    i received an email, not a phone call, from a place call E-Loan Universe LLC on February 23, 2012 and it states I have until February 28, 2012 to make a payment or pay the full amount due or I could go to court and pay fees, etc. Not totally sure but I'm supposed to owe money for a loan to NCP Payday. I do not remember obtaining a loan from this company, but they have all my information! I would like to find out if this is a legit number and company?!

    This is the email I received exactly nothing has been changed or altered at all. They did not have any of my persoanl information not even my name, I do not have a loan with this company and I know this for a fact. This is a scam....

    Extortion Scam Related to Delinquent Payday Loans

    The Internet Crime Complaint Center has received many complaints from victims of payday loan telephone collection scams. Callers claim the victim is delinquent in a payday loan and must repay the loan to avoid legal consequences. The callers purport to be representatives of the FBI, Federal Legislative Department, various law firms, or other legitimate-sounding agencies. They claim to be collecting debts for companies such as United Cash Advance, U.S. Cash Advance, U.S. Cash Net, and other Internet check-cashing services.

    According to complaints received from the public, the callers have accurate data about victims, including Social Security numbers, dates of birth, addresses, employer information, bank account numbers, and the names and telephone numbers of relatives and friends. How the fraudsters obtained the personal information varies, but in some cases victims have reported they completed online applications for other loans or credit cards before the calls started.

    The fraudsters relentlessly call the victim’s home, cell phone, and place of employment. They refuse to provide any details about the alleged payday loans and become abusive when questioned. The callers have threatened victims with legal actions, arrests, and, in some cases, physical violence if they do not pay. In many cases, the callers harass victims’ relatives, friends, and employers.

    Some fraudsters have instructed victims to fax a statement agreeing to pay a certain amount, on a specific date, via a pre-paid Visa card. The statement further declares the victim will never dispute the debt.

    If you receive these calls, do not follow the caller’s instructions. Rather, you should:

    Notify your banking institutions.
    Contact the three major credit bureaus and request an alert be put on your file.
    Contact your local law enforcement agencies if you feel you are in immediate danger.
    File a complaint at www.IC3.gov.
    Tips to avoid becoming a victim of this scam:

    Never give your Social Security number—or personal information of any kind—over the telephone or online unless you initiate the contact.
    Be suspicious of any e-mail with urgent requests for personal financial information. The e-mail may include upsetting or exciting but false statements to get you to react immediately.
    Avoid filling out forms in e-mail messages that request personal information.
    Ensure that your browser is up-to-date and security patches have been applied.
    Check your bank, credit, and debit card statements regularly to make sure that there are no unauthorized transactions. If anything looks suspicious, contact your bank and all card issuers.
    When you contact companies, use numbers provided on the back of cards or statements

    If your payments are not kept up to date following the issue of payment reminders, a Magistrate's Court summons will be issued for the full amount outstanding and you will lose the right to pay by installments. The issuing of a summons will incur costs of $55.00 which will be added to your bill. To prevent the issue of a summons, it is important that you reply on our email address settlementd@gmail.com

    Attending Court

    If you do not pay the full amount, including costs, shown on the summons before the Court hearing date the matter will be taken to the Magistrates' Court. You do not need to attend Court unless you dispute liability for the outstanding amount.

    At the hearing we will apply for a Liability Order, incurring additional costs of $35.00. The Liability Order enables us to recover the debt in a variety of ways.

    After the hearing you will be sent a copy of the Liability Order together with a form asking about your financial circumstances. After considering the information provided, the recovery section will be able to make a final installment arrangement with you. You must keep to any arrangement granted otherwise further recovery action will be taken for the full amount outstanding amount, incurring additional costs.

    A Liability Order also requires you by law to supply details of your employment and benefits. Failure to provide this information is a criminal offence, and could result in a summons being issued for to attend Court and explain to the Magistrates your reasons for non-compliance. The Magistrates have authority to impose a fine of up to $1,000.00.

    Further recovery action

    The following recovery options are available to us once a Liability Order has been granted;

    Attachment of income support, job seekers allowance or pension credit. If you receive any of these, the Council can apply to the Department of Works & Pensions to deduct regular sums to pay off the debt.

    Attachment of earnings. If you are in paid employment the Council can ask your employer to deduct amounts from your wages.

    Bailiffs. If we are unable to recover the debt under either of the above options, we will instruct Bailiffs to remove goods to the value of the debt. You will incur further costs on each occasion the Bailiff visits your property, and also for the cost of removing your goods for sale at public auction.

    Charging order. If you own property and you owe more than $1000 a charge may be placed on your house. This could mean you will have to sell it to settle your debt to the Council.

    Prison. If we are unable to recover the debt by means of the other options listed a summons will be issued requiring you to attend a committal hearing in the Magistrates Court. This could result in a prison sentencefor up to 3 months

    I too have received an e-mail yesterday from this same company only by someone named Joseph.  The funny thing is I noticed they are using the exact same case # for me as you all have mentioned above.  
    I have never had a payday loan with the NCP company because I do not keep a checking account for purposes like these.  I have been a victim of identity theft in the past.
    When I told them that my attorney will be handling this, they began sending me e-mails in bold letters as if they were screaming at me and very upset because I had retained an attorney.  They demanded to know my attorney's name and number so they can contact her.  I did not give them this information because my attorney already had their information and would contact them.  
    This is scarey.  I am tired of this happening to me.  How do they get my information and what gives them the right to harrass us.  What can be done to make them stop?

    Don't be scared. This sounds like an extortion scam. Scammers use bought/hacked/phished loan application data to extort payments for fictitious debts from victims and victims' families and friends.

    i didnt get a phone call, but i did get an email frm tasc inc. on a settlementtd1@gmail.saying that i owed 920.00 from a 400.00 loan from ncppay day. i have never taken out a loan with them.....so they must have gotten my ss from other websites where i applied for loan but never was able to get it because of my bankruptcy and bad credit. i sent them an email to let them know that they have the wrong person but i dont get a responce and i tried calling them but phone rings then hangs up.....

    Received the same email with the same case number CASE FILE NO : 30/41964 NH; never took out a loan of any kind with these people but they had my ssn correct.  Email was sent on 12/5/12 but was dated for 09/15/12; marked the email as SPAM; so will not be getting anymore!!  For those that don't know, this is a scam, and they will continue to try to call you or track you through your email, but will stop for a few months and start all over again; that's the way they operate.  Have already filed numerous reports on them but they change company names and locations every few months.  Hope you have better luck with them than I have.

          COMPLAINT UNDER THE CIVIL RIGHTS ACT, 42 U.S.C. § 1983

    1.     Civil lawsuit was filed against the debtor in the name of a debt buyer. The underlying debt happened to be an old debt.

    2.     The Debtor failed to answer the complaint in a timely fashion thus leading to the issuance of a default judgment in favor of the debt buyer.

    3.     The lawyer for the debt buyer proceeded to use discovery procedures “in aid of execution of the judgment”. These procedures empower the debt collection lawyer to send “interrogatories” to the debtor and to schedule the debtor for a deposition. The purpose of this is to locate any assets which the debtor may have and which may be amenable to execution.

    4.     The debt collection lawyer noticed the debtor for a deposition. The deposition was of course located at the debt collection lawyer’s office on the opposite side of the state. The debtor attempted to reschedule, but the debt collection lawyer refused.


    5.     When the debtor failed to attend the deposition, the debt collection lawyer filed two motions with the court, the end result being the Order of Copies warranting the arrest and subsequent incarceration of the debtor.
