- taz| 1 replyPhone call saying warrant out for arrest for check pan I didn't get and say will see u in court on Monday if I don't pay 300 now
- Mike in MD replies to tazSCAM! The arrest warrant is a lie and an illegal statement under Federal law. Debt it always a civil matter, not criminal. They also cannot see you in court until you have been served with a summons and service cannot take place this close to a court date.
- Nehemie G.| 1 replythey just send an email too. they told me that i owed $125.
- Caller: 2022412600
- Slim replies to Nehemie G.A phone call or an email from a supposed debt collector is not legally sufficient evidence of debt.
The Fair Debt Collection Practices Act (FDCPA) includes statements such as this:
* Every collector must send you a written “validation notice” telling you how much money you owe within five days after they first contact you. This notice also must include the name of the creditor to whom you owe the money, and how to proceed if you don’t think you owe the money. ["Written" means snailmailed ... not emailed or texted]
Source:
https://www.consumer.ftc.gov/articles/0149-debt-collection
Therefore, if that caller wants you to pay immediately, before you get the written validation notice via snailmail, or if the caller wants payment via green dot, Western Union, or other untraceable means, then the call is definitely not legitimate.
IF you wish to communicate with the supposed collector / creditor, visit the following page, for example "Action Letters" to snailmail:

If you KNOW you owe no money, or believe the call was from a fake debt collector, please take the time to read this:

http://www.cashnetusa.com/consumer-notices - Kathy/indianajust received a call from someone foreigh, could not understand their name but told me they were from attorney generals office and that I had three charges against me? They said they emailed me all the documents (NOT) and I told them to talk to my attorney and hung up! I hate these people praying on innocent people and constantly calling from different numbers all day along!
