    Did she show up? I had another message on my work phone today stating without a stop order she would be at my work today asking for my manager and two forms of ID.  She calls from a blocked number and leaves this number.

    I had a woman Janelle call my work and left the same message with my supervisor saying she was a private courier, and that she was first going to my home then to my job to serve documents and my supervisor needs to be present along with two identification. When I call to stop the order, a Ms. Atkinson  said the only way to stop the order was to pay 800.00 on a debt owed. When I told her I couldn't pay she reduced the amount to 300.00 to be payed in installments.

    Section 809 of the FDCPA http://www.ftc.gov/bcp/edu/pubs/consumer/credit/cre27.pdf requires 3rd-party debt collectors to give debtors written notice of debt (the key word is *shall*) :
    "§ 809. Validation of debts
    (a) Within five days after the initial communication with a consumer in connection with the collection of any debt, a debt collector shall, unless the following information is contained in the initial communication or the consumer has paid the debt, send the consumer a written notice containing—
    (1) the amount of the debt;
    (2) the name of the creditor to whom the debt is owed;
    (3) a statement that unless the consumer, within thirty days after receipt of the notice, disputes the validity of the debt, or any portion thereof, the debt will be assumed to be valid by the debt collector;
    (4) a statement that if the consumer notifies the debt collector in writing within the thirty-day period that the debt, or any portion thereof, is disputed, the debt collector will obtain verification of the debt or a copy of a judgment against the consumer and a copy of such verification or judgment will be mailed to the consumer by the debt collector; and
    (5) a statement that, upon the consumer’s written request within the thirty-day period, the debt collector will provide the consumer with the name and address of the original creditor, if different from the current creditor."

    A Collection Agent May Not…

    Here are the top 11 actions prohibited by the The Fair Debt Collection Practices Act:

    Misrepresent Him or Herself

      A debt collector may not misrepresent himself as an attorney or law enforcement officer.

    Use the Telephone to Annoy or Harass

      A collection agent may not cause a telephone to ring or engage any person in telephone conversation repeatedly or continuously with an intent to annoy, abuse, or harass anyone at the called number.

    Threaten Arrest or Lawsuit

      A collection agent may not threaten a consumer with arrest. It may not threaten legal action that is either not permitted or not actually contemplated. In other words, a the threat of a lawsuit may be an empty one.

    Use Abusive or Threatening Language

      A debt collector may no use abusive or profane language in the course of communication related to the debt.

    Publish a Bad Debt List

      Publishing the consumer’s name or address on a "bad debt" list is prohibited.

    Contact By Embarrassing Media

      A debt collector may not communicate with a consumer by post card. It may not use any language or symbol, other than the debt collector’s address, on any envelope when communicating with a consumer by use of the mails or by telegram. A debt collector may use its business name if such name does not indicate it is in the debt collection business.

    Contact a Consumer at Work

      A collection agent may not communicate with consumers at their place of employment after being told this is unacceptable or prohibited by the employer.

    Seek Unjustifiable Amounts

      A debt collector may not demand any amounts not permitted under an applicable contract or as provided under law.

    Contact a Consumer Represented by an Attorney

      A collection agent may not contact a consumer after it learns the consumer is represented by a lawyer.

    Communicate With a Consumer After Receiving a Validation Request

      If a consumer sends a written §1692g response within 30 days, the collection agent may not communicate with the consumer until it mails the consumer the requested verification of original creditor's name and address.

    Communicate With Third Parties

      A debt collector may not reveal or discuss the nature of a consumer’s debts with third parties other than the consumer’s spouse or attorney. A collection agent may contact neighbors or co-workers only to obtain location information. It may contact a third party again if it has reason to believe the information the party provided previously is false.

    Can a Collection Agent Call My Cell Phone?

      Yes. However, if you tell the debt collector it may not use that number because it is a cell phone, it may not contact you again at that number.

    I Keep Receiving Dozens of Calls From Collection Agents. Is That Legal?

      No. Unscrupulous collection agents will use "block parties" or "office parties" where they contact a consumer, multiple neighbors, or co-workers telling them they need to reach the consumer on an urgent matter. This is not permitted under the FDCPA.

