I get a call from this number at least twice a day during the week. They never leave a voicemail. When I answer it's a recording asking me to call if I am "Kimberly Lackey" or can confirm her address. I can't find a way to get these calls to stop, but I am NOT the person they are looking for! Frustrating!

I get a call every other week asking for Julie LaFontaine. I think this woman uses my phone number when she orders from QVS and the Home Shopping Network. Creditors call me often asking for Julie so I know it's not random. I don't know how to stop the calls though.

It is a collection agency. I started getting phone calls at least twice a day for the last 3 weeks and they never left a message. I answered and they wanted confirmation it was me. They wanted to collect on a disputed old bill that I settled about a year ago. I told them it was settled but they wanted proof and are trying to resettle again.

Whether you are called a debtor or some collector thinks you can flush one out, you have rights and options. Many are simple to exercise if you only learn how. You are entitled to proof of claim and fair treatment. If one or the other is not provided, the collection agency should *not* win your assets. You are granted control of how you are contacted, the right to dispute debt claims, and the means to sue violators at low cost. The FTC and the CFPB can start you on your homework. See also if your state laws grant additional or stronger rights.

You may have heard that in America the accuser bears a burden of proof. The FDCPA leans this way too. Debt collectors are supposed to have the right person and a correct amount and a valid claim before they go drilling for dollars. Contrary to what these collectors want you to think, it's not your job to prove you don't owe. Also, within that three weeks you were owed a paper notice outlining the debt claim and making required disclosures regarding your chance to raise a dispute, which certainly you have.

From misfiled comment by "CJ" on 08 Jul 2015:

"... It is a robocall and has called me 3-5 times a day for the last 2 weeks or so. ... a person picks up asking for my ex husband..... curious, I ask what this is regarding.  They tell me a "personal matter."

Anyways this conversation got out of hand, more calls came, and I filed a complaint with the FCC, after multiple requests to stop calling me as i am on the do not call list and for such a personal call.....obviously if they don't know whom they are calling......its not personal...

So my question is...what are my rights?  How did they get my number, especially years after a divorce? and can I get a copy of the recording of the phone call?"

The FCC and the DNCR do not apply to the "personal matter" or "business matter" of debt collection. The CFPB and FTC share primary federal oversight of the industry. Guidance to your rights and options is found in material I've linked to in this thread. I also have an essay handy addressing the rampant problem of skip trace calls.

Your phone numbers are not state secrets and will be found by a determined skip tracer through footprints left in commercial, financial, and governmental databases. It's unclear why you expect a call recording to be available, but if you want your own true copy you had best have recorded from your side. You're never getting one from the opposition without a lawsuit and a court order.
