David Rosenberg calling for my Daughter in Law said she put my number down for a second number (NOT) she needed to get back with him about a debt by end of day or legal action. They wont cooperate with my Daughter she has spoken to them she request them to send her a certified letter of what it is by sending info in mail (THEY SAID NO). She is not going to give out her information to random calls or money. So now they are calling my Husband to get in touch with her so I called them back again to tell them to stop calling my husband. THIS IS HARRASSMENT!!!

I also got a call today asking "solely" for my son, who is a severely handicapped adult who has no credit in his name nor any wages, no phone numbers in his name, etc.  Since they called MY Google voice number that I see comes up with zero results on Internet searches with or without our last name attached to the search, and the only other person who may have debt that is trying to be collected that is old is my son's father with the same name who he hasn't seen in 10 years, then you can deduce this collections dirt bag who is  threatening people all over the place is not Google searching but rather using public data bases and public records on which people like me are listed with their phone number, which isn't many, and he is looking for OTHER RELATIVES TO HARASS In the hopes they become so frightened that they give up the location and phone number that they know the other person to possess.  There is no way in hell my son is listed with this number anywhere in the world, not one, so although this dirtbag knows the number belongs to me with the same last name only, he has decided to harass people who he thinks he can help him FIND his target.  This is why he says the word solely in his messages, because he has to convince you that he legitimately thinks this is the number for his target and not the fact that he is doing something illegal like intentionally calling people to harass them repeatedly in an effort to INVESTIGATE AND HUNT.  He knows darn well the person he is asking for is not listed with the number he is calling, but he hopes that person is either there anyway for some reason or you know where his target is.  I suggest you take this information coupled with your log list screenshots from your phone of how many times this dirtbag called you to harass you even though you don't owe him anything and report it to your state's attorney general office In the hopes they will remove his license for illegal collection practices.  Also, it may or may not help for people to post the number he was calling from here in the comments so that they can be entered into an address book entry to be identified and/or blocked.

The reason dirtbags like that feel the need to spoof a phone number and then give a real number for you to contact them that is because when you go to look up the real number, the one he gives you, you will immediately see other people complaining about who he is and what he is doing. Additionally, most people will put a block on the number which Is the one you see on that phones display, so he can call you back as many times as he likes and not be blocked if he keeps changing the number to something other than his real number every single time he calls you.  additionally, the number he is calling you from may not even be the one he is telling you to call. The number he is calling from he certainly doesn't want YOU to harass HIM by calling his regular incoming line! He more than likely gave you an extension number on the number he wants you to call, because that is the only phone number he wants you and others to phone in on.  I don't even think there is a REAL extension number to be honest. I think when you call in, you will probably get a live person To whom you have to ask for your extension number, and that extension number is probably just a file number. Everyone of his targets probably has a number on their file, so if you call Lynn and say you would like extension 102 or something like that, He immediately knows right off the bat which phone number he called they got you to call him! You can be as anonymous as you like and tell him you don't want to give your name and you may have even blocked your phone from being displayed, but he already knows who you are because you gave him that extension number which is really a case number.  Your best bet in a case like this to someone who is not even calling for you and is menacing/threatening to you Is to report the number he told you to call to your states attorney general office for harassment so that they can hopefully remove his license to practice debt collection If they get enough complaints or if they feel one or a few individual charges were severe enough to warrant it.

If any debt collector calls you and threatens you with law enforcement and tells you you will be arrested if you do not comply with him, you need to report that to your state attorney general office and give them the number he told you to phone him at.

When a debt collector crosses the line and starts to harass people he knows he is speaking actually do not owe the debt, and those people tell him not to phone that phone number any longer that does not belong to the target they are looking for, then that is clear case harassment and you need to report the phone number he told you to call into to your state Attorney generals office.  If he gets enough complaints or if any one or a few of them are severe enough, they will remove his license or suspended it so that he cannot practice debt collection.

One of the tricks they use is to call your family, friends, neighbors and/or places of employment (past or present or both) to create panic and embarrassment so that their intended victim calls them so that they can scare that person into paying extortion money.  They will usually also state information that would be illegal for a real debt collector to state to a third party such as that you are being sued, that you owe money to someone, etc. They threaten that if you do not call them back, they will contact your HR department and tell them that you are a deadbeat who does not pay their bills.  They often call people that have never even been associated with you because they get erroneous information off the internet.

The fake process server extortion attempt usually consists of the following:

They mention that they have received a Fax document or some sort of complaint and that there is a pending legal matter or action about to filed against you to create the sense of urgency.  They tell you that they are a “process server” and cannot give you the particulars of the case since the file is sealed. This is simply ruse to get you to call another number (often with a made-up case number) where they will ask for money to “make it go away” (this is actually the same place, they work in teams, one pretending to be the server, and the other usually pretends to be a lawyer).  They threaten to serve you at home or at work.  They tell you that if they serve you at work then they will need a supervisor, security, or HR person there as a witness, hoping that will cause you to panic over the alleged embarrassment of being served at work.  They also tell you that you will need two forms of ID.  None of which is true.  Process servers do not ever call ahead so that you can dodge them.  Process servers get paid to serve papers, nothing else.  They certainly are not going to pass up a paycheck by telling you that you can avoid being served, they are not going to give you an extra day or even a few hours to get a “stop order”.  Court documents are time sensitive and must be served within a certain amount of time.  Remember that you can always call the local courthouse to see if there really is a lawsuit that has been filed against you.

It is incumbent upon them under the law to prove that the debt exists and that you owe it, and (this is the important part) that they have the legal right to collect it.  You are not obligated under the law to prove that you don’t owe or that it is paid.

Federal law (FDCPA) requires them to send you a letter (US MAIL ONLY) postmarked within 5 days of their first contact that contains their name, physical address, the creditor’s name, and the amount of the alleged debt. It also must contains “mini-Miranda” telling you that it is an attempt to collect a debt and that all information will be used for those purposes.  The one other important thing that this letter must also have in it is that you have a right to dispute the debt within 30 days of receipt of the letter and if you do so, all collection activity must be stopped until the debt is verified.  If and when you get that letter you should immediately send that debt validation letter by certified, return receipt mail.

First, you should make a complaint at this Federal Agency, and while there you should also read up on how debt collection is supposed to work as well as what your rights in this matter are: https://www.consumerfinance.gov/

Also file complaints with the FTC: https://www.ftccomplaintassistant.gov/#crnt&panel1-1

Also file a complaint with your State Attorney General's office.
