- Alfalfa replies to LL| 5 repliesThe Federal Trade Commission (FTC), the nation's consumer protection agency, is warning consumers to be on the alert for scam artists posing as debt collectors. It may be hard to tell the difference between a legitimate debt collector and a fake one. Sometimes a fake collector may even have some of your personal information, like a bank account number. A caller may be a fake debt collector if he:
•is seeking payment on a debt for a loan you do not recognize;
•refuses to give you a mailing address or phone number;
•asks you for personal financial or sensitive information; or
•exerts high pressure to try to scare you into paying, such as threatening to have you arrested or to report you to a law enforcement agency.
If you think that a caller may be a fake debt collector:
•Ask the caller for his name, company, street address, and telephone number. Tell the caller that you refuse to discuss any debt until you get a written "validation notice." The notice must include the amount of the debt, the name of the creditor you owe, and your rights under the federal Fair Debt Collection Practices Act.
If a caller refuses to give you all of this information, do not pay! Paying a fake debt collector will not always make them go away. They may make up another debt to try to get more money from you.•Stop speaking with the caller. If you have the caller's address, send a letter demanding that the caller stop contacting you, and keep a copy for your files. By law, real debt collectors must stop calling you if you ask them to in writing.
•Do not give the caller personal financial or other sensitive information. Never give out or confirm personal financial or other sensitive information like your bank account, credit card, or Social Security number unless you know whom you're dealing with. Scam artists, like fake debt collectors, can use your information to commit identity theft – charging your existing credit cards, opening new credit card, checking, or savings accounts, writing fraudulent checks, or taking out loans in your name.
•Contact your creditor. If the debt is legitimate – but you think the collector may not be – contact your creditor about the calls. Share the information you have about the suspicious calls and find out who, if anyone, the creditor has authorized to collect the debt.
•Report the call. Contact the FTC and your state Attorney General's office with information about suspicious callers. Many states have their own debt collection laws in addition to the federal FDCPA. Your Attorney General's office can help you determine your rights under your state's law.

Extortion Scam Related to Delinquent Payday Loans
Washington, D.C.
December 07, 2010 FBI National Press Office
(202) 324-3691
— filed under: Press Release
The Internet Crime Complaint Center has received many complaints from victims of payday loan telephone collection scams. Callers claim the victim is delinquent in a payday loan and must repay the loan to avoid legal consequences. The callers purport to be representatives of the FBI, Federal Legislative Department, various law firms, or other legitimate-sounding agencies. They claim to be collecting debts for companies such as United Cash Advance, U.S. Cash Advance, U.S. Cash Net, and other Internet check-cashing services.
According to complaints received from the public, the callers have accurate data about victims, including Social Security numbers, dates of birth, addresses, employer information, bank account numbers, and the names and telephone numbers of relatives and friends. How the fraudsters obtained the personal information varies, but in some cases victims have reported they completed online applications for other loans or credit cards before the calls started.
The fraudsters relentlessly call the victim’s home, cell phone, and place of employment. They refuse to provide any details about the alleged payday loans and become abusive when questioned. The callers have threatened victims with legal actions, arrests, and, in some cases, physical violence if they do not pay. In many cases, the callers harass victims’ relatives, friends, and employers. - Nonya replies to Robert BGot a call from this number today on my cell phone. The message says "This call is for (insert my husbands name) we are calling from (something that sounds like)We are calling with the offices of Aston Check Recovery regarding a complaint that has been filed against you and placed in our office. This is pertaining to a returned check with your name and SS# attached to it."
My husband doesn't have checks. NONE. And if he certainly wouldn't write his SS# on it.
I called the number back and some guy (that sounded like the recording) answered and just simply said "This is Joseph" I didn't say anything and hung up.
Sounds like a scam to me. - AshleyI recieved a phone cal from this company saying they were Ashton Check Recovery regarding a returned check with my SS#. I call them and they are saying that it was for a payday loan that I paid off 2 years ago. He said that I still owe money which I don't I have all the reciepts still. I told him that I may be young but I am not stupid.. He didn't want to give me a fax number to send my reciepts.

- Anonymous| 3 repliesJust received an ominous call from these guys, the call showed up as blocked on my phone so I didn't answer. They left this message "this message is intended for ____ my name is Marie Milk? calling regarding a pending case in our office it is set to be filed with in ____ county we immediately need to speak with yourself or you need to grab immediate representation because it is a time sensitive matter. When you call please refer to case number _____. Failure to reply will result in immediate court summons. Thank you" They didn't leave any information a side from the phone number 855-217-4635 to which I could in anyway identify who they may be, and internet searches have turned up nothing but some sort of computer store, who's name sounds nothing like what I heard when I called their number. I called the number and it sounds like asset check recovery? Or maybe ashton check recovery? Does anyone have any information on these guys? Is this a legit business? All my searching has turned up nothing but I don't want to get sued. I'm at a loss because i don't want to get sued but i also don't want to get taken advantage of. Any help would be greatly appreciated.

http://www.consumer.ftc.gov/articles/0258-fake-debt-collectors - Me| 1 replyCan anyone tell me for sure if they are scam artists before I file a report with the FBI?
- Tamianth replies to MeGot a business name for them? A legal street address that is verifiable ala google street view (no a PO box is not going to do it)?? Have they sent you legal debt validation as required by FDCPA law via the US mail (hardcopy) so you can verify the debt? Do they want a green dot card for payment? Major red flag that.
- Me| 1 replyI just got a message from them similar to the one above from a blocked number. She miss pronounced my county and last name before I called Monday i thought id check them out and landed here. They sounded fishy in their message being they can't actually issue court summons' but I wanted to make sure before I run to my attorney and the FBI.
- Me replies to MeI know for sure this is a fake collector now today the left a robo message on my cell phone saying they're calling about some check with my ss#. I haven't used a check in over 5 years. I'm talking to the FBI tomorrow.
- consumerI received a call from this number. They told me that if I didn't pay I want be subject to a subpeana and they woul dtake legal action. They sounded very real and had an old debt of mine that I knew was paid off. They refused to give me written information or their address and information.
