- Samantha| 1 replyReceived a phone call about a old debt that I had, gentlemen I spoke to on the phone was very nice. Supplied me with all proof that this was a debt that I had outstanding with a payday loan company. I received a settlement on the account, about a week later I received a paid letter in the mail, stating that this account has been settled and closed.

A supposed debtor DEMANDS a notice of validation. By MAIL! Not e-mail, not via fax. After this validation notice is received it should be verified. The debt collection agency should be verified. Then, and ONLY then, should any kind of payment be contemplated. If a collector refuses to mail proof of his claim, pay him NOTHING. If a collector refuses to provide a verifiable physical address, pay him NOTHING. I could elaborate further. There is no need. I've said enough to let people know how to deal with this outfit......

- HarrassedCaller said I owed a payday loan from Bell in 2013... 2 years ago. I argued back that I owed nothing. Caller became angry and was raising his voice at me saying I was going to be taken to court. I said to show me the website of that payday loan they were talking about and he (caller) said he did not have that information. I said he was grasping at straws to get money and hung up on him.

The account they gave was closed for identity theft. He said I was lying and I told him I would send him the police report. So he hung up on me.

Federal law (FDCPA) requires them to send you a letter (US MAIL ONLY) within 5 days of their first contact that contains their name, physical address, the creditor’s name, and the amount of the alleged debt. It also must contains “mini-Miranda” telling you that it is an attempt to collect a debt and that all information will be used for those purposes. The one other important thing that this letter must also have in it is that you have a right to dispute the debt within 30 days receipt of the letter and if you do so, all collection activity must be stopped until the debt is verified.

Those are called point calls, and they're done by the same collector assigned your file just under a different alias. No, you will never be sued. This is an illegal collection scam ran by two guys in their late twenties who will literally hire anyone off the street. There is no lawyers, there is no courts. None of the names are real. The debts are entirely real, but they also like to jack balances up. Long story short, you dont have to pay.

*Take a picture of your Caller ID
*Keep any and all conversations recorded to your states recording laws, some require they be told, others do not. This can be transferred to a recording device.
*Keep a notebook handy for writing time,date, who you spoke with and what the conversation detailed.
*Check your SOL for your state as well.
*Attorneys need to be licensed as a DC to collect, all DC's must be licensed in their state as well as yours if different.
