- anonymous| 2 repliesJust got a call from a Washington number, 509-703-4015, left vm asking to contact them at 855-977-2134. Automated message. Sounds fake as they threatened service of court documents if I don't contact them. Nobody calls to warn you that you are being served anything, plus I live in Florida, and work as a paralegal. I know how the legal system works in this state.

- danafg| 1 replyI got a call from(855) 977-2134 they also left me a vm saying if I want to voluntarily resolve this matter call that 855 number. In the msg they also alluded to some vague legal matter & referenced a case number. I actually called the number & was surprised it was answered by a real person. Didn't give them a chance to say alot as I immediately told her I know about this scam & to take my number off their list. I appreciate the para legal comments, I already have experienced these kind of calls going back 5-6yrs & like I told the nastiest of the callers NO ONE WARNS YOU WHEN YOU HAVE A WARRANT FOR YOUR ARREST THEY JUST COME GET YOU. I'm wondering what the next big scam is going to be cuz this one has been around for years even making it to the evening news both local & national. I pray some senior citizen like myself, doesn't fall victim to these kind of scams. Heck I hope no one does regardless of age.

- David replies to jennyJenny,
As a former collection manager (for a reputable company), I must say that they are just your 'run of the mill' collection agency. They use legal jargon as a scare tactic in order to make you think you're in serious trouble with the law. Every couple months I'll get a call from such companies claiming I took out a payday loan back in 2009, which I did not do. When they call and try to bluff me, I just laugh in their face.
If they call you again, demand that they validate the debt by sending it you in writing. Get their mailing address and send a Cease and Desist letter to them via certified mail. Once they receive it, they can call you just once more to tell you that any further communication will be by mail only.
If they refuse any of the above then you may want to contact the FCC, FTC, or your state attorney's office. - Good semeritanDo not waste you're time calling the 855-977-2134 number back that this scam company says to call back no matter what they say! I've been getting calls like this from different numbers over the past few years. Do not give them any information as they will use it to steal your identity and steal your money. It happened to someone I know.

- IrritatedThese people call about mainly regarding "dead" debt. We are past the state SOL, and they call claiming a Pay Day Loan that wasn't paid back. State that it is a "criminal manner" and they are going to press charges. When called, they don't declare their name or name of the company (Prime Management). Last guy I got kept talking over me, wouldn't give me any company info, went so far as to call me a bum and when I told him if he couldn't send verification in the mail then I would just assume they were a junk collection company that didn't abide by federal law. Tried to tell me I was harassing him. This is a junk company.

- LucyThese people called me the other day and told me they were calling regarding an unpaid loan from cashnet USA. I told them I never had a loan from that company and to stop calling me. The woman just kept trying to talk over me - I hung up. I called cashnet USA to make sure they didn't have me in the system from someone else. Not only was I not in there system but they can't even loan in my state. Today these idiots call again. I tell them to stop calling that I called cashnet USA and I never had a loan with them ! So the guy says oh really well it was not with cash net USA but quick cash advance - they are lime the 5th company to be calling regarding this company so I tell them I called them to and they are full of it and I never had a loan with them either - unbeleivAble! Cash net USA is aware of this scam-- these people need to get a real jOb and a real life

If they called you and you know you didn't receive the money they are calling you about wouldn't that make them a fraud?

Extortion Scam Related to Delinquent Payday Loans
Washington, D.C.
December 07, 2010 FBI National Press Office
(202) 324-3691
— filed under: Press Release
The Internet Crime Complaint Center has received many complaints from victims of payday loan telephone collection scams. Callers claim the victim is delinquent in a payday loan and must repay the loan to avoid legal consequences. The callers purport to be representatives of the FBI, Federal Legislative Department, various law firms, or other legitimate-sounding agencies. They claim to be collecting debts for companies such as United Cash Advance, U.S. Cash Advance, U.S. Cash Net, and other Internet check-cashing services.
According to complaints received from the public, the callers have accurate data about victims, including Social Security numbers, dates of birth, addresses, employer information, bank account numbers, and the names and telephone numbers of relatives and friends. How the fraudsters obtained the personal information varies, but in some cases victims have reported they completed online applications for other loans or credit cards before the calls started.
The fraudsters relentlessly call the victim’s home, cell phone, and place of employment. They refuse to provide any details about the alleged payday loans and become abusive when questioned. The callers have threatened victims with legal actions, arrests, and, in some cases, physical violence if they do not pay. In many cases, the callers harass victims’ relatives, friends, and employers.

Section 809 of the FDCPA http://www.ftc.gov/bcp/edu/pubs/consumer/credit/cre27.pdf requires 3rd-party debt collectors to give debtors written notice of debt (the key word is *shall*) :
"§ 809. Validation of debts
(a) Within five days after the initial communication with a consumer in connection with the collection of any debt, a debt collector shall, unless the following information is contained in the initial communication or the consumer has paid the debt, send the consumer a written notice containing—
(1) the amount of the debt;
(2) the name of the creditor to whom the debt is owed;
(3) a statement that unless the consumer, within thirty days after receipt of the notice, disputes the validity of the debt, or any portion thereof, the debt will be assumed to be valid by the debt collector;
(4) a statement that if the consumer notifies the debt collector in writing within the thirty-day period that the debt, or any portion thereof, is disputed, the debt collector will obtain verification of the debt or a copy of a judgment against the consumer and a copy of such verification or judgment will be mailed to the consumer by the debt collector; and
(5) a statement that, upon the consumer’s written request within the thirty-day period, the debt collector will provide the consumer with the name and address of the original creditor, if different from the current creditor." - ANGEL ROMAN| 1 replyANGEL ROMAN please don't call any more.

- LucyThese idiots sent me an email that had a subject line Dunning. Who does that? Again with the same bs that I need to pay some bogus loan from quick cash advance that I never had. They had an address on the letter so I sent them a letter via certified mail telling them to never contact me again. Well what a surprise - the address was fake! I should have known - it was too good to be true that these scam artists would actually put their "real" address on anything!!!!
