- Marj| 5 repliesreceived a call from them claiming to be a law office stating I was being sued for taking out a loan from cashnetusa fraudulently. When I asked questions I was told "don't you know" um, if I knew would I be asking? could this be real? They said they were forwarding the report to my local police dept and gave the address of my police dept. and stated that I needed to hire an attorney. I never took out any loan.

It may be hard to tell the difference between a legitimate debt collector and a fake one. Sometimes a fake collector may even have some of your personal information, like a bank account number. A caller may be a fake debt collector if he:
•is seeking payment on a debt for a loan you do not recognize;
•refuses to give you a mailing address or phone number;
•asks you for personal financial or sensitive information; or
•exerts high pressure to try to scare you into paying, such as threatening to have you arrested or to report you to a law enforcement agency.
If you think that a caller may be a fake debt collector:
•Ask the caller for his name, company, street address, and telephone number. Tell the caller that you refuse to discuss any debt until you get a written "validation notice." The notice must include the amount of the debt, the name of the creditor you owe, and your rights under the federal Fair Debt Collection Practices Act.
If a caller refuses to give you all of this information, do not pay! Paying a fake debt collector will not always make them go away. They may make up another debt to try to get more money from you.
•Stop speaking with the caller. If you have the caller's address, send a letter demanding that the caller stop contacting you, and keep a copy for your files. By law, real debt collectors must stop calling you if you ask them to in writing.
•Do not give the caller personal financial or other sensitive information. Never give out or confirm personal financial or other sensitive information like your bank account, credit card, or Social Security number unless you know whom you're dealing with. Scam artists, like fake debt collectors, can use your information to commit identity theft – charging your existing credit cards, opening new credit card, checking, or savings accounts, writing fraudulent checks, or taking out loans in your name.
•Contact your creditor. If the debt is legitimate – but you think the collector may not be – contact your creditor about the calls. Share the information you have about the suspicious calls and find out who, if anyone, the creditor has authorized to collect the debt.
•Report the call. Contact the FTC and your state Attorney General's office with information about suspicious callers. Many states have their own debt collection laws in addition to the federal FDCPA. Your Attorney General's office can help you determine your rights under your state's law.

They claimed i used a fraudulent bank acct to obtain funds. I explained i didnt but he said to take it up with the court. I said ok because i know i did nothing wrong, keep in mind he spoke with a thick indian voice. He did say he.was.from a law firm that does exist. They actually left me a msg with a call back number. So i called it back. This cannot be real though. The guy hardly spoke english

Extortion Scam Related to Delinquent Payday Loans

The Internet Crime Complaint Center has received many complaints from victims of payday loan telephone collection scams. Callers claim the victim is delinquent in a payday loan and must repay the loan to avoid legal consequences. The callers purport to be representatives of the FBI, Federal Legislative Department, various law firms, or other legitimate-sounding agencies. They claim to be collecting debts for companies such as United Cash Advance, U.S. Cash Advance, U.S. Cash Net, and other Internet check-cashing services.
According to complaints received from the public, the callers have accurate data about victims, including Social Security numbers, dates of birth, addresses, employer information, bank account numbers, and the names and telephone numbers of relatives and friends. How the fraudsters obtained the personal information varies, but in some cases victims have reported they completed online applications for other loans or credit cards before the calls started.
The fraudsters relentlessly call the victim’s home, cell phone, and place of employment. They refuse to provide any details about the alleged payday loans and become abusive when questioned. The callers have threatened victims with legal actions, arrests, and, in some cases, physical violence if they do not pay. In many cases, the callers harass victims’ relatives, friends, and employers. - clint replies to Marj| 2 repliesMarj could you please tell me what u find out I had the same thing happen to me today but they had a fake name? Its clearly some type of internet scam but it has me flustered it can't be a law firm its some type of communications it says so it has to be fraudulent
- Marj replies to clint| 1 replyWell, I placed a call to the actual law firm they claimed to be and left them a message. The law firm called me back saying that the number I provided was in northern California and that he was located in a different part of California but that his law firm has no record of any pending law suit against me. The person who called said his name was John, but had an Indian accent. I hung up on him, he called me back and left a message telling me to call the number I provided to 800notes. When I called, another gentleman named Chris took my call, he too had a thick Indian accent. He read me an affidavit that had the details of the alleged law suit against me. It sounded so real because he had the address of my police dept to which he said he was forwarding the affidavit and then told me to hire a lawyer. He never asked for money. But he may have wanted to scare me into offering to pay it

