  • Vision Media Sues 800notes

    Vision Media, a company that produces television promotions for non-profit groups, filed a law suit against us after we refused to remove unfavorable postings about the company and identify the authors of postings in which they accuse Vision Media of deceptive advertising.

    Comments about Vision Media have been placed about three different numbers: 561-338-7475, 561-367-7601, and 561-826-0770.

    Public Citizen attorney Paul Alan Levy along with local counsel Judith M. Mercier of Holland &  Knight in Florida stepped in to represent us in this case.

    We will update you on any new developments on the case.

      Obvious SLAPP suit, one of the sleaziest tactics an unethical lawyer can pull.  

      Best wishes to 800notes, Mr. Levy and Ms. Mercier.  Hope you hand them their crooked a** cheeks.    

      As per New York Supreme Court Judge J. Nicholas Colabella re SLAPP suits, "Short of a gun to the head, a greater threat to First Amendment expression can scarcely be imagined."

      In this era of wireless networking there is little point in trying to trace any ip address.  The country is littered with open wireless access points that anyone can connect to.  In addition, one could bounce a signal around the entire globe using a string of proxy servers.  Tracing the ip address is only going to get you to the last link in the chain.  Unless someone is caught in the act of using the computer there may be no way to prove who actually authored the posting.

      And to think, the money Vision Media is spending on this ridiculous law suit could have been spent on making thier customers happy! But then again, scammers do not think about customer satisfaction. Nay, they will attack you like some kind of schoolyard bully (read some of their counter posts to complaints on the links above. No legitimate company would act so unprofessional.) Their only focus is keeping up the guise of legitimacy for as long as they can, even wasting courtroom time to do so.

        They don't spend a dime on the lawsuit except for the filing fee.  It is almost certainly contingent.

          They probably DO spend money, lawyers don't do this kind of thing for contingency fees, but they've decided that it's worth it to them to crush this voice of dissent and hope to get an order for fees and costs.

      Stand by your policy.  The fact that your company refuses to remove ANY posts means you can't be intimidated or bought.  How about if 10,000 people posted bad things about a "major software corporation", but then, they just paid you $1 billion to delete it all?

      Truth is on your side, all posts are here, including the responses.  If someone wants to dispute a claim, the dispute is posted also.

      This is the only place to get the whole story:  The truth, the false, and the something that in between.  Don't allow censorship of information because someone disagrees with it.  Update it with facts from all people concerned.

      I will assume the "average" individual who uses this site can make an intelligent decision about any organization reported here.

          No, I'd go forward - doesn't like look an indefensible action, as someone else wrote, all the evidence is on here and the burden will be on them to prove it wrong and who's got the deep pocket,hmm?  Yep, an anti-SLAPP cross-complaint, cause of action for frivolous filing and against their lawyers who should have known better and maybe add in some RICO just to make it more painful.  Man, I miss litigation!

      P.S.

      The attorneys at Holland & Knight will not remember me, but I remember them.  The courier company I worked for in Tampa just after college serviced at least 6 of the top 10 attorney firms in the Tampa area.  H&K was one of them, and we were always there in our dark blue jackets to pick up their deliveries.  I've spent a few late nights waiting for that last packet to try to make it to the airport before closing, and knew each of them was just as important as the last.  Hi to all my ex Corporate Courier, Inc co-workers, and the wonderful clients they served.  If H&K is on your side, you have nothing to worry about!

      Hi,
      A site like this is important because so many numbers are not listed and some how they are able to get our information and call us at any time of the day they wish. This is the only way that the average person can quickly find info and post about unwanted solicitations. It is the only way to keep the telemarketers marginally courteous. Laws only go so far. Information is power.

      Good for you guys. This type of harassment needs to stop. Constant phone calls and faxes from companies that you wouldn't do business with just because of their marketing practices. I am on the national do not call list but that doesn't really seem to help. This site is nice to vent on and see that I'm not the only one affected by this. I hope maybe the people that run the DNCL visit this site, because there is allot more information here, then there.
