    No message left, likely scam collector.   Called back and Mr. Westbrook refused to tell me what their company was.  Went on to say that he was recording my voice.   Hung up.    Blocking the number from now on.

    Called to tell me that "they" were in the process of deciding whether or not to file a lawsuit against me. Press one to speak to a rep regarding lawsuit or press 2 to provide my attorney info. Call cut off before I could press either, not that I would have.

    BBB has seen a major increase in collection agencies starting business in the Upstate New York area over the past several years. In an effort to keep consumers informed about which collection agencies are operating in accordance with federal and state law, we have asked for specific information from all collection agencies located in our service area, including proof of licensing, bonding, and or registration required by NY state or other governments where the business is located, as well as proof of licensing required by any state in which the business operates. This collection agency has not responded to our requests. BBB advises consumers to be aware of their rights in regard to collections. This includes New York States law prohibiting any collection agency from collecting on Payday loans in the State of New York. The Fair Debt Collection Practices Act (FDCPA) outlines prohibited behavior when attempting to collect a debt, and outlines specific rights for consumers. There are penalties for agencies found in violation of the Act.     They just called my house I look the number up and found this site and asked to speak with "Mr. Westbrook" and just so happen the man on the line was mr.Westbrook so he says, I called him out and he became very defensive then i asked to speak to a supervisor (poor attempt of a voice change) who also got defensive...bottom line its a scam dont give out any information what so ever

    This number called my husband's phone, yesterday, and left a detailed message regarding me and threatening a lawsuit, which I thought was illegal to leave via voicemail. Anyway, when he called the number back they did not answer. I do not or have I ever gotten a payday loan, which is what they said they are collecting on.  I called the number, today, and some guy answered. He did not say who he was or what company he was with.  I told him to stop contacting me and my husband because I am aware of this call being a scam and he hung up on me. My husband contacted his attorney and they said to set a fraud alert on our credit reports, because these people have all our information.  It is quite scary what people can get their hands on.  Please be aware.

    I received an automated message indicating I had written a bad check. I've never written a bad check in my life. Clearly, a scam call. It's illegal to threaten legal action or to "show up" at your home or business. The voicemail was transferred to the authorities in my county. The confirmed this was a scam call.

    These scam artists are a joke. Now we call people to alert them we are coming to serve legal papers?! Yeah right. One of many clues that they are full of s*** , no REAL process server would ever alert anyone they are coming to serve you. They do not set up times with you to meet. Nice try morons. If you are contacted by these idiots, do not give them any info, refuse to verify anything and report them to the Attorney General in your state and the department of commerce and the ftc. They are fake. Don't fall for it.

    They keep calling leaving voicemail mails saying they need my signature on legal paperwork and will come to my home or address and if I am unavailable they will return the paperwork to the mediation office.

    The fake process server/location finder extortion SCAM usually consists of the following:

    They mention that they have received a Fax document or some sort of complaint and that there is a pending legal matter or action about to filed against you to create the sense of urgency.  They tell you that they are a “process server” and cannot give you the particulars of the case since the file is sealed. This is simply ruse to get you to call another number (often with a made-up case number) where they will ask for money to “make it go away” (this is actually the same place, they work in teams, one pretending to be the server, and the other usually pretends to be a lawyer).  They threaten to serve you at home or at work.  They tell you that if they serve you at work then they will need a supervisor, security, or HR person there as a witness, hoping that will cause you to panic over the alleged embarrassment of being served at work.  They also tell you that you will need two forms of ID.  None of which is true.  Process servers do not ever call ahead so that you can dodge them.  Process servers get paid to serve papers, nothing else.  They certainly are not going to pass up a paycheck by telling you that you can avoid being served, they are not going to give you an extra day or even a few hours to get a “stop order”.  Court documents are time sensitive and must be served within a certain amount of time.  Remember that you can always call the local courthouse to see if there really is a lawsuit that has been filed against you.

    It is incumbent upon them under the law to prove that the debt exists and that you owe it, and (this is the important part) that they have the legal right to collect it.  You are not obligated under the law to prove that you don’t owe or that it is paid.  

    Federal law (FDCPA) requires them to send you a letter (US MAIL ONLY) postmarked within 5 days of their first contact that contains their name, physical address, the creditor’s name, and the amount of the alleged debt. It also must contains “mini-Miranda” telling you that it is an attempt to collect a debt and that all information will be used for those purposes.  The one other important thing that this letter must also have in it is that you have a right to dispute the debt within 30 days of receipt of the letter and if you do so, all collection activity must be stopped until the debt is verified.  If and when you get that letter you should immediately send that debt validation letter by certified, return receipt mail.
