- This is their lawyer replies to jimA bankruptcy judge has ruled that Fort Lauderdale attorney Peter Herman, of Tripp Scott, concealed a $10 million fee when he filed for bankruptcy in February 2012.
Herman was found to have “defrauded” creditors in his personal Chapter 7 bankruptcy by concealing the anticipated fee, U.S. Bankruptcy Judge John K. Olson ruled on Aug. 6.
Because of the findings, Olson ordered that Herman cannot wash his hands of debts in bankruptcy, including a judgment of $4.5 million related to a failed development project in Indian River County.
Herman is best known for winning a $20 million intellectual property case against The Home Depot in 2011 for his client Michael Powell, who developed technology to protect saw operators from injury.
But Herman filed for bankruptcy before he received payment from that case and another big win against Security Mutual Life Insurance.
By not disclosing the anticipated windfall, Olson ruled that Herman “acted with intent to hinder, delay or defraud his creditors… when he concealed his interest in the $10 million fee.”
Herman’s bankruptcy attorney, Bart Houston, said Monday that Herman would appeal Olson’s ruling. Houston said he’s the one who told Herman not to disclose the anticipated windfall.
According to Houston, Herman didn’t know how much of the $10 million fee he would be apportioned when he filed for bankruptcy. Herman ended up getting $2.7 million of the fee for the two cases. Technically, that was a bonus awarded by the firm, not a fee, Houston said.
“He did everything required of him under bankruptcy law and ethics regulations, including that he followed the advice of his attorney,” Houston said. “If that means I’m wrong and he sues me for malpractice, so be it. I would suggest something with USM studios Inc seems to be a little off, don't waste your time or money

They are playing the old sales trick of pitch and sucker them in before you hit them with a price. These people have called on me for four years, always the same - a new company name, hi tech profile job and they need me. Then they want you to talk exclusively with the producer. Go ahead, ask them if there is a cost associated with this - they will start dancing around the question. To call this a PR firm means you have never worked with a PR firm. First of all any PR or marketing firm would not be calling you with a pitch and hook. Call it what you want, this is just bad business and a terrible way for anyone to work, reminds me of the timeshare pitch with a cruise at the end!!! Ha
