 30 days, the collector must send you the name and address of the original creditor if it's different from the current creditor.
If you don't get the 5 disclosures, orally or in writing (you do not have to ask for them, the FDCPA requires collectors to provide them), treat the collector like you would any SCAMMER.
Note that 3,4,5 must be done *IN WRITING* so you will need to ask an address from your collector. If s/he refuses to give you one for any reason, treat the collector like a SCAMMER.
The collector can threaten court action at initial contact but the FDCPA requires that the collector actually take you to court if the collector threatens it. Threatening court and not going through with it (coercion) is illegal.
If they say the FDCPA does not apply to them because they own your debt, the debt-owner exemption only applies to the original owner. Any 3rd party who buys the debt for the purpose of collecting debt is treated as a debt collector, i.e., ownership is irrelevant and debt buyers must obey the FDCPA as explained in this FTC Staff Opinion letter here http://www.ftc.gov/os/statutes/fdcpa/letters/arbuckle.htm
Has the statute of limitations for your state http://www.fair-debt-collection.com/SOL-by-State.html expired on your debt? If expired, don't pay.
Collectors generally have to be licensed by your state to practise (collect debt) in your state and you can find out by calling your state Attorney Generals Office. Ask if a license is required and does this collector have one. If not licensed, don't pay and file a complaint with your state AG.

Don't worry, let them scream all they want, talk to them calmly, its not worth getting upset over. They have no power and all they can do is call you but if you tell them to stop calling you, they must. If they persist take them to court.
