these collectors tell you they are on your side and on a salary so what ever arrangements they make are in your best interest.  THEY LIE!  They are on a salary and bonus structure and do not adhere to anything they say.  Remember, they can make up to 7000 a month in bonuses, but to do that, they have to tell you what you want to hear.  They cost me over 500 and a bank account because of false statements (specific colector: Dave).

They also work with Crown Management which buys charge-off loans that are bought in "pools loans" other words there "junk debt buyers - (JDBs)" well I have called them once to offer a settlement of a debt from a couple of years back they refuse to accept the offer and try collect the full amount of the debt. The original creditor offer me a settlement of 25% of the debt which I was willing to pay; but they insist in collecting the full balance by treating a law suit, very agressive collectors, and treating you by charging 10% interest (which is illegal) so they try some how to lure you into accepting a debt that is not worth the original balance. be careful before accepting any deals or agreements without doing your research and validating the debt by asking original staments, terms/conditions with your original signiture. Gurstechargo (newname) commitment fraudulent of collections on charged off accounts.  They misstate important dates, like date of last transaction (often the date of default), fraudulent "affidavit" from alleged employee of Cap One, under oath and sworn by notary public, in support of summary judgment.  This is a very important of their "no genuine facts".  However, in this affidavit inaccurate information given which I consider (though I am not an attorney) another example of fraud, or "win at all costs".  I was sued by Gurstel representing Plaintiff Cap One Bani (USA), N.A., but according to my credit report, this Cap One account defaulted in 2008 and charged off in 2009.  I was served S&C 2/13/10, I Answered within 20 days.  Heard nothing until July, 2010 when they filed S&C in District Court.  I next received Requests for Interrogatories, Docs and Admissions.  I am Pro Se because I am disabled, have no job and no money and I can't afford an attorney, even Legal Aid, because I don't have a car or money for a borrowed car.  I have studied consumre credit card debt for at 70 hours, and finally wrote and will serve them.  Gurstel has filed for Summary Judgment to be heard in about 14 days.  I don't know what to file at this point.  I am preparing 3 docs:  Motion to Dismiss Case (which is really not a good option,I guess), a Defendant's Summary Judgment, assuming the judge will allow me to serve it, or wait until after the Summary hearing and file a Motion in Response of Summary Judgment.

Has anyone been through this type of situation with Cap One Bank and Gurstel.   I did not mention Gurstel did not answer my request for validation in my Answer.  They attached some bologna to their request for Admissioons, but never to the Complaint.  

I know Cap One is not the plaintiff, they are the "nominal plaintiff".  Is Gurstel, the attorneys for Plaintiff, Cap One the Third party collector or is another collection buyer or collector.  I am really confused.  I am wasting time deliberating with myself, a novice in this subject at best.  I would love to have someone call me to tell me exactly what to do from this point.

Just because your account was "charged off" doesn't mean you don't owe the money, it simply means that cap one doesn't want it on their active account books.  My advice, stop trying to get out of paying YOUR bill, call the attorney's office and make arrangements to pay your bill.  Oh, and stay off the internet...none of these people know what they are talking about.  The best way to make your creditors go away is to pay the money you owe them.
