It seemed odd, so I told her that I would not settle, but I would give her my new address so she could send me the information so I could send it to my lawyer. - WolfmanJack replies to Same here (GA)| 3 repliesIf your checks were stolen then you are not responsible for that money to begin with. The bank has a responsibility to verify the signature before cashing it. No bank would hunt you down for $9, just isn't worth it. Garnishment only happens after they take you to court, win a judgement against you, and the judge agrees to it, and then only if your state allows it.
Federal law (FDCPA) requires them to send you a letter (US MAIL ONLY) within 5 days of their first contact that contains their name, physical address, the creditor’s name, and the amount of the alleged debt. It also must contains “mini-Miranda” telling you that it is an attempt to collect a debt and that all information will be used for those purposes. The one other important thing that this letter must also have in it is that you have a right to dispute the debt within 30 days of receipt of the letter and if you do so, all collection activity must be stopped until the debt is verified.

Extortion Scam Related to Delinquent Payday Loans

The Internet Crime Complaint Center has received many complaints from victims of payday loan telephone collection scams. Callers claim the victim is delinquent in a payday loan and must repay the loan to avoid legal consequences. The callers purport to be representatives of the FBI, Federal Legislative Department, various law firms, or other legitimate-sounding agencies. They claim to be collecting debts for companies such as United Cash Advance, U.S. Cash Advance, U.S. Cash Net, and other Internet check-cashing services.
According to complaints received from the public, the callers have accurate data about victims, including Social Security numbers, dates of birth, addresses, employer information, bank account numbers, and the names and telephone numbers of relatives and friends. How the fraudsters obtained the personal information varies, but in some cases victims have reported they completed online applications for other loans or credit cards before the calls started.
The fraudsters relentlessly call the victim’s home, cell phone, and place of employment. They refuse to provide any details about the alleged payday loans and become abusive when questioned. The callers have threatened victims with legal actions, arrests, and, in some cases, physical violence if they do not pay. In many cases, the callers harass victims’ relatives, friends, and employers. - April| 2 repliesWon't leave me alone. We are having a good time calling "Jessica" in Atlanta and giving them a hard time. I figure if we become enough of a nuisance, they'll stop calling. If not, we'll continue to enjoy ourselves at their expense.

- Sean| 1 replyJust got a call from them. Saying i wrote a check in 2004 that bounced from an actual bank i was at. Stopped trying to get ahold of me in 2008. But now they want 125.00 and have my social security number and my current mailong address. Said they would email me the information but refused to send it through regular mail. Told me that if i didnt settle then i would get a letter from a law firm that it is being sent to and i could fight it in court. Ill admit i wrote a bad check back then but i know i took care of it due to having over draft protection, i was careless back then. How do these companies get this information? And how can i report them?

- Kelly W| 1 replyI just received a call from the same number as well as from 559-573-8780 both stated I had a unpaid debt that would go for garnishment. When I spoke to a person, stated I had a check that had bounced to pizza hut from an account I had in 2008 for 18.27. I said I would pay it, the total she gave me was 300+ for all the fees. Without the fees over 150.00. I told her I was more than happy to pay the check and a bounced check fee. she said no, I told her she could take me to court because I wasn't paying something from 18 years ago. She then hung up.

- WolfmanJack replies to Kelly WOffering to simply pay something because they called you is a very bad policy. First, the debt might not even exist. These people are hard core criminals that try to bully and scare you into paying them extortion money. Once you pay, they put your name on an easy marks list and sell it to other crooks who then call you over the same or nonexistent debt.

- T| 3 repliesI received a call today in reference to a supposedly 16 year old bad check from this number but originally they called from 559-573-8780 and left a message to call the 1-866 number back. I did and was talked to very badly and urged o pay within 24 hours for a $68 check to Winn Dixie 16 years ago a total of $269. I argued and called my bank and winn dixie, and they said must be a scam but the convincing thing is they produced a copy of my check online instantly for me. It was my check alright but it did not say NSF anywhere....that was the only thing that had me hanging to paying it was how did they get this check. Called state attorneys office and they had four calls today with same scam and the Sherriff dept said I was caller 50 for today. Still freaks me out they have a check copy but hey I have I think one of their cell phone numbers to call back and bother. He was concerned that I had that number lol
