    I got the calls too and they finally got a hold to me today and the sparks flew. They didn't want me to get off of the phone so that I could call my attorney. Then at 7:00pm I get a call fromt he head guy after I hung up on his employee. I told him that I had an appointment in the morning with my attorney (I do) he asked why and I told him that since his employee told me that he was having me arrested then It hought an attorney would be in order. He didn't know what to say and then tried to tell me that neither he or his employees would ever say such a thing. But he did. Oh get this.. I pulled my report and the bill is only $800 but they told me that the bill was $6000!!!! What a HUGE PROFIT FOR THEM!!!

    they had an employee ny the name of vincent garyno call me to try and settle an old credit card from 2002.  This guy settled with me for around 2000 dollars.  the only reason I agreed to pay them was because they said they were going to take me to jail. I paid 4 payments to them in the amount of 500 dollars not exactly but more less. after setting up my last payment for March and still not recieving any type of invoice from them after repeatedly requesting something from them in writing about the settlement, and about how much I have paid still they have sent me nothing.  So I called back last week on wednesday and asked for Vincent Garyno and was told by Jason stroe that he was no longer employed there and I still owe 500 plus dollars.  I told him that was impossible because back in january i set up dates for them to take out the last two payments in february and march but he still said if i dont pay than he was going to just put it back up to about 6000 dollars.  I than told him to send me something in writing and yet still I have'nt recieved anything I even went as far as giving him my email to send it to me that way and nothing. Does anyone know what I could do to protect myself from these guys or what i could do to get some kind of help because I really can't afford an attorney but the lies and the deception really sucks.

    Basically what they have done is mispresented the amount of the debt, which is against Federal Law:

    § 807.  False or misleading representations  [15 USC 1962e]

    A debt collector may not use any false, deceptive, or misleading representation or means in connection with the collection of any debt. Without limiting the general application of the foregoing, the following conduct is a violation of this section:

    (1) The false representation or implication that the debt collector is vouched for, bonded by, or affiliated with the United States or any State, including the use of any badge, uniform, or facsimile thereof.

    (2) The false representation of --

    (A) the character, amount, or legal status of any debt; or

    (B) any services rendered or compensation which may be lawfully received by any debt collector for the collection of a debt.

    (3) The false representation or implication that any individual is an attorney or that any communication is from an attorney.

    (4) The representation or implication that nonpayment of any debt will result in the arrest or imprisonment of any person or the seizure, garnishment, attachment, or sale of any property or wages of any person unless such action is lawful and the debt collector or creditor intends to take such action.

    (5) The threat to take any action that cannot legally be taken or that is not intended to be taken.

    (6) The false representation or implication that a sale, referral, or other transfer of any interest in a debt shall cause the consumer to --

    (A) lose any claim or defense to payment of the debt; or

    (B) become subject to any practice prohibited by this title.

    (7) The false representation or implication that the consumer committed any crime or other conduct in order to disgrace the consumer.

    (8) Communicating or threatening to communicate to any person credit information which is known or which should be known to be false, including the failure to communicate that a disputed debt is disputed.

    (9) The use or distribution of any written communication which simulates or is falsely represented to be a document authorized, issued, or approved by any court, official, or agency of the United States or any State, or which creates a false impression as to its source, authorization, or approval.

    (10) The use of any false representation or deceptive means to collect or attempt to collect any debt or to obtain information concerning a consumer.

    (11) The failure to disclose in the initial written communication with the consumer and, in addition, if the initial communication with the consumer is oral, in that initial oral communication, that the debt collector is attempting to collect a debt and that any information obtained will be used for that purpose, and the failure to disclose in subsequent communications that the communication is from a debt collector, except that this paragraph shall not apply to a formal pleading made in connection with a legal action.

    (12) The false representation or implication that accounts have been turned over to innocent purchasers for value.

    (13) The false representation or implication that documents are legal process.

    (14) The use of any business, company, or organization name other than the true name of the debt collector's business, company, or organization.

    (15) The false representation or implication that documents are not legal process forms or do not require action by the consumer.

    (16) The false representation or implication that a debt collector operates or is employed by a consumer reporting agency as defined by section 603(f) of this Act.

    Hi, i work for rubin and yates, and i took the call from this individual.  She was uncooperative in rectifying her debt on terms satisfactory to the client. This individual found every excuse possible and used it as to why she couldnt pay her bill.  Shame on you zammada, you need to get your life together and save some money so you can pay off the multiple debts you owe.

    Jimmy these guys aren't lawyers they are a collection agency.  They dont represent Bank of America, they bought old debt from some one, probably didnt even buy it from bank of america, they probably bought it from some one that bought the debt from bank fo america and could not collect on it.  Bank of America would not let that fat [***] Jay Stroe near thier clients delinquent or not.  Collection agency lawyers are not as expensive as you think, check out www.naca.net to see what they say about debt collectors and get suited up.  Go to a radio shack and get a tape recorder as well it sounds like these guys are very microphone friendly.

    I have two conversations recorded already and these guys started saying it was against the law to record them and than started acting like a lawyer.  this guy really screwed me over forcing me to pay money I don't even have or else they were going to go back on the agreement and make me pay the full balance.  If anyone can refer a good lawyer so I can take action against these guys that would be great.

    I'm familiar with Rubin and Yates!!!!  All employed through this collection agency are wannabe Lawyers with NO power at all!!!!  Law school rejects who make their money harassing people!!!!  They go after people for false debts only to profit intrest themselves!!!!  How can you people sleep at night?  Guess it makes you feel powerful threating people and claiming they are going to be arrested!!!! This agency violates state and federal laws!!!!

    Well in order to use a recording as evidence in a court based situation you would of had to give a disclaimer basically just stating "You are being recorded"  Because it could be entrapment.

    Truth is, if you are getting calls the only way to really stop them is to pay off the debt. I recommend cutting deals or trying to get the interest knocked off because if they don't recollect on it they will just sell the debt again to another agency and then you will get calls from them.  You really can't run from your debt.   All agencies, bar none, are agressive in recollecting debts that are 3 plus years old.  If you havent paid in that long voluntarily, then obviously your not going to just pay with a simple "would you like to pay your debt today?"  NO!!  It's obvious anyone that owns debt is going to come hard for the money YOU LEGALLY OWE THEM!!! , what would you do if someone owed you 1000 plus dollars for YEARS!!!  [***], id tag on 25% interest and send some guys to your house!!!

    it seems like people that owe debts are more concerned with what debt collectors say over the phone than the key issue at hand.. the fact that YOU OWE A DEBT!!!  I mean, at least make a payment plan or something, pay 100 a month at the very least to try and improve your credit.  Im not saying give these agencies thousands up front, but obviously the industry is only getting more aggressive.  People aren't just going to let huge debts go, once your signature is on that credit agreement your bound by those terms. `

    These clowns are simply third party debt collectors. Typically a third party debt collector will say anything over the phone to get you to pay them even if you don't actually owe the money.  Violating the Fair Debt Collection Practices Act is nothing new for most debt collectors, especially this one! If you feel that this debt collector has violated your rights you may want to file a complaint with The New York State Attorney's Office Consumer Protection Bureau 120 Broadway New York, New York 10271 Telephone: (800) 771-7755.  A posting above made reference to the web site www.naca.net  They are the National Association of Consumer Advocates.  Their web site has information about various consumer related issues including debt collector abuse.  They also have information on finding an attorney should you feel compelled to do so.  This debt collector appears to use two other telephone numbers.  866-237-6191 and 866-350-0460  Google the last phone number or type it in the search bar at www.800notes.com  to see what other people have had to say about their experience with this debt collector.
