This number came up private on my cell phone. They also managed to leave a message on my boyfriends' cell phone. You can tell the guy : "Eric Shaw" is reading a "script" and says he has a legal summons and needs to send an "officer or agent" to my residence or place of employment. After 3 failed attempts to contact me they will go to court and file a failure to be served. He does not tell you what it is about or what company he is calling for.  If they are smart enough to get my cell phone number, you would think they could find my address.

They called my number as well but it has nothing to do with me. They are saying that I'm a relative of who they are looking for and want me to get in touch with them. They are only using you to get in touch with the person or have you pass the message to the person.

Same boat as you all- they called my parents and then myself and left the same message about a processor- get back in 3 hrs. Luckily, with an attorney in the family.... I am having them call right now to find out what this is actually all about. I'll post....

It is Direct legal services. They file a civil suit against you for whatever debt/credit card they have in their possession. They tell you that you only have 24 hours to pay and of course the deadline to pay is always a few days from the time they call. I have searched online and they can legally pursue a lawsuit even if it is only for $500...but you will have to pay court costs. There is a statute of limitations on most debt...which means the last "activity" on that account. In PA it is 4 years. Even if you closed the account in 2005, but promised another debt collector repayment in 2008, the Statute of limitations begins all over again from 2008. This is how Debt collectors keep these old debts alive. They are ruthless. But they must follow the rules set by the Fair Debt collection Act.

The following comments are in regards to extremely inappropriate phone calls received from Direct Resource Capital (888-901-3089). The continued calls qualify as harassment especially when the matter has nothing to do with the people they are calling. In short there is a lack of continuity of information which leads to continued phone calls and  harassment of people who are not connected with this company.

Direct Resource Capitol should focus there efforts to contact the person that owes the debt.  In addition, they are rude and lack the professionalism and interpersonal skills that are associated with communicating with people if the intent is to gain information. Their scare tactics are amature at best. A complaint will be filed with BBB for harassment.

Please be informed that this is a valid and true statement. Collection agencies can attempt to locate persons of interest within reason. The lack of professionalism, incessant calls, and rude disposition demonstrated by this company qualify as harassment.

My problem is the same as Bab, Sean James told me the exact same thing. He had me scared, until I saw this site. Have they actually carried this out with anyone? Please let me know quick. He said I had a 2 to 3  to contact him or they would dispatch my summons. And something about a uniform officer.

Just got the same "legal summons" and "respond within 3 hours" message on my home voicemail. Tried to call them back last night from my cell and got a recording. Now I wish I would have seen this site first. They are definitely a scam company and use any tactic to gather personal information from you via scare tactics. Don't give them ANY info and block their number!

My phone rang with a private name and number . They stated if I did not call 1-888-901-3089 a uniformed officer would be sent to my door with a summons for civil suite in 2-3 hrs!!!!. When I called the above number they  answered with "yeah?" I said I just got a call with a refference number, I was told "hang on". Then a guy gets on the phone  and asks me for the refference number. He tells me it involves a debt to sd company (credit card) that he can not speak to me he must speak to my husband. I sd he was at work and I handle monies being paid to people. He asked our town in which we live in, asked for the last 4 digits of his social and his date of birth. I supply it. He then says "Hold while I download the file" I wait aprox 7 minutes. He returns to the phone and says that he is to pay $700 some odd for debt owed for sd comany for sd credit card. He said "You can take care of it now or your husband will be sued and he will have to go to court. I said that we will not pay in full, I would like to handle outside of court making payments. He said"We don't except pmts, you can go to court and the judge will allow pmts but he won't be paying $700 something it will be $1900 something if goes to court. I said Uh uh...so you have people call and tell people a uniformed officer will be your door in three hours as a scare tatic to get people to pay there debt? He said the person that called me should not have said that it is untrue. He further stated that there has yet to be a court date issued. We have until tm to pay the amount or an officer will come with summons.

I too will be contacting the BBB on this. It was the absolute most unprofessional phone call I have ever recieved from someone wanting to collect on a debt. Further these working employess don't even give their names!!!!! I am my husband's wife. I do handle his personal affairs. However I am aware of the privacy act law. Legally they were not to share his debt with me and they did.

Further I have never ever heard of someone anyone calling you to warn you of a summons especially the day or in 24 hrs they plan to serve. A summons is simply served without a call.

So-indeed I go to the internet to search the one number the caller told me to call when I find this is what they do to many people. Nothing more than a harassment and scare tattic done so poorly. I mean you would think they would go above and beyond to be professional so they would be more believeable. However answering the phone with "yeah" simply raises flags for one to not take them serious or feel it's a scam and prompts people to want investigate the company on their own.

    Crazy!

Did you file with the BBB? You need to at least know the state. I called Direct Resource Capital and they refuse to provide any information on their location and I am wanting to file a complaint.

I too got a call from them, Direct Resources Capital Corp, in Oceanside Ca.  I spoke to "Mike Longley" and after asking multiple times, he said their address was 2356 Vista Way, Oceanside CA 92054.  I can't find anything at this address so it may be bogus.

If you're going to be sued, they don't bother serving you in person via a process server; a simple letter sent certified mail, return receipt requested, will do the trick.  The "uniformed process server" line is just to scare you into calling.  But they know the rules and HAVE to tell you their name and address if they're collecting a debt.  There is a letter you can send them on Benjamin Dover's awesome site http://www.bendover.com/cdletter.asp that will notify them to leave you alone, and if they call again you can file charges under the fair debt collection practices act and get them fined.

They just left me a message as well, I'll admit it spooked me. Reading these other posts helps understand that it's just scare tactics and I thank you all for posting here.

The worst part is the person this "summons" is for doesn't even live here, nor has ever as far as I know lived here, so where do these clowns get their information?

888-901-3089 just left the threatening message on my machine; which happens to my husband's name, with a case #, and this happens to us regularly because he has a common name, and somewhere along the line a debt collector put him on a list.  It is the wrong person.  Monitor your credit report and get an identity protection (like lifelock, etc.)  to make sure no erroneous judgements are filed against you. Also, call FTC right away and file complaint against this phone number identifying self as a legal summons company.  It is illegal to threaten over the phone concerning debt whether the debt is yours or not.
FTC has a very easy online complaint form to fill out- takes a couple minutes.
