    BONIFIED SCAM!

Law Offices of Calvin Miller (formerly Calvin & Travis Law Firm)

    Number currently calling from 561-257-4644
Number left to call back 561-855-1647

After researching the 561-855-1647 number it appears they changed the name of their SCAM office just recently (June 4th, 2015).
The BBB page popped up with..
    http://www.bbb.org/south-east-florida/busines ... ami-fl-90136897
    Calvin Miller Collection Agency
    (561) 855-1647
    1203 SW 22nd Ave, Miami, FL 33135-5027

Heavy accented middle-eastern male leaves messages..

“This is an attempt to collect a debt from (automated female voice stating the consumer's name for which they are trying to extort money from). My name is Robert Verdin from the Law Office of Calvin Miller. We have an account under your name. This is a final attempt to contact you before we send this to the court system or else this will be handled by filing a civil case & garnish you pay check with amount you owe & other charges to the Midland Financial Incorporated since 20--. If you are still interested to settle this matter then call me on 561-855-1641."

    Researching the 561-235-7900 number.
"Calvin & Travis Law Firm" shows an alert for the SCAM Group on the BBB site: http://www.bbb.org/south-east-florida/busines ... ton-fl-90060219
    561-235-7900 currently has 9 pages long dating back to September 5th, 2012 to February 26th, 2015: https://800notes.com/Phone.aspx/1-561-235-7900

    Known aliases the caller leaves;
    - Will Jacobs
    - Robert Woods

Their use of this fake creditor dates back to reports as early as 2012 and continues today.

The magic number they seem to be stick on and tell most that is owed is "$489.00". This number has been reported throughout the many posts reporting against this SCAM.

A phone call, email or text message from a supposed debt collector is not legally sufficient evidence of debt.

The Fair Debt Collection Practices Act (FDCPA) includes statements such as this:

    * Every collector must send you a written “validation notice” telling you how much money you owe within five days after they first contact you. This notice also must include the name of the creditor to whom you owe the money, and how to proceed if you don’t think you owe the money.   ["Written" means snailmailed - US Mail ... not emailed or texted]

    Source:
    https://www.consumer.ftc.gov/articles/0149-debt-collection

Therefore, if that caller wants you to pay immediately, before you get the written validation notice via snailmail, or if the caller wants payment via Green Dot, MoneyGram, Western Union, prepaid gift card or other untraceable means, then the call is definitely not legitimate.

IF you wish to communicate with the supposed collector / creditor, visit  the following page, for example "Action Letters" to snailmail:
    http://www.consumerfinance.gov/blog/debtcollection/

If you KNOW you owe no money, or believe the call was from a fake debt collector, please take the time to read this:

There's been a few reports on other forums that I found interesting..
The automated female voice which states the consumer's/victim's name sounds like they are using "siri" from their iPhone.

Received a call saying I  was being sued for  $4000. Called from 561 257 4644, but leaves 561 855 1647 as call back number. Gave a file number, and said it would be filed under Section  9. Have no idea section 9 of what. Claims paperwork should be received within 3-5 days from the court. What court? Says garnishment is in place, but never says who he is "representing"

He is also using the name Robert Burch and saying "C &T law firm. He came up with a long number that was supposed to be my court number and that I was going to be served. My "garnishment " is $4000.00. I'm grateful for your post because that's how I found out about the scam. You can never get ahold of a live person at any number he leaves.

I think I speak for all of us 800notes regulars when I say, if our informational posts help ONE person, it's well worth our efforts. Don't allow criminal scammers to ramp you up and stress you out. They are criminals.

Thank you all so much for the posts! Talk about stressing out for a couple of minutes. Unfortunately due to his heavy accent I couldn't understand the name he used or the Law Firm name he said. It sounded like TNT Law Firm.   I was pretty sure it was a scam, but it's nice to read the confirmation and that I'm not the only one.

Linda, don't allow this scammer to ramp you up with their scare tactics. That's what they count on.

    1. Read the first post on this thread..

    2. Any scam zombie or scam debt collection slime can get your information in many ways (if you at any time you filled out an online application for an online loan, you filled out an application for a payday loan, you placed info in a questionable site, or if any number of institutions that have been hacked into had your information).

