- Sarge| 3 repliesGot call on my cell phone yesterday from someone named Leslie Miles, representing herself as a paralegal, and referred me to her "Director". A Mr. Purcell identified himself as a representative of the state as "Director Purcell" in charge of white collar crimes. He stated and Leslie had all my personal information and stated that he was giving me a courtesy call to let me know that they were issuing a warrant for me for fraud (3 counts) for issuing a bad check, defrauding by check, and some other charge from a payday loan back in 2010 with CashNet. I told him that I haven't had a payday loan since 2008 and had documentation to prove that it had been paid, he persisted to threaten me with arrest and charges. He stated that he was making notation that I was refusing to comply and that he was processing the paperwork and would file it this morning. That I needed to take two forms of identification and turn myself in to the Sheriff's office by noon Tuesday. He identified himself as being part of the State or County white collar fraud division.

So what happened with yours? I just received that call too.... - Elspeth replies to MaryIt's a scam. Look, if you'd committed fraud, the cops would have shown up to interview/arrest you. You wouldn't receive a threatening phone call from a non-existent department - which is illegal, btw. Defaulting on a payday loan is *not* check fraud, no matter how much the scammers may scream that it is. Per the FDCPA, you should not pay any caller who refuses to mail - do not accept email or fax - proof of debt/proof your caller has the legal right to collect said debt. Refusal to mail this documentation within five days of their first contact with you is another violation of federal law,and as such, you should not pay them.

Extortion Scam Related to Delinquent Payday Loans

The Internet Crime Complaint Center has received many complaints from victims of payday loan telephone collection scams. Callers claim the victim is delinquent in a payday loan and must repay the loan to avoid legal consequences. The callers purport to be representatives of the FBI, Federal Legislative Department, various law firms, or other legitimate-sounding agencies. They claim to be collecting debts for companies such as United Cash Advance, U.S. Cash Advance, U.S. Cash Net, and other Internet check-cashing services.
According to complaints received from the public, the callers have accurate data about victims, including Social Security numbers, dates of birth, addresses, employer information, bank account numbers, and the names and telephone numbers of relatives and friends. How the fraudsters obtained the personal information varies, but in some cases victims have reported they completed online applications for other loans or credit cards before the calls started.
The fraudsters relentlessly call the victim’s home, cell phone, and place of employment. They refuse to provide any details about the alleged payday loans and become abusive when questioned. The callers have threatened victims with legal actions, arrests, and, in some cases, physical violence if they do not pay. In many cases, the callers harass victims’ relatives, friends, and employers.

- Smith| 1 replyI rec'd a call from 512 827 2984 from Patricia Stewart from "the fraud division" in regards to a check written to Ace Cash Advance back in 2008. I checked the county site and low and behold no such number. She had accurate information in regards to my social and an old address but could not tell me which Ace Cash Advance she was referring to for "consumer safety" reasons. She told me she would not the file and they would proceed since I stated that I had no clue what she was referring to. She stated that they would file 3 felony charges against me but they are not interested in the money nor can Ace speak to me now because it has been turned over to her office...Just a few days ago I rec'd a collection call from someone in Ga trying to collect $2k on the same "debt." I have never rec'd a loan in that amount from anyone.

2. A phone call, email or text message from a supposed debt collector is not legally sufficient evidence of debt.
The Fair Debt Collection Practices Act (FDCPA) includes statements such as this:
* Every collector must send you a written “validation notice” telling you how much money you owe within five days after they first contact you. This notice also must include the name of the creditor to whom you owe the money, and how to proceed if you don’t think you owe the money. ["Written" means snailmailed ... not emailed or texted]

Therefore, if that caller wants you to pay immediately, before you get the written validation notice via snailmail, or if the caller wants payment via green dot, Western Union, or other untraceable means, then the call is definitely not legitimate.
