- Ken| 1 replyA female named lindy James called my mother in law after skip tracing her phone and address. stated that her daughter my wife was having a medical emergency and needed information! But refused to give her any details. Little does she know the calls have been recorded! You can only imagine the thoughts my in law was having hearing this. Lindy James gave my in law a reference # to call her back. This is very illegal! This is not 1st party collections . F.D.C.P.A does apply & must be followed. I have called this company prior to the illegal call and gave the same person our attorney info. They are required by federal law to stop all contact with debtor and obtain info from attorney. They have now called at least 3 more times to my in laws home! I’m filling complaints to the federal trade commission, among others. The collector is looking at a 1000$ fine & the collection agency is also responsible for fines.

It sounds like you think the FTC has staffers sitting idle who can prosecute individual cases. The $1k is not a "fine", it's your maximum statutory damage award from a successful lawsuit. The Act also awards reasonable legal fees, charged to the loser. You want some payback, you'll have to gather those audio tracks and notes and get it yourself. You should have a tough case to beat which settles out rapidly. I guess you want the deceitful agent and her employer to be co-defendants to double-dip awards, but I'm not sure you'll convince a consumer lawyer to run that play.
