- Alfalfa replies to BrianaHow can I verify whether or not a debt collector is legitimate?
Here are a few warning signs that could signal a debt collection scam:
The debt collector threatens you. Legitimate debt collectors probably won't claim that they'll have you arrested or claim that they or their employees are law enforcement officers.
The debt collector refuses to give you information about your debt or is trying to collect a debt you do not recognize. You have certain rights to ask a debt collector to verify the debt. You can use this sample letter to request this information. Ask for an explanation in writing before you pay.
The debt collector refuses to give you a mailing address or phone number.
The debt collector asks you for sensitive personal financial information. You should never provide anyone with your personal financial information unless you are sure they're legitimate.
If you think that a caller may be a fake debt collector:
Ask the caller for his or her name, company, street address, telephone number, and professional license number. Many states require debt collectors to be licensed. Check the information the caller provides you with your state officials, or the state in which the debt collector holds a license. If the caller refuses or is unable to provide you with information about his company, or if you can’t verify the information he provides, do not give money to the caller or company.
Tell the caller that you refuse to discuss any debt until you get a written "validation notice." This notice must include:
The amount of the debt
The name of the creditor you owe
A description of certain rights under the federal Fair Debt Collection Practices Act
If a caller refuses to give you all of this information, consider requesting this information in writing or seeking assistance before paying the debt to make sure the debt, and the company, are valid.
Tip: You can consider sending the collector a letter requesting the information by using one of the CFPB's sample letters. You can also submit a complaint to the CFPB or you can contact your state Attorney General’s office.
Do not give the caller personal financial or other sensitive information. Never give out or confirm personal financial or other sensitive information like your bank account, credit card, or Social Security number unless you know the company or person you are talking with is a real debt collector. Scam artists, like fake debt collectors, can use your information to commit identity theft such as:
Charging your existing credit cards
Opening new credit card or checking accounts
Writing fraudulent checks
Taking out loans in your name
Contact your creditor. If the debt is legitimate – but you think the collector may not be – contact your creditor about the calls. Share the information you have about the suspicious calls and find out who, if anyone, the creditor has authorized to collect the debt.
Report the call. Submit a complaint with the CFPB or get in touch with your state Attorney General's office with information about suspicious callers.
Stop speaking with the caller. If nothing else works and you believe the calls are fraudulent, send a letter demanding that the caller stop contacting you, and keep a copy for your files.
Tip: You can use this sample letter to write a letter demanding the debt collector stop contacting you. By law, real debt collectors must stop calling you if you ask them to in writing.
Tip: If you're having trouble with debt collection, you can submit a complaint with the CFPB online or by calling (855) 411-CFPB (2372).

Consider getting a call blocking device or phone.. You can google them and many are around $40.00 or so. If its a cell phone, some already have call blocking, if not, there are free apps on the web that will work for some. You can google this. If you have a smart phone, there is a free app called call control. Iphones appear to have apps also. Another one is called Mr. Number. For tracfone & straight talk:

Extortion Scam Related to Delinquent Payday Loans
Washington, D.C.
December 07, 2010 FBI National Press Office
(202) 324-3691
The Internet Crime Complaint Center has received many complaints from victims of payday loan telephone collection scams. Callers claim the victim is delinquent in a payday loan and must repay the loan to avoid legal consequences. The callers purport to be representatives of the FBI, Federal Legislative Department, various law firms, or other legitimate-sounding agencies. They claim to be collecting debts for companies such as United Cash Advance, U.S. Cash Advance, U.S. Cash Net, and other Internet check-cashing services.
According to complaints received from the public, the callers have accurate data about victims, including Social Security numbers, dates of birth, addresses, employer information, bank account numbers, and the names and telephone numbers of relatives and friends. How the fraudsters obtained the personal information varies, but in some cases victims have reported they completed online applications for other loans or credit cards before the calls started.
The fraudsters relentlessly call the victim’s home, cell phone, and place of employment. They refuse to provide any details about the alleged payday loans and become abusive when questioned. The callers have threatened victims with legal actions, arrests, and, in some cases, physical violence if they do not pay. In many cases, the callers harass victims’ relatives, friends, and employers. - Tamianth replies to NateIn a word, Yes its a extortion scam operation! Please read Alfalfa's post above and mine below.. And here is some more information as well.

- MatthewGot the same call, some uneducated black woman who, only knew how to get loud. When I told her my local athourities would be contacting her, she said to surrender to them and hung up. I will just call and continue to herass them on my free time.
- Caller: Rebecca Outlaw
- Call type: Debt collector
- HiswifeI got this call a few mins ago when I asked what it was about they said it's about a payday Loan we will
Let u handle it in court good luck. This needs to stop - karen| 3 repliesI received a call from (678) 503-5412 stating we owed loan that was never taken out from someplace called direct lending. she said she was an investigator and had and affidavit on her desk. I checked all bank records to make sure no deposit was made by a lending company for $300 to $700 dollars, because they have a lot of my husbands past financial information. This is a closed account since 2012. NO DEPOSIT was made ever made for these amounts or from a lending company like this. I tried calling the number back so that I can ask the woman's name, business name, and address so I can turn it into the FTC and attorney generals office but the voice mail was not professional and I didn't leave a message. I then started doing research on this company and how to report fraud claims. I then typed in the phone number and got this page where I see I am not the only one that received these calls. This was a very stressful day due to this crap. I hope they get caught.
- Caller: fraud department
- Call type: Debt collector
- BigA replies to karen| 2 repliesYou need to remember that it is up to them to prove that you owe the debt, not the other way around. Read Alfalfa 's and Tamianth's posts above to learn more.
- karen replies to BigA| 1 replyBigA I did read it after hours of freaking out. I'm just glad I found this page before it went any further. I know so much more now than I did a few hours ago. After reading this page and the FTC's page. Thanks for the reply. I just hate this kind of crap. I work so hard to have good credit. ☺
- BigA replies to karenGood, that is the best way to prevent from becoming a victim of these scams. If more people would educate themselves, these criminals would be out of business since no one would fall for their ruse and pay them anything.
- Martin replies to KarenThey called me yesterday as well. Same story except they had my DOB and last four of SSN. I am signed up for credit monitoring so I can hopefully stop them if they try anything, but the call was very strange. I hope they get caught!!
- CWG40The Infamous Rebecca Outlaw strikes again. She just loves to threaten arrest.
The “govern yourself accordingly” Scam group. Ignore these people and block their calls.
Report them:
http://www.consumer.ftc.gov/articles/0149-debt-collection (Threatening criminal prosecution to collect a civil debt is a clear violation of the Federal Fair Debt Collection Act)
Also contact your local attorney general
If they continue to bother you, and you know you do not owe any money, tell them that you know this is a debt scam and that you are making a complaint to the police for extortion. You might have to yell at the scammer and talk over him or her. Once you get a copy of the police report and they call you again , just read out the file number and the name of the PD or Sheriff’s office involved. Tell them you’ll be glad to send a copy to them at whatever address the jack***es are working out of now.
_______________________
Usually starts off by saying there are 2 “complaints” against you. Or that there are “warrants” against you or that you are going to be arrested. Gives you a spiel meant to frighten you into paying them something and then sometimes ends with the stupid phrase “govern yourself accordingly.” Sometimes includes threats of arrest. Sometimes they use the phrase “handle yourself accordingly.”