Fahey| 3 repliesI received a call stating the individual was from a law firm and that I was being sued for something (could not understand through accent) and that my case papers would be at my local police station (gave correct police address) and that I needed to call him and if not, by ss# would be immediately "blacklisted' upon receiving the call.

- ANONYMOUS| 2 repliesJohn Douglas (heavy Indian accent; barely understandable) called claiming that there was a pending warrant in my name and the local police department was after me. They have sent "100's" of emails with no response. He could not give me details as he needed to transfer me to a senior attorney to discuss the case further. Needed to confirm address paersonal data.....WTF! BEWARE OF THIS SCAM!!!

I called back and another man named Chris martin (who also had a thick Indian Accent) answered. And proceeded to read an affidavit of alleged charges against me. Stating that would be sent to my local police. (also had the exact address of my police dept).

Read all my alleged charges to me with the exact address of my local Police dept. I called the real law firm of William Hopkins and left a message. He called back and stated he has no case against me. Total scam. Not to mention that both men I spoke to had think Indian accents. How many law firms hire not only 1 but 2 people who barely speak English? Tisk Tisk. sue away baby, cause you got nothing on me
- Marj replies to JenThe call I received was from a private number. it said unknown caller on my caller id. No number to block. the number I listed was the call back number the guy gave me after I hung up on him. He called me back and left a msg telling me to call that number.

I have had fraud happen to me and have been in contact with a police officer from Illnois who is working on charges against a guy that has been in California as well as other places. Don't let them scare you.
- dahook replies to MarjThey have called me many times also gave me the police depatments address eveything he has not asked for money they address he gave me fir my house is a house i have not lived in for two years and telling me that i have a summons that my police department will bring to me he had told me two diffrent dates and nothing has happen i got some information that im going to ask him the next time he calls and if he hangs up i will know the truth then

I called back, and spoke with John Douglas (sounded like the same voice) who told me it was The William Hopkins Law Firm, and they had subpoenas waiting for me at the local police station, and hat this was going to the Federal court house in my local village. Great... Except, the only Federal court house is of an hour away. I also told him I was recording the call and forwarding to the FBI as a scam call. I live in NY, and it is illegal to collect on any payday loan in NYS. Someone hasn't done their homework.... I have, and own my rights. They are saying I owe $4335 for a $300 payday loan. Uuummmm... I think not buddy.

- Cari| 1 replyI received several messages from "ryan smith" stating the same thing as everyone else is saying...he's from a law office and I needed to call his senior attorney to get all of this information on the lawuit being filed against me. He wouldn't give me any information, but he knew my home address, which really freaked me out...Needless to say, I know this is fake and I did not return the call - his senior attorney and he can both kiss it because I'm not going to fall for this crap!! Nice try...

- JoI just received the same call. I am reporting it as suggested in the previous post. So thankful for the all the post. I couldn't think of any reason I would be sued.

- alexia replies to MarjJust got the same call but knew from previous attack how to handle it. Said he had a warrant or something and my local police department had it because I had a debt. Told me he was going to read it to me since I didnt know what it was about and for me not to interupt him. I then told him to hold on I needed to say something first. I told him first off my local police dept doesnt have anything on me as my husband is a police officer there, I know your a scam as I have talked to someone like this last year and that I have just reported him to the police, feds and better business, ask do you have any questions for me now? He said he didnt know what I was talking about and they were going to turn this in! I told him go ahead but dont ever call me again. After I hung up I called back to see what they would do and they wouldnt answer my number! LOL. Dont ever give them anything, they buy US numbers (which is illegal) and pose as a business in that state. They are apparently to lazy to get off their [***] and get a real job so they sit over there like a bunch of freaking animals calling scaming people who actually believe them and give them money!
