Got a call from 323-300-5792 ext 224 Jodi Simmons (direct line 626-671-8354) trying to get ahold of my mom. (first they were talking to me without my mothers permission) telling me that she owes $29,000 . She said that there are allegations against her, she said Death by Deception, Defrauding a financial institution.  Of coarse I was freaked out and so is she. Jodi even gave me the last four numbers of my moms c c # she sounded really convincing, they wanted to know how much she makes and her bills so that she can try and work with us on a lump sum or payment plan. I did not give her much info and have not given her any numbers at all. She said that the paperwork was on the lawyers desk and that they were getting ready to send them to the clerk of courts and swear out an arrest warrant on my mom. I am supposed to call her back tomorrow and she said that she would be able to cut off $19,000 (interest alone) off the balance but she would still be liable to pay the rest. I am soo glad that my husband told me to look up the number and glad people are writing about their calls too.  she also said that the c c# was from Washington mutual from 2008

    To PB:  Total scam.

There's no such thing as theft by deception or defrauding a financial institution as it relates to a civil debt.  This is a common scam allegation made by phony debt collectors.

There's no way an ordinary civil debt can be magically transformed into a criminal case.  Fraud and theft are crimes, and if they had occurred,  and you were a suspect, you'd already be interviewed by representatives of law enforcement on a face to face basis.  Debt is a civil matter.  Period.

Debt collectors have no influence on law enforcement.  No debt collector can "swear out" a warrant.  Warrants are only issued by local judges to duly constituted law enforcement officers and are only served by duly constituted officers of the law.  They are only used in criminal cases.  Debt collectors cannot get warrants.  Period.  You can check this out yourself by simply going down to your local police station and letting them know about his call.  They will verify that it is most like a debt scamming operation.

This whole business is simply a lot of legal mumbo-jumbo put out in  an attempt by someone to scare you into paying them something.   There is no paperwork anywhere.  Do not return the calls.  Ignore and block.  DO NOT PAY THEM ANYTHING AND DO NOT AGREE TO.

Just because a voice on the telephone claims you owe a debt does not mean you owe it
If a voice on the telephone claims you owe a debt:

    1.    Demand the person give you his or her name, company name, and address
    2.     Demand a debt validation letter by US mail.  E-mail no good.
    3.    Do not pay  the collection agent or anyone else a  DIME  until the debt is validated.

Of course they won’t do this, no scammer ever will, so simply block their calls and ignore them.

    If they are bothering you,

    Report them:

http://www.consumer.ftc.gov/articles/0149-debt-collection  (Threatening criminal prosecution to collect a civil debt is a clear violation of the Federal Fair Debt Collection Act)

Also contact your local attorney general

If they continue to bother you, and you know you do not owe any money,  tell them that you know this is  a debt scam and that you are making a complaint to the police for extortion.  You might have to yell at the scammer and talk over him or her.  Once you get a copy of the police report and they call you again , just read out the  file number and the name of the PD or Sheriff’s office involved.   Tell them you’ll be glad to send a copy to them at whatever address the jack***es are working out of now.  If you can find them.
