- mrsdmt3| 5 repliesI am receiving multiple treatening phone messages every day stating "this is Nick Roth with litigation. There are multiple pending fraud and breach of contract charges pending against you. If I do not hear back from you, local police will be coming to serve you with papers and arrest you. You will be facing jail time. It is important you contact us to settle this matter immediately". They are also now calling family members on their cell phones, which is even scarier. How are they getting these phone numbers?

- Mrs. Bird| 5 repliesI received a call from this number at work. It wasn't even a real person just a recording that started when I picked up the general line at work. It stated that they were Great Lakes Arbitration and they were leaving a message for (my name here) and that they were persuing a criminal complaint against me and I had 72 hours to call them. So I called the message and first asked the person who answered, what kind of company was this? He said a arbitration company, I asked if it was a debt collector and he said, "No mam, we are arbitrators". He then said he was going to get me to the right department, even though he had no idea who I was or any information from me. A guy got on said he was calling to let me know he was giving me 72 hours to resolve my debt and when I said what debt, he said Oh you don't know? I still had not given my name! When I did give my name he said he was representing my bank, Chase and Cashnet loan on a criminal charge that was being filed against me. I said I want more information and was told it was all in the papers the process server had given me. Of course I haven't been served so I said that and he said oh well they probably haven't gotten out yet, but all the information was in all the e-mails and voice mails I had been sent. I have not received one single e-mail from this company or a voice mail. I told him I wanted a debt validation letter and he said this was a payday loan and he was not required to sent me a debt validation letter. I said send me a debt validation letter and refrain from calling me at my place of business, he started screaming and I hung up. I put down debt collector in the space where you asked what kind of call it was even though the person answering denied that

- Alfalfa replies to Mrs. BirdThe Federal Trade Commission (FTC), the nation's consumer protection agency, is warning consumers to be on the alert for scam artists posing as debt collectors. It may be hard to tell the difference between a legitimate debt collector and a fake one. Sometimes a fake collector may even have some of your personal information, like a bank account number. A caller may be a fake debt collector if he:
•is seeking payment on a debt for a loan you do not recognize;
•refuses to give you a mailing address or phone number;
•asks you for personal financial or sensitive information; or
•exerts high pressure to try to scare you into paying, such as threatening to have you arrested or to report you to a law enforcement agency.
If you think that a caller may be a fake debt collector:
•Ask the caller for his name, company, street address, and telephone number. Tell the caller that you refuse to discuss any debt until you get a written "validation notice." The notice must include the amount of the debt, the name of the creditor you owe, and your rights under the federal Fair Debt Collection Practices Act.
If a caller refuses to give you all of this information, do not pay! Paying a fake debt collector will not always make them go away. They may make up another debt to try to get more money from you
.•Stop speaking with the caller. If you have the caller's address, send a letter demanding that the caller stop contacting you, and keep a copy for your files. By law, real debt collectors must stop calling you if you ask them to in writing.
•Do not give the caller personal financial or other sensitive information. Never give out or confirm personal financial or other sensitive information like your bank account, credit card, or Social Security number unless you know whom you're dealing with. Scam artists, like fake debt collectors, can use your information to commit identity theft – charging your existing credit cards, opening new credit card, checking, or savings accounts, writing fraudulent checks, or taking out loans in your name.
•Contact your creditor. If the debt is legitimate – but you think the collector may not be – contact your creditor about the calls. Share the information you have about the suspicious calls and find out who, if anyone, the creditor has authorized to collect the debt.
•Report the call. Contact the FTC and your state Attorney General's office with information about suspicious callers. Many states have their own debt collection laws in addition to the federal FDCPA. Your Attorney General's office can help you determine your rights under your state's law.
http://www.consumer.ftc.gov/articles/0258-fake-debt-collectorsReply ! - AnonymousI too got a call on my cell with a voicemail that states he was "Nick Roth" and that there was criminal charges against me filed in the county I live in which he got correct and he was notifying me within 72hrs of action taking place. That was friday jul 18, then again mon. 21st. With another 72hrs. But before that Wen.16th a woman called stating 72hrs.I have payday loans I defaulted on last year. Had to close bank account or I would have had charges I could not pay. I consulted a lawyer and he said it was not criminal even if I did close my account before they could get payment. If you go to the great lakes arbitration website at www.glmas.com they state on their front page they do not collect payday loans or any other kind of debt! And if you have been contacted by someone using there name they are operating contrary to law. I think maybe they just might have set up their phone to forward to the official company. That's my guess because the lawyer I consulted called it and it did in fact say you have reached Great Lakes Arbitration. Either that or it is completly fake. He did not talk to anyone it was just a recording. I'm just not really sure.

Extortion Scam Related to Delinquent Payday Loans
Washington, D.C.
December 07, 2010 FBI National Press Office
(202) 324-3691
— filed under: Press Release
The Internet Crime Complaint Center has received many complaints from victims of payday loan telephone collection scams. Callers claim the victim is delinquent in a payday loan and must repay the loan to avoid legal consequences. The callers purport to be representatives of the FBI, Federal Legislative Department, various law firms, or other legitimate-sounding agencies. They claim to be collecting debts for companies such as United Cash Advance, U.S. Cash Advance, U.S. Cash Net, and other Internet check-cashing services.
According to complaints received from the public, the callers have accurate data about victims, including Social Security numbers, dates of birth, addresses, employer information, bank account numbers, and the names and telephone numbers of relatives and friends. How the fraudsters obtained the personal information varies, but in some cases victims have reported they completed online applications for other loans or credit cards before the calls started.
The fraudsters relentlessly call the victim’s home, cell phone, and place of employment. They refuse to provide any details about the alleged payday loans and become abusive when questioned. The callers have threatened victims with legal actions, arrests, and, in some cases, physical violence if they do not pay. In many cases, the callers harass victims’ relatives, friends, and employers. - JosephI faxed a cease and desist letter to (888) 979-9081 I spoke to attorney who said the phone calls are illegal. They stated they were working with prosecuting attorney for both criminal and civil. This is a lie.
They are a scam company that does not have license to collect debt in most states.- Caller: Great Lakes Arbitration

- Helper1Just missed a call from a "Jessica Heart" stating a similar story; criminal charges, litigation, call back to debrief to place a stop hold on the charges. A story that is been played out wayyyy too much. No intent of calling back, it's not like they are going to give me an address to mail a validation letter to seeing as how they "aren't a debt collector"..
- Caller: Great Lakes Advisory Group