    3. Someone with a heavy Indian accent named "Robert Woods" is fictional.

    4. He flipped on you because as soon as you asked that question his gig was up because.
    a. He doesn't have anymore information. What he told you is all he has before him in the stolen or purchased database his "firm" has in its possession.
    b. He doesn't have a legit date of transaction nor any bank account information for which it would have to have been deposited. If he did he would be drawing money out of it and not bothered to call because that's how criminals roll.
    c. In order to garnish any wages he would have to go about the lawful way of doing so and that is, send you a letter postmarked 5 days of his initial contact with detailed information of the original creditor, his collection agency and include the dates and institution of the transaction. He would then have to give you 30 days to respond. Then he would have to have an attorney file at your local courthouse to which you would be informed well in advance regarding any lawsuit to garnish wages. IT WON'T HAPPEN because HE'S WORKING A SCAM.

    5. Block the number or don't bother answering it again. Let it go to voicemail.

Click on the following link and start educating yourself on the laws and the scams https://800notes.com/arts/
Chances are, if this scam firm has your info pretty soon they will sell it down the line and you will be getting calls from other scam firms.

Linda, remember that knowing your rights gives you power over them.  Now there is nothing you can do to prevent anyone from taking "legal action".  But remember this, these are criminals and they would be terrified to set foot in a court house.  Second, you would have to be properly served and have your day in court before they could "garnish" your wages, if that is even al;lowed in your state (there are a few that do not allow it. Now, the next time you talk to hime you tell him that federal law requires the following, and also go to the links I have porovided to make complaints and learn more about your rights:
Federal law (FDCPA) requires them to send you a letter (US MAIL ONLY) within 5 days of their first contact that contains their name, physical address, the creditor’s name, and the amount of the alleged debt.  It also must contains “mini-Miranda” telling you that it is an attempt to collect a debt and that all information will be used for those purposes.  The one other important thing that this letter must also have in it is that you have a right to dispute the debt within 30 days receipt of the letter and if you do so, all collection activity must be stopped until the debt is verified.
Read up on your rights here, get template letters to send and also make a complaint at this government site:  http://www.consumerfinance.gov/
Also file a complaint with your State Attorney General's office.

I received an email from Robert Woods which stated that:
This is an important letter and requires your immediate attention. Despite sending you several reminders, we have received no response from you about your seriously past due account.
We feel that we have given ample time and have been more than patient with you. Therefore, we feel there is no resource but to start the Civil Procedure on you.
Civil case files Under Section (9) with court system. Garnishment letter will be submitted to your employer.
Note: Garnishment amount cover principal amount of debt, Interest charges 18%, late payment penalty, attorney fee, collection agency cost and court expenses.
You can avoid these legal charges by paying the Principal and interest to the appointed collection firm. Contact us to avoid legal consequences.
We regret having to take this action, but we feel we have been more than patient with you. We sincerely hope you will give this your serious consideration.

I received the following email from "Midland Financial Inc". Haven't gotten a phone call from them yet, but if I do I won't be answering. This is a total scam.

Comes now the Plaintiff in the above-entitled matter and for cause of action alleges as follows:

That Defendant is a resident of _______ City, State of ____

That on or about the 20th Day of December, 2012, Defendant did execute and deliver to BANK of ALL BANKS and agreement for a line of credit with MIDLAND FINANCIAL.

Defendant, being in default, demand for payment has been made but Defendant still owes Plaintiff the sum of $489 plus interest at Ten percent (10%) from the 13th day of January 2013, the date of the last account transaction was fail with your bank because either you have closed your account or there was insufficient fund.

Said Agreement further provides for the payment of reasonable Attorney’s Fees. A reasonable Attorney Fee is $192.00 in the event of default.

That said chose in action was assigned to Debt Collector by written assignment on 5-5-13.

Account was assigned to Law Firm by written assignment on 07-28-2015.

Case file under Debt Collection Act CPC(9) Section (14) on defaulter and Garnishment letter will dispatch to the Employer and local authorities.
