    They just called me and told me if I didn't pay back some fake payday loan I've never taken out I'll get a warrant for my arrest and never told me an amount. Told me I had to get like three lawyers for something and told me to watch my attitude when I cussed at him. I've never taken out a loan before in my entire life and he said they have been sending me emails and sepenas for court. I'm very angry!

    Extortion Scam Related to Delinquent Payday Loans

    Washington, D.C.
    December 07, 2010  FBI National Press Office
    (202) 324-3691

    — filed under: Press Release

    The Internet Crime Complaint Center has received many complaints from victims of payday loan telephone collection scams. Callers claim the victim is delinquent in a payday loan and must repay the loan to avoid legal consequences. The callers purport to be representatives of the FBI, Federal Legislative Department, various law firms, or other legitimate-sounding agencies. They claim to be collecting debts for companies such as United Cash Advance, U.S. Cash Advance, U.S. Cash Net, and other Internet check-cashing services.

    According to complaints received from the public, the callers have accurate data about victims, including Social Security numbers, dates of birth, addresses, employer information, bank account numbers, and the names and telephone numbers of relatives and friends. How the fraudsters obtained the personal information varies, but in some cases victims have reported they completed online applications for other loans or credit cards before the calls started.

    The fraudsters relentlessly call the victim’s home, cell phone, and place of employment. They refuse to provide any details about the alleged payday loans and become abusive when questioned. The callers have threatened victims with legal actions, arrests, and, in some cases, physical violence if they do not pay. In many cases, the callers harass victims’ relatives, friends, and employers.

    This happened to me last week. I had to actually file a police report as they gave me SS# to me. They claimed to be a law firm, and that I would get arrested if I didn't pay them money by going to CVS and getting a card to pay them over the phone with. I argued back with them and this made them angry. I got a follow up call from "911" with someone impersonating an officer twice soon there after. This went on for an entire day. I ended up having to flag my credit with fraud alerts, and again.. had to file a police report just to cover myself in case they sell my SS#.

    I just received a phone call from this number claiming I had committed "check fraud". They wouldn't tell me who the debt was through. I could hardly understand what the person on the other end of the phone was saying. They had my personal information including name, social, address, and email. They claimed that I had a debt that was never paid. I hung up on them. They called back and I told them that they were a fraud. I don't know what intrigued me to keep talking but I was curious. They told me they wanted me to pay this debt using my debit/credit card. When I refused he told me he was going to file an arrest warrant for my arrest and come TODAY to my place of employment and arrest me. He then proceeded to tell me that I would spend the "minimum of 16 months in prison". He read me my "rights" and this is what sounded fishy. He used the term "take a ride in a police car" if I got arrested. I HAVE NEVER EVER HEARD ANYONE USE THIS IN REGARDS TO READING SOMEONE THEIR RIGHTS. This is a complete scam and now that I know this, I want all of you to be aware!

    Don't fall victim to this scam! These crooks are not even close to a law firm! Give them a taste of their own medicine - laugh in their face, keep calling them back - ironically they block your number.  I mean come on, if you were really going to be arrested, do you think they would call you?  Ask them to send a copy of the complaint and court order via certified mail - PER LAW!  Also, you all should know you CAN NOT be prosecuted for any payday or installment loan default, so don't take their BS. Do your research on any calls like this - trust me - they change their phone numbers daily!!! SCAM!!!!!!!!

    I just got a phone call from this company, stating that they are a law firm, would not give me any other information when I asked them what law firm they were?  They told me that "the cops are going to come for you and you will talk to you about it, you will ride in the back of a cop car.  I told the person on the other end that I need proof of this transaction and again he said the cops will come and get you.  I asked for more information and than he stated to get very rude with me saying rude things like I could s**k his d**k and it would be the biggest one I ever hard and it got worse from there.
    I again asked what law firm this was and that they would not speak like that if this was a true lawfirm.
    He hung up on me.
    Be careful SCAM.

    The Federal Trade Commission (FTC), the nation's consumer protection agency, is warning consumers to be on the alert for scam artists posing as debt collectors. It may be hard to tell the difference between a legitimate debt collector and a fake one. Sometimes a fake collector may even have some of your personal information, like a bank account number. A caller may be a fake debt collector if he:

    •is seeking payment on a debt for a loan you do not recognize;
    •refuses to give you a mailing address or phone number;
    •asks you for personal financial or sensitive information; or
    •exerts high pressure to try to scare you into paying, such as threatening to have you arrested or to report you to a law enforcement agency.

    If you think that a caller may be a fake debt collector:

    •Ask the caller for his name, company, street address, and telephone number. Tell the caller that you refuse to discuss any debt until you get a written "validation notice." The notice must include the amount of the debt, the name of the creditor you owe, and your rights under the federal Fair Debt Collection Practices Act.

    If a caller refuses to give you all of this information, do not pay! Paying a fake debt collector will not always make them go away. They may make up another debt to try to get more money from you.

    •Stop speaking with the caller. If you have the caller's address, send a letter demanding that the caller stop contacting you, and keep a copy for your files. By law, real debt collectors must stop calling you if you ask them to in writing.

    •Do not give the caller personal financial or other sensitive information. Never give out or confirm personal financial or other sensitive information like your bank account, credit card, or Social Security number unless you know whom you're dealing with. Scam artists, like fake debt collectors, can use your information to commit identity theft – charging your existing credit cards, opening new credit card, checking, or savings accounts, writing fraudulent checks, or taking out loans in your name.

    •Contact your creditor. If the debt is legitimate – but you think the collector may not be – contact your creditor about the calls. Share the information you have about the suspicious calls and find out who, if anyone, the creditor has authorized to collect the debt.

    •Report the call. Contact the FTC and your state Attorney General's office with information about suspicious callers. Many states have their own debt collection laws in addition to the federal FDCPA. Your Attorney General's office can help you determine your rights under your state's law.

    dont fall for it
    I just got a call from 712-283-4296, someone with a very heavy accent called and said that he was from a law firm and I asked the name of the lawfirm, he said OakView Lawfirm.  He told me that was not important the name of the lawfirm I just needed to know that cops were on the way to my house and they are going to put me in the back of their car and I will go to jail for a long time.  I asked why and he told me that the COPS will have the paperwork and I will find out when they come and get me.  I said fine let them come and get me.  He got very nasty at that point telling me I am a S**T and nothing but an American [***].  That he has the biggest D**K.  I hung up from him as he was getting very nasty on the phone.
    He called me back and I said that there is no way that you are a lawfirm speaking to me like that and he hung up on me.
    I did google Oakview Lawfirm.  Funny Oakview Lawfirm is in Calf. and the 712-283-4296 is in Iowa!!! So this is a scam.
    I called them back and I told this to the same man, and he said stop looking things up and posting back things. The cops are pulling in your driveway in 2 minutes. and you are going for a ride and hung up again.
    I called Oakview Lawfirm the number they have on line and they said they are getting a number of complaints about this.  Do not give anyone any information. Oakview has reported it to the FTS and the BBB as well as others, and Real Police have been put on alert and notified.
