- Same Here| 3 repliesHi, This is crazy because my aunt got a message from someone for me, the original caller didn't mention their name but said to call Bill Richards at 714 586 9292 because I was to appear in court. I never received a subpoena and as I am home all day everyday due to lack of work and attending online classes. I remember having something like this done to me before and which some woman said I had to make arrangements in order not to go to court. I was never able to keep the arrangements due to lack of money and I found out that they might not have had my account in the first place because I called the last collection agency who owned it. The only credit I've had recently is some phone bills from AT&T and they are about 1 yr old now. I think I will wait for the subpoena and then find out the truth. Thanks everyone for the input. If you have anything to add to my situation please let me know. Thanks!

- Emk replies to Same Here| 2 repliesThey harass you into calling them by saying they filed, or have papers to serve you, when all there doing us really trying to get some money. They didn't even own my account and wanted me to pay 1400 for a debt that was 6 years old. They said they sent someone out to serve me, which was funny because they had my address from 6 years ago, but she said she was looking at a current report. Well if they had current info she would know I moved 3 times since then! Just look through your credit report, and research what's on there, that's the best thing. There major scammers!!!!! If anyone has actually been sued by them please give the court info, because IRS public records anyways! But I really doubt anyone has!
- GM replies to Emk| 1 replyWhy do you all post this stuff. These are same people that sued me over a repo in 2009 and now i got a call almost 2 years later over a credit card i had with Bank of America. They didn't get anything from me on the Auto loan until they sold my truck at auction then i owed the difference they claimed they only got $6500.00 for it and my note still had $23,000 left.So I ended up owing almost $18,000 because of the lawyers as well.I will pay them out this time before court.they agreed to 172.12 a month for 15 months because I do not have a job.And i pointed out when I do go back to work my wage's will be garnished and they would have to wait in line anyway.I make more on unemployment now staying home then I will make when i go back to work because of the wage garnishment and my back child support.Legal aide told me there is nothing I can do and they advised me to "take a vacation" as along as I still get checks because it will be a long time before I see a full check again.Anyhow my point is there are some ways around things and I know it is not the most stand up thing to do but these guys can get you if they got me and unless you want to end up like me in round 1 just call them up or get a a paralegal to call them(it cost me $80) and set up small payments.Bad advice is to ignore a suit.
- Emk replies to GMI'm not ignoring them! First of all they claim to own my debt, and so does another company they actually proved it, they haunt proved anything but words. Second the statue of limitation expired on the debt and my lawyer informed me they can take me to court all they want but can't collect if it has expired! These people have been nothing but shady. If they prove they own it and it wasn't expired I would pay them, but since the credit card opened in 06 and nothing gas been done on the account since then, they can't fo anything!!!
- lostthis company called my work at told my employer that they needed to get a hold of me for a case and that I needed to call, they stated that they were from Stein and Associates. When my boss said that she shouldn't be the one to get this information they informed her that they just needed to make sure I got it. After reading the other post regarding this number I will not be calling them back and if they call my employer again I will have her suggest they don't call again.

- Resident47 replies to alanThis is really what these forums are for, sharing the puzzle pieces we have. To be fair, the debt industry is full of alphabet soup-like business names, where acronyms frequently clash. Many collectors have footprints in multiple states or boast of an "attorney network" to make it simpler to sue away from the home state. Names are changed like socks as the worst firms try to sidestep the inevitable piles of complaints and lawsuits.
Subsequent reports here indicate that my first instinct was correct, that whatever "process server" purports to be on the prowl is really part of a deceptive and extortionist collections practice, therefore illegal. I would agree that it's critical to get names and locations totally straight when building a FDCPA case.
