Facebook Irregularities

On another note, CallerId4u’s Facebook page appears to be quite popular these days.  The page was first created on January 28th, 2013.  Sometime between February 7th and February 14th, they went from 44 “likes” to 2,567 “likes.”  It’s interesting to note that most of these “likes” originated from Saint Petersburg, Russia.

CallerId4u, Inc. Uses FTC Official Seal to Promote Telemarketing Scheme

On February 20th, 2013, CallerId4U, Inc. used the Federal Trade Commission’s official seal in conjunction with an advertisement for their telemarketing services, which was posted on their Facebook page.  Although this implies an endorsement from the FTC, the services advertised do not appear to have any connection to the FTC’s Do Not Call compliance program for telemarketer Service Providers.

This misuse of the FTC’s official seal appears to be an effort to deceive consumers and prevent them from reporting unsolicited telemarketing calls from CallerId4u phone numbers to government regulators.  CallerId4u purports to offer an “official” complaint mechanism for consumers, however this scheme simply diverts consumers from the FTC’s real complaint form.

As we have noted in an earlier investigation, CallerId4U’s phone numbers were the subject of 138,184 consumer complaints submitted to the FTC between January 1, 2012 and November 30, 2012.  In these complaints, consumers alleged to have received pre-recorded telemarketing calls in violation of Federal law.  CallerId4u enters into revenue sharing agreements with the telemarketers who are responsible for initiating these outbound calls.

CallerId4u purports to offer consumers the ability to “opt-out” of the telemarketing calls identified by CallerId4u phone numbers via an online form or by calling their office directly.  However, this “opt-out” mechanism does not bring a telemarketer into compliance with FCC or FTC rules, especially when the consumer’s phone number is listed on the Federal Do Not Call Registry.

Although they claim to offer services to help telemarketers comply “… to all FCC/FTC Telemarketing regulations,” it appears that CallerId4u is NOT registered with the FTC to provide compliance as a Service Provider.  This means that CallerId4u does not have the ability to prevent calls from being made to phone numbers listed on the Federal Do Not Call registry, which is a fundamental part the FCC and FTC’s telemarketing regulations:

   The Federal Trade Commission (FTC) amended the Telemarketing Sales Rule (TSR) to give consumers a choice about whether they want to receive most telemarketing calls. As of October 1, 2003, it became illegal for most telemarketers or sellers to call a number listed on the National Do Not Call Registry.

Organizations who offer meaningful compliance services to telemarketers must typically register with the FTC as a “Service Provider.”  After paying a registration fee on a per-area code basis, the organization can access the list of phone numbers on the Do Not Call Registry.  This allows for call lists to be proactively “scrubbed” in advance of any calling campaigns, as required by Federal law.

   Service Provider (“SP”) – includes any person or business that provides assistance to sellers or telemarketers to engage in telemarketing, such as list brokers and service bureaus.
