Extortion Scam Related to Delinquent Payday Loans

The Internet Crime Complaint Center has received many complaints from victims of payday loan telephone collection scams. Callers claim the victim is delinquent in a payday loan and must repay the loan to avoid legal consequences. The callers purport to be representatives of the FBI, Federal Legislative Department, various law firms, or other legitimate-sounding agencies. They claim to be collecting debts for companies such as United Cash Advance, U.S. Cash Advance, U.S. Cash Net, and other Internet check-cashing services.
According to complaints received from the public, the callers have accurate data about victims, including Social Security numbers, dates of birth, addresses, employer information, bank account numbers, and the names and telephone numbers of relatives and friends. How the fraudsters obtained the personal information varies, but in some cases victims have reported they completed online applications for other loans or credit cards before the calls started.
The fraudsters relentlessly call the victim’s home, cell phone, and place of employment. They refuse to provide any details about the alleged payday loans and become abusive when questioned. The callers have threatened victims with legal actions, arrests, and, in some cases, physical violence if they do not pay. In many cases, the callers harass victims’ relatives, friends, and employers. - Jeffrey| 1 replyI have received similar calls in the past. This is new, and I believe to be fraudulent. - LinkageYep, just got mine. This is a new one "the mediation dept". The last one was "if we don't hear from you, you will forfeit your right to counsel". Before that, it was "important legal documents have crossed my desk". There is no end! Even when you turn it around on these morons and call the bluff, here comes another call a couple months later

I attempted to call back, knowing I have NO outstanding debts, no collections, etc. it rang once and then turned to music for 10 minutes. I hung up and googled, and now believe it as a scam, hope they try and call back so I can speak with them.- Caller: some mediation deptartment

They said I owe $1800 for a $300 online payday loan I took out in 2011. they say if I don't pay my file will be submitted for criminal processing for intent to defraud because I took out a loan without intention of paying it back. I do have record on my bank statement of a payment I made to M Callahan and associates (an online payday loan debt collector which has been shut down) in 2012 of the principal for this same payday loan but they said it's not valid because I don't have any email proof of recept.

You will find that these criminals are required by Federal law to do certain things. They are required to prove to you that the debt is valid, and this has to be done by US Mail, not e mail, or fax, or even smoke signals. They are not allowed to threaten criminal prosecution for a civil debt because it simply does not exist. This is a common attempt to extort money from people because most people do not know the law or their rights. You have just been given the chance to educate yourself, please do so. Also file a complaint about this company on that web site as well as with your State Attorney General's Office.
Do not pay them a dime in the mean time until they validate the debt. Insist they give you a physical address so that you can send them a debt validation letter. I can pretty much guarantee they will not since they know they are breaking the law and will not want you to have their location. - Jim replies to TriciaDid anything come from this?
- Don| 2 repliesI have been dealing with these guys for the last two weeks and they finally sent a "validation email" but said they can not send it via mail because that is what the original lender "supposedly" did for the past four and a half years. I contacted the FTC and local FBI but they couldn't verify whether these guys are scammers. Looking for some insight. Thanks

- Debra replies to JamesSame here, I was called today 1/16/15 saying that I was being charged with wire fraud due to a payday loan that was unpaid and needed to prove that it was paid. I know it was paid over 2 years ago.
They (Amber) said that it was going to be sent to the local district attorney if I did not have an attorney information for them. They had made a recording of the fact that I had paid the bill in full.
It also referred to the Indian person in the first instance when this thing started, and they were A SCAM.
I have a fax # of 8 866 365-9092 that they wanted me to send them information regarding the collection agency that I paid off my bill to. I am not sending them a thing.
