- Mady Polsky replies to NelmsieThese aresome dumb people. Three time she said the same thing. They were looking for Antonio Botus (sp?) I kept asking "WHO!?" and repeated that this was a recorded phone call.
she could not vary from the script in front of her. I finally said, "There is no Antonio Botus here!" I did not wait for a reply and said loudly [***] before I slammed the phone shut, I don't care if she heard me or not. That is how pissed off I am. - post pending moderator approval
- Kelly Rose replies to ChrisSame happened to me to saying I owe 2000. At us bank we’ll I called us bank and they said it a scam we don’t own money to them
- brian spruill| 1 replyShe told me she was from portfolio recovery. For once I knew I had nothing in collections so I acknowledged I was the person she was asking for. She asked me confirm my address but I insisted she tell me what this was regarding before I gave her any more info. I told her I was working and couldn't hear her well. She said she would contact me at another time. Never happened.

- BigA replies to brian spruillWell, since they talked to you they are now required to do this:
It is incumbent upon them under the law to prove that the debt exists and that you owe it, and (this is the important part) that they have the legal right to collect it. You are not obligated under the law to prove that you don’t owe or that it is paid.
Federal law (FDCPA) requires them to send you a letter (US MAIL ONLY) postmarked within 5 days of their first contact that contains their name, physical address, the creditor’s name, and the amount of the alleged debt. It also must contains “mini-Miranda” telling you that it is an attempt to collect a debt and that all information will be used for those purposes. The one other important thing that this letter must also have in it is that you have a right to dispute the debt within 30 days of receipt of the letter and if you do so, all collection activity must be stopped until the debt is verified.
First, you should make a complaint at this Federal Agency, and while there you should also read up on how debt collection is supposed to work as well as what your rights in this matter are: https://www.consumerfinance.gov/
Also file complaints with the FTC: https://www.ftccomplaintassistant.gov/#crnt&panel1-1
Also file a complaint with your State Attorney General's office.
