- Mississippi Housewife| 1 replyIgnore - Ignore ....this is a bill collector or someone to commit IDENTITY FRAUD aka Investigators. LEFT THREATENING MESSAGE ON ANSWERING MACHINE. Says he's Investigator Mercer. Threatens you with police and says he's sending someone to your house - that you have committed criminal activity and he's going to have a police officer at your house to arrest you, THAT HE HAS SPOKEN WITH THE POLICE (although he can't tell you the police station name or the person he spoke to). Leaves threatening messages and when you speak to him - do not verify the last 4 digits of your social security number. Says he represents Tri-State Attorneys. Numbers are 716-362-9219 (ON CALLER ID with WCS New York) and tells you (or have your attorney) to call in 72 hours to 866-397-1612 with case numbers. These people are the R E A L dead beats who can't get a descent respectable job. Be sure to watch any activity on your credit cards and bank statements. Just got the call today 7/3/08, but I have been a victim of Identity fraud in the pass. P.S. I owe no one any money, especially anything delinquent. Everything is current. The only conclusion is this is IDENTITY F R A U D. DO NOT RETURN PHONE CALL!!!!!!!
ASK HIM WHAT STATE HE'S CALLING FROM (MINE SAID NEW YORK) AND THEN TELL HIM THAT YOU ARE GOING TO REPORT HIM TO THE NEW YORK ATTORNEY GENERAL'S OFFICE. HE WILL HANG UP.
Remember this about old debts: companies that buy debt at pennies on the dollar and then try and collect on it. DO NOT deal with these jerks. Tell them you WILL NOT DEAL WITH THIRD PARTIES. If you do owe the money, inform them you will only deal with the ORIGINAL CREDITOR. By law, they must now STOP CALLING you and inform the OC that you are willing to deal with them. Since the OC already wrote you off, you will never hear from them.

The collection of debts is a CIVIL and NOT a CRIMINAL matter. And, Mississippi Housewife, these CRIMINALS have broken Section 807 of the
of the FDCPA by threatening to have you arrested and misrepresenting the legal status of this BOGUS debt:
§ 807. False or misleading representations [15 USC 1962e]
A debt collector may not use any false, deceptive, or misleading representation or means in connection with the collection of any debt. Without limiting the general application of the foregoing, the following conduct is a violation of this section:
(1) The false representation or implication that the debt collector is vouched for, bonded by, or affiliated with the United States or any State, including the use of any badge, uniform, or facsimile thereof.
(2) The false representation of --
(A) the character, amount, or legal status of any debt; or
(B) any services rendered or compensation which may be lawfully received by any debt collector for the collection of a debt.
(3) The false representation or implication that any individual is an attorney or that any communication is from an attorney.
(4) The representation or implication that nonpayment of any debt will result in the arrest or imprisonment of any person or the seizure, garnishment, attachment, or sale of any property or wages of any person unless such action is lawful and the debt collector or creditor intends to take such action.
(5) The threat to take any action that cannot legally be taken or that is not intended to be taken.
(6) The false representation or implication that a sale, referral, or other transfer of any interest in a debt shall cause the consumer to --
(A) lose any claim or defense to payment of the debt; or
(B) become subject to any practice prohibited by this title.
(7) The false representation or implication that the consumer committed any crime or other conduct in order to disgrace the consumer.
(8) Communicating or threatening to communicate to any person credit information which is known or which should be known to be false, including the failure to communicate that a disputed debt is disputed.
(9) The use or distribution of any written communication which simulates or is falsely represented to be a document authorized, issued, or approved by any court, official, or agency of the United States or any State, or which creates a false impression as to its source, authorization, or approval.
(10) The use of any false representation or deceptive means to collect or attempt to collect any debt or to obtain information concerning a consumer.
(11) The failure to disclose in the initial written communication with the consumer and, in addition, if the initial communication with the consumer is oral, in that initial oral communication, that the debt collector is attempting to collect a debt and that any information obtained will be used for that purpose, and the failure to disclose in subsequent communications that the communication is from a debt collector, except that this paragraph shall not apply to a formal pleading made in connection with a legal action.
(12) The false representation or implication that accounts have been turned over to innocent purchasers for value.
(13) The false representation or implication that documents are legal process.
(14) The use of any business, company, or organization name other than the true name of the debt collector's business, company, or organization.

- Another Housewife replies to Mississippi HousewifeThanks for the warning Mississippi housewife. I recieved a message today 10/8/08 from 716-362-9219 (WCS New York) and the same incident happened. You are right the message was threatening. I called my husband telling him that an investigator wanted a statement in regards to two filed charges and he needed to call back the investigation unit (866-397-1612) and it would be in his(my husband)best interest to cooperate with authories. Well, the "investiagtor" that I am, I looked the number up and saw your warning. I called my husband to tell him. Thanks.

RE: [insert account number or name of account or name of debt]:
Dear [insert collector's name or company name],
This letter is in response to your [letter dated xx-xx-2005] (copy enclosed) or [phone call on xx-xx-2005], concerning the collection of the above referenced [account or date].
I do not believe I owe what you say I owe therefore I dispute this debt. I am well aware of my rights under the Fair Debt Collection Practices Act (FDCPA) and my state laws so I hope to save both of us a great deal of time by letting you know that not only do I dispute the validity of this debt, I have also checked with my State Attorney General and verified that the Statute of Limitations for enforcing this type of debt through the courts in (insert your state or the state in which the contract was signed) has expired. Therefore, should you decide to pursue this matter in court I intend to inform the court of my dispute of this debt and that the "statute of limitations" has expired.
This letter is your formal notification that I consider this matter closed and demand that you, or anyone affiliated with your company, stop contacting me regarding this or any other matter except to advise me that your debt collection efforts are being terminated or that you or the creditor are taking specific actions allowed by the FDCPA or my state laws.
Be advised that I consider any contact not in accordance with the Fair Debt Collection Practices Act a serious violation of the law and will immediately report any violations to my State Attorney General, to the Federal Trade Commission and, if necessary, take whatever legal action is necessary to protect myself. Be advised that I tape record all phone calls and violations of the FDCPA can result in you or your company being personally fined up to $1,000 per incident.

http://www.fair-debt-collection.com/Disputing ... ute-letter.html - meowmixOn 01/26/2009 at 11:14AM I recieved a call from this phone # 716-362-9219. The caller claimed to be an investigator named Anthony Carter. He claimed to be investigating a case (#B112058). He was triing to locate a Leroy Lockridge. He claimed that a complaint had been filed with them against this person. After questioning this person he told me to have Leroy call this # 866-916-3494. After he gave me this number he said "thank you" and hung up. After triing to call back on both of these numbers, I was unable to get through. this was when I decided to google search these numbers and found this posting. Before completing and posting this comment, I tried to call back one more time on 716-362-9219. This time a switchboard opperator named Mike Rosedale answered. When I asked what company this was, Mike told me it was World Wide Consumer Search Corp., in New York. After giving Mike the case # given to me by Anthony Carter, Mike transfered me to Anthony. Anthony would not give me any info regarding why they are looking for Leroy Lockridge, unless I told him I was Leroy. Since I was not Leroy and I refused to say that I was, Anthony hung up on me again. Mike and Anthony had different voices but, both sounded like they were black. I also heard different background sounds when talking with each of them and could tell that it was some kind of call center. (simmiliar to what you hear behind telemarketers) This is the second time I have recieved a call from someone claiming to be an investigator, looking for someone I have never heard of. Unfortunately, I did not make a note of the previous number used.
