- JonReceived a call from 251-344-6660 and Lady left a message saying she is with Direct Management Collection Agency and that an account was turned over to them for collection. Now the funny part is that I do not have any accounts do or past due to anyone. Then the thing that put the icing on the cake is she said to call them at a 1 800 number. I did not make a record of the rest of it because I knew it was a scam from the get-go. They use the 251-344-6660 to show up as their number, but have you call a different number. Beginning to get more of these calls all of the time. Will not answer unless I recognize the number.

- OldNavythis number called me many months ago (refused to identify with which company they work for). In their VM, they gave me a local number to call back. When I did, it was demanded of me to pay the $350 immediately or they would take me to court. When I pushed her with a bunch of questions and asked several times for them to send me the proof of the debt and she said "we don't do that" and she hung up on me. I called back and spoke with the "supervisor" ...same attitude, same crap being told to me. When I pushed to find out who I owed this alleged debt to, she said it was my bank! ummm, good try because they know how to get a hold of me and my bank account and I would have never gotten my account with them had I owed them money. The supervisor said that I need to settle that instantly (without proof of said debt) and if I didnt, she was taking me to court. I told her fine, see you there! I called my bank and they checked. I owe the bank nothing and am in good standing with them. Today, they called again and left no VM. Guess what, keep calling because I'm not answering! Send me the proof and then we'll talk.

I called the customer service number from the original bill that I had with me and I was told that the collection agency shouldn’t be doing that

- BigA replies to AOne of two things has happened. Either they are misinformed as to what you actually owe or they are collecting for an out-of-network company that supplied the doctor which would be a separate billing. In either case you have more rights then they can imagine.
It is incumbent upon them under the law to prove that the debt exists and that you owe it, and (this is the important part) that they have the legal right to collect it. You are not obligated under the law to prove that you don’t owe or that it is paid.
Federal law (FDCPA) requires them to send you a letter (US MAIL ONLY) postmarked within 5 days of their first contact that contains their name, physical address, the creditor’s name, and the amount of the alleged debt. It also must contains “mini-Miranda” telling you that it is an attempt to collect a debt and that all information will be used for those purposes. The one other important thing that this letter must also have in it is that you have a right to dispute the debt within 30 days of receipt of the letter and if you do so, all collection activity must be stopped until the debt is verified. If and when you get that letter you should immediately send that debt validation letter by certified, return receipt mail.
