    This jack ass keeps calling me and threatening me. Ooooohhhhh I am so scared.....NOT! He says that if I don't call him back I will be arrested, will lose my job.....blah blah blah. They must have people that fall for their bs otherwise they wouldn't keep calling hard working AMERICAN citizens. It's too bad the fbi can't track them down and lock them up. People please do not fall for their scam!

    Well I have recive a email from this number they said that they are low office an that my social secure it's in hold for USA gov, and also that I have a debt with America cash advance they are really stuped they said that I have to pay 13000 dollar don't trust in this company

    I have received the same kind of email. They say i owe a little over 11000. I wonder who this Michael Davis is and why isn't anyone going after him for trying to steal peoples money. Somehow they get SS numbers and they think they can scare you with threatening jail time. Maybe someone should do this them see how they like it...

    I received this e-mail this morning also.  I contacted Holland & Knight law firm and this Michael Davis is not from there.  Please do not give this person any money.  His e-mail has so many red flags in it.  It is against the law to read me my rights in an e-mail and he is not a police officer or a judge.  The grammar in the e-mail is a joke if he is really representing a law firm.  He somehow has gotten some of your personal information, but he is not who he says he is.

    So this MIchael Davis harassed me at work and called me 10  times, I told him to leave me the [***] alone. He tried to scared the hell out of me and stated that I am being sued for owing money and need to pay the law offices back. Please ignore if you get a call from him. He just wants your money and he is not legit.

    Extortion Scam Related to Delinquent Payday Loans

    The Internet Crime Complaint Center has received many complaints from victims of payday loan telephone collection scams. Callers claim the victim is delinquent in a payday loan and must repay the loan to avoid legal consequences. The callers purport to be representatives of the FBI, Federal Legislative Department, various law firms, or other legitimate-sounding agencies. They claim to be collecting debts for companies such as United Cash Advance, U.S. Cash Advance, U.S. Cash Net, and other Internet check-cashing services.

    According to complaints received from the public, the callers have accurate data about victims, including Social Security numbers, dates of birth, addresses, employer information, bank account numbers, and the names and telephone numbers of relatives and friends. How the fraudsters obtained the personal information varies, but in some cases victims have reported they completed online applications for other loans or credit cards before the calls started.

    The fraudsters relentlessly call the victim’s home, cell phone, and place of employment. They refuse to provide any details about the alleged payday loans and become abusive when questioned. The callers have threatened victims with legal actions, arrests, and, in some cases, physical violence if they do not pay. In many cases, the callers harass victims’ relatives, friends, and employers.

    I got an email from this person telling me I was being g a arrested for fraudulent checks and bank fraud and that I needed him as an attorney before this happened. I have also gotten numerous calls as well. Says he's with Holland and knight attorney and name is Michale Davis number is 1-904-402-9167 it scared me so bad as a mom of 2 who has never even had so much as a ticket then I found this after performing an internet search.

    And he gave you a chance to buy your way out of trouble by giving him a credit card right now or by sending money by Western Union or on a Green Dot card.  

    Its a scam.  He's trying to scare you into paying a debt you don't owe.  Congratulations on not falling for it.

    Is Michael Davis using his real name? Is Holland & Knight registered to do business in any state? Are any of them even found in the States? Thugs like this don't make those answers simple to find.

    Davis, or whatever his real name, is an  Indian scammer.  I've noticed some of the Indian scammers seem to be using devices that suppress their Indian accents, so you can't really tell if they are Indian or not.  But of course, their behavior and the way they phrase their words gives them away.

    These calls are likely not coming from a real bill collector or loan company.  More likely, these calls are coming from cowardly criminals hiding behind a magicJack device plugged in at some God-forsaken corner of the world where there is Internet service.  They simply use a magicJack device and your fear the same way a common thief uses a toy pistol hidden in the pocket of his overcoat to make a bulge that looks like a real gun.

    MagicJacks are readily obtainable outside of the United States for about $100 US and can come with up to a year of free calling to the U.S. and Canada.  In India, see, for example,

    So it doesn't take long to turn a profit, even if only 0.1% of the people they call are stupid enough to believe the scammers.  And India has a high poverty rate, low salaries, and a corrupt government that doesn't cooperate with our government in arresting these scammers.  So to someone in India, it may make cold, hard economic sense to invest in a magicJack and randomly call blocks of numbers - particularly blocks known to contain cell phone numbers - in hopes of finding a suitably gullible person to scam.

    In addition to the regular reporting channels, you might also report the abuse to YMAX Corp.  This corporation is a fully-owned subsidiary of the company that sells magicJacks and is in charge of assigning telephone numbers to magicJack devices.  I have seen reports that they are pretty good at responding to complaints and may be able to permanently shut off a magicJack device, if necessary, so that it can never be used again.

    You should also make a complaint to your state's attorney general's office, letting them know (if true) that the calls appear to be coming from a magicJack overseas, and that YMAX Corporation appears to accept subpoenas from government law enforcement for information that might be used to identify the scammers and at least shut them down.

    Clients Attempted To Extract The Funds Back there were 6 EFT's Returned
    Constituting Worthless Electronic Cheque, So As of Now Rather Than Chasing You
    For Money They Have Simply Decided to write This money as a loss and deemed to
    be stolen As well as press charges against you in your state under your social
    security number.

    Now this legal affidavit has been taken care by FDCPA Law Fair Debt Collection
    Practice Act Chapter: 9 Section: 19

    This is a criminal extortion scam operating out of India. They are making the calls utilizing VOIP and the names of legitimate firms to make it appear the calls are originating from within the US. There is NO "company" or "debt" and you will NOT be arrested. They are harvesting and/or buying consumers' personal identifying information and you need to do whatever you can to protect yourself. This includes: Notifying the FTC: https://www.ftccomplaintassistant.gov/, placing fraud alerts with all three credit bureaus, notifying your bank and employer and letting these criminals know you are aware they are attempting to extort money for a non-existent debt and have alerted the authorities.

    This same email and close variants has been reproduced and debunked many, many times on this site and surely other complaint sites. They all cite the same three bogus charges, all claim "this means just two things for you", and all want you to "take a piece of paper" even though you already have the stupid threat message in print. It's possibly adapted from a South Asian call center talkoff script. Mainly the names and phone numbers change.

    The FDCPA has no "Chapter 9, Section 19" as implied in one train-wrecked sentence. The FDCPA exists to protect alleged debtors from abusive collectors, not help those abusers punish consumers. While it does have a whole section devoted to excluding "bad check diversion" programs, none of that matters since payday loans are *always consumer credit* and never a concern of criminal court when people default.

    No one can hold a numeric sequence for hostage, nor can your own SSN be "suspended" or whatever just because some dirtsack thinks you owe money. This again is part of the illegal bluster showing no comprehension of how American legal process works.

    I don't know if that's your real personal data buried in that cheesy email, but I'm asking Admin to redact it and you to be more careful when posting publicly.

    Not factual.
    A lie.

    The Fair Debt Collection Practices Act (FDCPA) includes statements such as this:

    * Every collector must send you a written “validation notice” telling you how much money you owe within five days after they first contact you. This notice also must include the name of the creditor to whom you owe the money, and how to proceed if you don’t think you owe the money.   ["Written" means snailmailed ... not emailed or texted]
