is calling my cell phone and is able to leave a SMS even though I do not have text messaging, i am being charged for the calls, cell service says they cannot do anything about it.

What cellular service provider do you have ?
Have you tried forwarding that SMS to 7726 (SPAM) ?

The domain was registered only 6 days ago, the registrar is ENOM which is notorious for not vetting its customers, and the owner hides behind a privacy proxy service. It appears there is no website, so the domain might be used only for email ... and spam.

It is hosted on Google servers. This means this scammer might be in violation of Googles' contracts.