    A Collector Says I Will Be Arrested if I Do Not Pay

      This was a true statement before the US Civil War, but has not been true since. People may be arrested if an aggressive judge files a bench warrant for a person who does not appear at a hearing relating to a lawsuit regarding a debt. However, in that case, the offense is the failure to respond to a court order, and not the existence of the debt. As stated above, it is illegal under the FDCPA to threaten a consumer with arrest if the consumer does not pay the debt.

    Thank you for the information. I did make a report with consumer finance just today and will take your advice and file with the FTC , FCC. I made the report after getting another voice message on my cell phone. FYI. This group has two numbers for use one is 855-543-4300 the other is 888-736-0267 please pass on the information .     Will did the woman ever show up at your work? I reported the incident to the FCC that are looking into my case but I'm still getting messages on my phone that she will come to my job. Just yesterday such a message waa left. Has anyone else been getting messages like this?

    I too just had a woman Janelle call my work and say she is either going to my home or my place of employment today and will have a supervisor/manger witness a signature. Something about calling a number to put stop order either way she gets paid. Did this person every show up with anything. I really feel it is a scam. Hope someone answers me back. Really don't know what this is about and I don't need someone coming to my home or job with false documents.

    The person never came but, did try calling and left a voice message saying she needed to make sure she had the correct address, etc. that she was still coming to deliver documents on my job or work.
    I filed a complaint with the FTC and are looking into the matter so please do the same and file a report. I wasn't stupid enough to confirm any information still it has been stressful and embarrassing for these people to contact me at work. Another tip, contact any companies you might owe that is what I did is how I found out the people calling and treating me are trying to get me to pay large amounts of money. Hope this helps

    Someone from this number called and said they had tried to reach me before, that they were going to come to my home, and then come to my place of work.  Left direct number to call, no other information,  I want to file a complaint!!

    Yes that is the woman that called my cell pbone! I had to replay the message a bunch
    of times because her message to me with the number was garbled bur that she was going to come to my home and then to my place of wok to talk to my supeevisor. Is this legal?

    No, it's not legal - it's a violation of the FDCPA to threaten to come to your work and talk to your supervisor - there should be no disclosure to a third party, and certainly not to your employer!  

    Report the caller to the FTC, FBI, Dept of Justice and your state's Attorney General.  NEVER pay any caller unless they MAIL proof that you actually owe a debt and that they have the legal right to collect said debt.  Refusal to mail this documentation is another violation of the FDCPA.  Emailing or mailing an invoice or bill is not proof that you owe a debt.  

    If you're being harassed at work also (yet another violation), please make sure you print up this thread and give it to your HR Dept and/or manager, so they know you're being harassed by scammers.  BTW, process servers do NOT call you ahead of time, and they already know your address, so they don't need to "verify" anything.

    See Tamianth's reply and mine above.  No one gets a heads up they'll be served - the court process server just shows up, so you're being harassed by scammers (or very shady junk debt collectors).  Regardless, if they can't or won't mail proof of debt, you should NOT pay them.

    Yes, reporting to the FTC, and Comsumer Finacing are free government agencies. Another thing you might want to do is try blocking your number. I have a app. From apple for about $2.99 and since downloading the app. This person has'nt been able to call.

    Communicating to my employer these are scamers have also been helpful because now if the scamers call my job, their told to DO NOT CALL.

    yes i got a call on mon dec 2 2013 and then oneat my job on 12/3/2013 and the lady said she doesnt know what the "paper say" she just deliver them,and gave me another number  and the lady kept asking me the reference number,then said sorry our computers are slow and keep going down, then she said im not sure let me transfer you to the "corporate" office,i then hang up.

    I just had the same type of message left on a voice mail at work. But this was a guy stating his name was Patrick Straham (sp) - And he had said the same thing as the lady Janelle did. I'm glad I looked into it. I know better then to pay anyone without giving me proof on paper of what I owe, and I know how the Justice Systems' work, and they wont call before "serving papers," - They just show up without warning. - P.S. - This Patrick guy was very rude and snoby while leaving his message. -

    Patrick has called me 4 times now and i refuse to call back because it is ridiculous!!! I think it is quite funny that he really thinks his threatneing messages are going to be asnwered. What is even more funny is that I work at the police department with the magistrate that he supposedly going to file papers with. Why would patrick be so upset if he is just a mail man? When you think about this it is even more ridiculous!!! Maybe Patrick and Janelle are trying to raise money for the holidays, but I have my own family to care for and I am sure you do too... ignore the calls and report as I have done... keep records of the messages.
